AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
AN ALLEY AND BELLAIRE DRIVE NORTH AND THE REMAINING
PORTIONS OF GRISHAM WAY AND MID COURT LOCATED IN
BLOCK 22 OF THE BELLAIRE ADDITION AND BLOCK 12 OF THE
TCU ADDITION, ADDITIONS TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS AS RECORDED IN VOLUME 902, PAGE
557, AND INSTRUMENT NO. D212168304 RESPECTIVELY OF THE
DEED RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING
APPROXIMATELY 28,975 SQUARE FEET OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF
EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following alley and public open space easements described below:
I Being that portion Mid Court a 50-foot wide street and a portion of a 25-foot
alley located in Block 22, Bellaire Addition, an addition to the City of Fort
Worth, Tarrant County Texas as recorded in Volume 902, Page 557 of the
Deed Records of Tarrant County, Texas, and Lot IR, Block 12, TCU
Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as
recorded in Instrument No. 212168304 of the Deed records of Tarrant County,
containing 16,076 square feet of land more or less;
2. Being Grisham Way a variable width right-of-way according to plat of Lot I R,
Block 12 TCU Addition, an addition to the City of Fort Worth, Tarrant
County, Texas as recorded in D212168034, containing 9,857 square feet of
land more or less,
3. Being a portion of Bellaire Drive North according to plat of Lot IR, Block 12
TCU Addition, an addition to the City of Fort Worth, Tarrant County, Texas,
as recorded in Instrument No. D212168034 of the Deed Records of Tarrant
County, Texas, containing 3,042 square feet of land more or less;

and as more specifically described in Exhibits "A" and "B" attached hereto and
incorporated herein, by reference be and the same are vacated and extinguished.
SECTION 2.
That the fee to the lands in the above-described vacated alley and streets are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a portion of MID COURT, a 50.0 foot wide street, and a portion of a 25Ft
alley, originally dedicated by plat of Bock 22 of the Bellaire Addition an addition
to the City of Fort Worth recorded in Volume 902, Page 557 of the Deed Records
of Tarrant County, Texas (DRTC), and according to plat of Lot 1R, Block 12 TCU
Addition an addition to the City of Fort Worth as recorded in D212168304
DRTC, said tract being tied to the Texas Coordinate System, North Central
Zone, NAD83, bearings are grid, distances are horizontal ground measurements
and being more particularly described as follows;
BEGINNING at a found 5/8" brazed iron pin in the east right of way of Mid
Court being N 89'54'45" E 50.0017t, from the northeast corner of Lot 12, Block
22 of the said Bellaire Addition;
THENCE, S 00-05'15" E, with the east right of way of Mid Court, 165.00Ft to a
point being in the south line of the said Mid Court as a result of a previous
street vacation by Ordinance No 19264-08-2010 according to plat for Lot 2R,
Block 12 TCU Addition recorded in D210203296 DRTC, said point being in the
projection of the south line of the said 25Ft alley;
THENCE, S 89-54'45" W, continuing along the south line of 25Ft alley

THENCE, N 00-05'15" W, 25.00Ft to a point in the south line of Lot 6, Block 22
of the said Bellaire Addition and the north line of a said 25Ft alley ;
THENCE, N 89-5445" E, with the south line of Lots 6 through 12 of the said
Block 22 Bellaire Addition, 312.8017t to a point in the west line of the said Mid
Court,
THENCE, N 0005'15" W, with the west line of the said Mid Court, 140.0017t to
the northeast comer of the said Lot 12 and being in the south line of the said

ground measurements and being more particularly described as follows:
Beginning at a found 5/8" brazed iron pin at the northeast intersection of
Grisham Way and Bellaire Drive North, said point being at the beginning of a
curve from which the center bears S 67'43'57" E 58.00Ft,
THENCE, southeasterly with said curve through a central angle 23'58'13",for a
distance of 24.2 IR to a found 5/8 brazed iron pin and being the beginning of a
non-tangent curve from which the center bears N 73'27'08" E 80.63Ft;
THENCE, southeasterly, with said curve through a central angle of 36'05'54",
for a distance of 51.1OFt to a found 5/8" brazed iron pin;
THENCE, N 89054'45" E, 89.5 1 Ft to a P/K nail for the northeast comer of the
said Grisham Way;
THENCE, S 00"05'15" E, 40.00Ft to a found 5/8inch iron pin for the southeast
comer of the said Grisham Way;
THENCE, S 89054'45" W, with the south right of way of Grisham. Way 187.00Ft
to a found 5/8inch brazed iron pin;

Bellaire Drive North
Being a portion of Bellaire Drive North as according to the plat of the said Lot
1R, Block 12 TCU Addition and being the result of the vacation of Kent Street
by City of Fort Worth Ordinance No.7529, said tract being tied to the Texas
Coordinate System, North Central Zone, NAD83, bearings are grid, distances
are horizontal ground measurements and being more particularly described as
follows:
BEGINNING at a found °T' cut in concrete being in the south right-of-way of the
Bellaire Drive North and also being the northwest comer of the said Kent Street
as vacated by said Ordinance;
THENCE S0005'15"E, 50.00ft to a found P/K nail for the northwest re-entrant
comer of the said Lot I R, Block 12 and also being the southwest corner of the
said Kent Street vacation;
THENCE S8905445"W, 121.66ft to a point in the said south line of Bellaire
Drive North;
THENCE N67034'15"E, 131.54ft to the place of beginning and containing 3,042
square feet of land.

Adopt Ordinance Vacating a Portion of an Alley, a Portion of Bellaire Drive North and the Remaining
Portions of Grisham Way and Mid Court Within the Texas Christian University Campus for a New
Dormitory, Parking and Multi-Purpose Student Services Building (COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of an alley, a portion of Bellaire Drive North and the
remaining portions of Grisham Way and Mid Court within the Texas Christian University Campus for a new
dormitory, parking and multi-purpose student services building; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and
Council Communication G-15624).
DISCUSSION:
JB Davies, Inc, on behalf of Texas Christian University, has requested the vacation of these portions of
rights-of-way to replat them with the adjoining property for a new dormitory, parking and multi-purpose
student services building. The City Plan Commission recommended approval of this request at its
meeting on September 25, 2013. An acceptable final plat, FS-013-145, has been received, in accordance
with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof, of
purchase price of the right-of-way easements for the streets and alley.
This project is located in COUNCIL DISTRICT 3, Mapsco 75Z.
FISCAL INFORMATION CERTIFICATION:
The Financial Management Services Director certifies that this action will have no material effect on City
funds.
