AN ORDINANCE AMENDING THE CODE OF THE CITY
OF FORT WORTH (1986), AS AMENDED, BY THE
AMENDMENT OF SERVICE RATE FOR THE THIRTY-
TWO (32) GALLON CART AND THE SIXTY-FOUR (64)
GALLON CART IN CHAPTER 12.5, "ENVIRONMENTAL
PROTECTION AND COMPLIANCE", ARTICLE VIII,
"SOLID WASTE AND RECYCLING", DIVISION 4,
"DEPOSITS, RATES AND COLLECTION", SECTION 1.2.5-
841..1, "RESIDENTIAL COLLECTION FEES"; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL OTHER ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 12.5-841(a) of the City Code provides that the City Council
shall establish rates for solid waste collection services-, and
WHEREAS, the Code provides that the City shall charge customers for the solid
waste services received pursuant to such rates.
,NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
SECTION L
That Part 11 of the City Code (1986), as amended, Chapter 12.5, "Environmental
Protection and Compliance", Article VIII, "Solid Waste and Recycling", Division 4,
"Deposits, Rates and Collection", Section 12.5-841.1, "Residential Collection Fees",
shall be further arnended for the thirty-two (32) and sixty-four (64) gallon cart service
rate as follows:

The rate for the ninety-six (96) gallon cart service and the rate for all other services in
Section 12.5-841.1 shall remain the same.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections
of this ordinance, since the same would have been enacted by the City Council without
the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section.
SECTION 4.
This ordinance shall take effect on January 1, 2014.

Adopt Ordinance Amending the Service Rate for the Thirty-Two Gallon and Sixty-Four Gallon Carts in
Chapter 12.5, Environmental Protection and Compliance, Article VIII, Solid Waste and Recycling, Division
4, Deposits, Rates and Collection, Section 841.1, Residential Collection Fees to be Effective January 1,
2014 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance amending the service rate for the
thirty-two gallon and sixty-four gallon carts in Chapter 12.5, Environmental Protection and Compliance,
Article VIII, Solid Waste and Recycling, Division 4, Deposits, Rates and Collection, Section 841.1,
Residential Collection Fees to be effective January 1, 2014.
DISCUSSION:
On November 5, 2002, the City Council approved the new Solid Waste Program (Program) for the City
with a variable rate structure and awarded several contracts to implement the Program on March 31,
2003. The City's collections contract for garbage and recyclables was successfully renewed in April 2013
with Waste Management of Texas, Inc. (City Secretary Contract No. 28358-E1) with a decrease in
contractual costs.
One of the ongoing goals of the Program is to increase the City's landfill diversion rate by expanding
recycling. To provide residents the incentive to recycle more and to encourage residents to use a smaller
garbage cart, a rate reduction of$0.25 per 32 or 64 gallon garbage cart per month will be given effective
January 1, 2014. The adopted Solid Waste Fund budget for Fiscal Year 2013-2014 includes a reduction
in revenues in the amount of$384,723.00 for the remaining nine months of this fiscal year. Rates have
not changed since 2006 when they were increased by $1.30 for each size of cart for collection services.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that the Water Department, as billing agent, is
responsible for the collection of funds from solid waste customers. Revenues will be deposited in the
Solid Waste Fund.
