THIRD RENEWAL TO CITY SECRETARY
CONTRACT NO. 40125
WHEREAS, on April 13, 2010, the City of Fort Worth ("City") City Council authorized
a contract with Ace Pipe Cleaning, Inc. ("Contractor"), (City Secretary Contract No. 401,25)
(M&C C-24174, April 13, 2010) (the "Contract") for the Interceptor Condition Assessment
Program Contract 1: Larger Diameter Sanitary Sewer CCTV, Sonar and Laser Inspection; and
WHEREAS, the Contract may be renewed up to three times at the same terms,
conditions, and unit prices as originally bid; and
WHEREAS, the Contract was renewed on January 10, 2012 (M&C C-25393) in the
amount of$848,875.00; and
WHEREAS, the Contract was renewed on December 11, 2012, (M&C C-26003) in the
amount of 848,875.00; and
WHEREAS, the Parties desire to enter into this third and final renewal of the contract;
and
WHEREAS, in order to protect the public's funds, the contractor will be bound to the
unit prices as found in the bid tabulation section of the original agreement.
NOW, THEREFORE, the Parties, hereby agree as follows:
1.
a. Contract No. 40125 is hereby renewed in the amount of $848,875.00 for a term
not to exceed 365 calendar days following the date of the Notice to Proceed or
expenditure of the amount of this renewal, whichever should occur later.
b. The Unit Prices originally bid by Contractor upon which basis the Contract was
awarded, shall remain in effect for the duration of the Contract, as renewed.
C. Task orders will continue to be issued and remain contingent upon the availability
of funds and the availability of the contractor.
11.
All other terms and conditions of the Contract not amended herein remain unaffected and
in full force and effect, are binding on the Parties and are hereby ratified by the Parties.

SUBJECT: Authorize Execution of the Third and Final Renewal for the Interceptor Condition
Assessment Program Contract 1 - Large Diameter Sanitary Sewer CCTV, Sonar and
Laser Inspection, in the Amount of $848,875.00 with Ace Pipe Cleaning Inc. (ALL
COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of the third and final renewal for the
Interceptor Condition Assessment Program Contract 1 - Large Diameter Sanitary Sewer CCTV,
Sonar and Laser Inspection, in the amount of$848,875.00 with Ace Pipe Cleaning Inc.
DISCUSSION:
On April 13, 2010, (M&C C-24174) the City Council authorized a contract with Ace Pipe Cleaning
Inc., in the amount of$848,875.00 for the Interceptor Condition Assessment Program Contract 1 -
Large Diameter Sanitary Sewer CCTV, Sonar and Laser Inspection. The contract contains three
one-year renewal options. The purpose of this Mayor and Council Communication is to exercise the
third and final renewal option. All terms, conditions, and unit prices contained in the contract remain in
full force and effect.
The Interceptor Condition Assessment Program (ICAP) Contract 1 includes 3-D laser, HDTV and
Sonar Inspection of Large Diameter Sanitary Sewers located citywide.
ICAP Contract 1 - Large Diameter Sanitary Sewer CCTV, Sonar and Laser Inspection is mandated by
the Texas Commission on Environmental Quality (TCEQ), Sanitary Sewer Overflow Initiative
(SSOI). In addition to being an SSOI regulatory requirement, the ICAP is a major component of the
Water Department's Wastewater Master Plan to restore and maintain capacity within the wastewater
collection system and to facilitate short-term and long-term Capital Improvement Program
recommendations.
M/WBE Office - A waiver of the goal for MBE/SBE subcontracting requirements was requested by the
Department and approved by the M/WBE Office, in accordance with the BIDE Ordinance because the
purchase of goods and services from source(s) where subcontracting or supplier opportunities are
negligible,
This project is located citywide and affects ALL COUNCIL DISTRICTS.
FISCAL IN FOR MATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget, as appropriated, of the Water and Sewer Fund.
