BE IT ORDAINED BY THE CITY COUNCiI OF THE CITY OF FART WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2(~2- 2403 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $104,004.00, subject to receipt of an executed contract, far the purpose of funding an amendment to City Secretary Contract Na. 28464 with the Texas Commission on Environmental Quality to operate and maintain particulate matter 2.5 samplers. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining pravisians shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in Chase instances where the previsions of this ordinance are in direct conflict with such other ordinances and apprapriatians, in which instance said conflicting pravisians of said prior ordinances and apprapriatians are hereby expressly repealed, SECTION 4. This ordinance shall take effect upon adoption. AGREEMENT WITH THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR THE OPERATION OF PM 2.5 SAMPLERS RECOMMENDATION: It is recommended that the City Council: Authorize the City Manager to execute an amendment to City Secretary Contract No. 28060 with the Texas Commission on Environmental Quality to operate and maintain PM 2.5 samplers for the period September 1, 2003, through August 31, 2004; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $104,000 in Fiscal Year 2002-2003, subject to receipt of an executed contract. DISCUSSION: In 1998, the U.S. Environmental Protection Agency revised its measurement standards for particulate matter {PM} emissions into the atmosphere. Since FY1999-2000, the Texas Commission an Environmental Quality has contracted with the City for operation and maintenance of the monitoring equipment they provide for five PM monitoring stations. The location of each station is as follows: Environmental Resource Center 5000 Martin Luther King Freeway {2 monitors} Diamond Hill Community Center 1701 NE 37th Street {1 monitor} Haws Athletic Center 600 Congress Street {2 monitors} The City is responsible for retrieving the sampling data, sending it for analysis, and performing regular maintenance activities on the equipment under the terms of this contract. The current amendment changes the total contract amount from $104,000, to $208,000, and specifies the amendment term is from September 1, 2003, through August 31, 2004.
