AN ORDINANCE AMENDING SECTIONS 35-56{~) and 35-56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING CERTAIN RATES AND CHARGES; MAKING THIS ORDINAl~~CE CU1vIU- LATIVE OF PRIOR ORDINANCES; REPEL-1LING ALL ORDINANCES AND PROVISIONS OF THE FORT y~'ORTH CITY CODE IN CONFLICT HEREWITH; PRO~%'IDING A SAVI'_'~GS CLAUSE; PROVIDING A SEVERABILIT~ CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTFI: SECTION 1. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Eort Worth, Texas {1986}, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTIQN 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section, SECTIQN 5. DISCUSSION: Each year a whalesale water and wastewater rate study is prepared in accordance with the terms of the uniform whalesale customer contracts. For Fiscal Year 2004, the Wholesale Water Cost of Service Study was completed by Water Department staff based an the 2002 Wholesale Water Cost of Service Study performed by Gamp Dresser and McKee, Inc. The Wholesale Wastewater Cast of Service Study was completed by Water Department staff based on the 2001 Wholesale Wastewater Gast of Service Study performed by Black and Veatch, Inc. The result of these studies indicated the rates, as proposed below, wiH recover the cost of providing wholesale water and wastewater service. R joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 24, 2003, to present the study and the rate requirements. The Customer Service Division of the Water Department is responsible for collection of funds due to the City by adoption of this ordinance.
