THIS THIRD AMENDMENT to, city Secretary contract Igo. 41383 is entered into by and
between the city, of Fort Worth "C,ityr„),, a home-rule municipality in the State of Texas,
acting through Fernandol costa, its duly authorized Assistant city Manager, and
ccutest Laboratories, Gulf coast, Inc., a Texas corporation ("Contractor"), acting
through Stephen Grant, its duly authorield 'dice 'resident.
WHEREAS, the City, and Accutest Laboratories Gulf Coast, Inc. have entered into that
certain agreement identified as city Secretary contract No. 41383 (also the "Contract)I)
commencing on Januarys 14, 2011 for services involving laboratory analytical services of'
air, soil, water, sludge, sediment, fissuie, and various other types of materials and ,media
as authorized by Mayor and Council i communication c-245912; and
WHEREAS, Mayor and Council' Communication c-24592 provides for an initial contract
term of one year and provides for the extension of the terg1 of the agreement for up to,
three additional periods of one year each; and
WH' ERE S, municipal contracts for services are exempt from the provisions of chapter
252 olf' the Texas Local Government code under the General Exemption provided for
Procurements necessary to preserve or protect the publ�ic he',a
Kh or-.-s,afety of a
municipality's residents; and
WHEREAS, the parties wish to extend 'the term of the initial contract for an additional
year(fourth of four) and sufficient funds have been appropriated; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain
the same as sated in city ,Secretary contract No. 41 383;
NOW) THEREFORE, for and in consilderation of the mutual covenants contained herein,
and other goody, and valuable consideration, the receipt and sufficiency of which are
hereby ackno wledged and confessed, the parties hereto agree as follows
1.1 Extended terhn'of contract:
City Secretary Contract nurnber 41383 is extended to include the terra beginning
January 14, 204 and ending January 13, 20,15.

2. Compensation Not to Exceed Amount-,
Compensatiio�n shall not exceed one hundred thousand oIllars ($100,000.00) for the
term of this amendment, billable according to the fee schedule of City Secretary
Contract number 41383 and subject, to, all other terms and conditions as stated in City
Secretary Contract number 131 3.
3. Miscellaneous-.,,
All other definitions, teIrms, and conditions of City Secretary Contract number 41383
shall remain unchanged except as expressly set forth herein.

Authorize the E ecutioln of a Professional Services Contract with, Acc�ute�st Laboratories Gulf Coast, Inc., for
Laboratolry Analytical Services, Not to Exceed $1 0101,000.go Per cointract.Year
RECOMMENDATION:
It is recommended that the City Council authorize the City Manageir to execute a, professional services
contract not to exceed 100,000.010, per contact year with Ac�cutest Laboratories Gulf Coast, Inc., for
laboratory analytical services.
DISCLISSIONI:
The Transportation and Public Works Department, Environmental Services Division requiire�s a�
professional services contract for-the furnishing of all labor, materials and equipment necessary for
performing environmental laboratory analyses of'air, soil, water and asbestos, samples collected for
various projects and inspections.
The cost for the laboratory analytical services will not exceed $100,0001.00 per contract year. -the
proposed agreement will commence one the date the contract is fully executed and continue, for a period) of
one-year with three one-year options,to renew. Renewal may be effected by written notification by the City
Manager or his designated representative to the contractor within 30 days, of the expiration of the prior
term and does not require specific city Council approval, provided the city Council has a�ppropriated
sufficient funds to satisfy the city's obligations, during the renewal term.
The Environmental Services Division requested proposals for environmental laboratory analysis on July
221 2010.� Proposal packages were received on August 12, 2010 from the fo�llowing firms:

EIRMI Environmental Laboratories,, Inc.
oxidor Laboratories, LLC.
Southern Petroleum Laboratories, Inc.
T'es,tAmerica Laboratories, Inc..

Xenco Laboratories
The proposals were evaluated and scored based) on a pre-determined list of factors including cost,
performance oin EPA proficiency tests, experience, qualifications of'personnel,, testing capabillities, and
subcontractors. Eased on the above described evalulation,1 staff is recommending the contract be awarded
to Accutest Laboratories Gulf coast, Inc..
A waiver of the s /WEE requirements was requested by the department and approved by the ICI/WET
office because the purchase olf services is from sources where subcontracting or suupplier opportunities
are negligible.
