HomeMy WebLinkAboutOrdinance 15682Ordinance No. r AN ORDINANCE APPROPRIATING $1,270,610.00 IN THE SOLID WASTE FUND AND DECREASING RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE GENERAL FUND FOR STREET MAINTENANCE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATNE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 in the Budget of the City Manager, there shall also be appropriations in the amount of $1,270,610.00 in the Solid Waste Fund and a decrease in retained earnings by the same amount for the purpose of transferring said funds to the General Fund for street maintenance. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing appropriations and decreasing retained earnings in the Solid Waste Fund in the amount of $1,270,614; and 2. Approve a transfer from the Solid Waste Fund to the General Fund in the amount of $1,270,610 for the purpose of funding street maintenance. DISCUSSION: On August 25, 1998, City Council approved M&C G-12311, thereby adopting an ordinance requiring commercial waste haulers to apply for and execute non-exclusive privilege agreements with the City of Fort Worth in order to collect and transport municipal solid waste within the City. Under these grants of privilege, commercial waste haulers are required to pay 5°lo Of the gross revenues generated from their municipal solid waste collection operations within the City. The 6°lo fee relates to the impact of vehicles used for solid waste collection on City streets and the costs of administering the program. The cost of maintaining City streets is centralized in the General Fund. Therefore, City staff recommends the transfer of grant of privilege revenue from the Solid Waste Fund to the General Fund. The transfer process will continue in subsequent fiscal years, provided that grant of privilege revenue continues to be collected in the Solid Waste Fund. Based on quarterly payments received, the Solid Waste Division of the Department of Environmental Management projects a total of $1,270,610 to be received from commercial waste haulers in FY2002-2003. The City's Budget Office concurs with this projection.
