HomeMy WebLinkAboutOrdinance 21049-12-2013 ORDINANCE NO. 21049-12-2013 AN ORDINANCE AMENDING ORDINANCE NO. 19262 TO REFLECT THE CORRECT ZONING DISTRICT INFORMATION FOR ZONING CASE ZC-10-116; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE WHEREAS, on August 03, 2010, the City Council approved a request in Case No. ZC- 10-116 to rezone properties generally bounded by Angle Avenue, NW 28`h Street, N. Main Street, and Meacham Airport, from "B" Two-Family, "C" Medium Density Multifamily, "D" High Density Multifamily, "E" Neighborhood Commercial, "FR" General Commercial Restricted, "F" General Commercial, "I" Light Industrial, "Y' Medium Industrial, "K" Heavy Industrial, and "PD-834" Planned Development to "A-5" One-Family, "B" Two-Family, "CF" Community Facilities, "ER" Neighborhood Commercial Restricted, "E" Neighborhood Commercial, "FR" General Commercial Restricted, "F" General Commercial, "I" Light Industrial, "Y' Medium Industrial, "PD-848" Planned Development, and "PD/FR" Planned Development for all uses in "FR" plus compressor sales and service, max. 50 hp on any one machine, no metal cutting, welding, or acid washes; site plan waived; WHEREAS, the City Council voted to approve the above mentioned case, but Ordinance No. 19262 incorporating the City Council's zoning decisions from the August 03, 2010, meeting does not reflect the correct zoning district for 102 NW 28" and 102 NW 29"' Streets permitted in the zoning case information; WHEREAS, it is advisable to amend Ordinance No. 19262 with regard to Case No. ZC- 10-116 only, in order to reflect the zoning district permitted for the two properties; Ordinance No. 21049-12-2013 Page 1 of 4 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. Ordinance No. 19262 an amendment to Ordinance 13896, is amended to correct the zoning information for Case No. ZC-10-1 16, as follows: ZC-10-1 16 102 NW 28 " Street and 102 NW 291h Street Zonin,- Chan,-e: From: "I"Light Industrial and "K"Heavy Industrial To: V" General Commercial NUMBER STREET PARCELLEGAL 102 NW 28"' St Ellis, MG Addition, Block 60 Lot 2 i-O-2 NW 29"' St Ellis, MG Addition, Block 60 Lot 1 SECTION 2. This ordinance corrects Ordinance No. 19262 with regard to Case No. ZC-1 0-116 only, SECTION 3. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after full and complete public hearing with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular Ordinance No. 21049-12-2013 Page 2of 4 uses and with a view of conserving the value of a building and encouraging the most appropriate use of land throughout the community. SECTION 4. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 5. All rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No. 13896 or of any amendments thereto that have accrued at the time of the effective date of this ordinance; and as to such accrued violations, and all pending litigation, both civil or criminal, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any ph-rase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent Jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be tined not more than Two Thousand Dollars ($2000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. This ordinance shall take effect upon adoption and publication as required by law. Urban Forestry — A complete Urban Forestry Plan, including Part I and Part 11, shall be completed for the entire property included in the area zoned PD/l, as required through Section 6.302 Urban Forestry. The Plan shall be submitted upon replatting of the property or the first building permit after approval of the zoning. Total canopy coverage shall be determined by the total of the canopy requirements for industrial uses. Tree planting may be accommodated within the identified Urban Forestry Plan area, including street trees, parking and landscaping islands. DISCUSSION: On January 4, 2011, the City Council adopted Ordinance No. 19516 (ZC-10-189, PD-896) approving a request to rezone the City of Fort Worth Public Events Will Rogers Area to include all uses in "I" Light Industrial, excluding certain unwanted uses but allowing additional permitted uses that are typically conducted in the Will Rogers Memorial Center, The complete list of the additional uses was included in the development standards that were adopted with the district and attached as an exhibit to Ordinance No. 19516 but not in the main body of the ordinance. Adding a complete list of additional uses to the body of the ordinance will clarify what is permitted within the district and aid in plans review. A correction ordinance is needed for PD-896 in order to reflect the complete list of additional permitted uses within the Will Rogers Memorial Center. This project is located in COUNCIL DISTRICT 7. On August 3, 2010, the City Council adopted Ordinance No. 19262 (ZC-10-116) approving the rezoning of 102 NW 28th and 102 NW 29th Street, known as the City of Fort Worth Far Greater Northside Neighborhood, Phase 4 to "F" General Commercial. Ordinance No. 19262, incorporating the City Council's zoning decisions from the August 3, 2010 meeting, does not reflect the correct zoning district for 102 NW 28th and 102 NW 29th Streets. A correction ordinance is needed in order to reflect the correct zoning district for two parcels. These projects are located in COUNCIL DISTRICTS 2 and 7, Mapsco 62C and 75H.
