AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT
OF $145,317.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING
A CONTRACT WITH WILLIAM J. SCHULTZ, INC. DiB/A CIRCLE "C"
CONSTRUCTION COMPANY, FOR SANITARY SEWER R-EHAMIA"FATION,
CONTRACT 79; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer
Capital Projects Fund in the amount of$145,317.00, from available funds, for the purpose of executing a
contract with William J. Schultz, Inc. d/b/a Circle "C" Construction Company, for Sanitary Sewer
Rehabilitation, Contract 79.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be Cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repeated.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of a Contract with William J. Schultz, Inc. d/b/a Circle "C" Construction Company, in
the Amount of $2,977,235.00 for Sanitary Sewer Rehabilitation, Contract 79, on Riverside Drive, Berry
Street, Ellis Ranch Trail, Fairway Drive, Glen Garden Drive, Stardust Lane and Three Easements, Provide
for Project Costs and Contingencies for a Project Total in the Amount of $3,122,552.00 and Adopt
Appropriation Ordinance (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize a transfer in the amount of$145,317.00 from the Water and Sewer Operating Fund to the
Sewer Capital Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $145,317.00 from available funds; and
3. Authorize the execution of a contract with William J. Schultz, Inc. d/b/a Circle "'C" Construction
Company, in the amount of$2,977,235.00 for Sanitary Sewer Rehabilitation, Contract 79.
DISCUSSION:
On July 12, 2011 , (M&C C-25000) the City Council authorized an Engineering Agreement with Pacheco
Koch Consulting Engineers, Inc., for Sanitary Sewer Rehabilitation, Contract 79 for the preparation of
plans and specifications for the rehabilitation of deteriorated sewer mains on Riverside Drive, Berry Street,
Ellis Ranch Trail, Fairway Drive, Glen Garden Drive, Stardust Lane and three easements.

The project also includes the installation of the following sanitary sewer mains and laterals:
• M-1 02R - Beginning from the Ellis Ranch Trail/Briardale Road intersection northerly 1,350 feet, then
easterly 200 feet then northerly 1,050 feet consisting of the installation of a 66-inch sanitary sewer
pipe.
• L-3541 - Located on easement between houses on Glencrest Drive and Timberline Drive.
• L-4089 - Beginning from a point located 650 feet west of the Riverside Drive/Highpoint Road
intersection northerly 200 feet then 200 feet on Clearview Drive.
The project was advertised for bid on August 29, 2013 and September 5, 2013 in the Fort Worth Star-
Telegram. On October 3, 2013, the following bids were received:

M/ WBE Office - William J. Schultz, Inc. d/b/a Circle "C" Construction Company is in compliance with the
City's BIDE Ordinance by committing to 3 percent MBE participation and documenting good faith effort.
William J. Schultz, Inc. d/b/a Circle "C" Construction Company identified several subcontracting and
suppliers opportunities. However, the MBE's contacted in the areas identified did not submit the lowest
bids. The City's ("JIBE goal on this project is 10 percent.
Most State Revolving Loans are granted for construction contracts only. Since no other expenses can be
covered by the SRF funding, additional appropriations of$145,317.00 ($56,000.00 for construction
staking, project management, material testing and inspection and $89,317.00 for project contingencies)
are needed from the Sewer Capital Projects Fund.
The project is located in COUNCIL DISTRICT 8, Mapsco 77Z and 91 D.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Clean Water SR F2007 Fund and upon approval of the above
recommendations and adoption of the attached appropriation ordinance, funds will be available in the
current capital budget, as appropriated, of the Sewer Capital Projects Fund.
