HomeMy WebLinkAboutOrdinance 21070-12-2013 Ordinance No. 21070-12-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE COMMUNITY TREE PLANTING PROGRAM FUND IN THE AMOUNT OF $399,956.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Community Tree Planting Program Fund in the amount of $399,956.00, from available funds, for the purpose of funding the Community Tree Planting Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the use of $399,956.00 of Tree Removal Fee Revenue to fund the Community Tree Planting Program-, and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Community Tree Planting Program fund in the amount of$399,956.00 from available funds. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the use of Tree Removal Fee Revenue to fund the Parks and Community Services Department's Community Tree Planting Program (Program). During the Fiscal Year 2009 budget deliberations, the City Council directed and subsequently authorized, the use of three funding sources in order to continue the Program, which was slated for elimination. These sources included Tree Removal Fee Revenue, Parks Gas Well Royalty Revenue and monetary donations from Chesapeake Energy Corporation. Chesapeake committed to donate the amount of$100,000.00 per year to the Program for five years for a total amount of $500,000.00, The Fiscal Year 2013 budget included the fifth and final committment from Chesapeake. This is the first year the Program will be funded solely through the Tree Removal Fee Revenue, The Tree Removal Fee Revenue source is comprised of tree removal mitigation fees collected through the tree ordinance administered by the Planning and Development Department and from tree removals on City property administered by the Parks and Community Services Department. The tree fund does not have a consistent or predictable revenue stream. Funding for the Program provides for six authorized positions consisting of two foresters and a four-person nursery production/tree planting crew and related supplies, materials and services. The Program provides approximately 1,600 trees annually for neighborhood associations and organizations for community tree planting projects on public property. Additionally, the foresters included in this Program manage the Citizen Forester Program and other volunteer programs that train volunteers for tree planting, data collection and ongoing care and maintenance of the City's tree farm.
