AN ORDINANCE AMENDING A PORTION OF THE FORT WORTH FIRE
CODE AS FOLLOWS: APPENDIX H, SECTION H104, ADDING A NEW
SUBSECTION H104.4 "FEES FOR CONSTRUCTION PERMITS;" REVISING
SECTION H105.4 "FEES," TABLE H104.1 "BASE FEES FOR FIRE
INSPECTIONS," TABLE H104.2 "FEES FOR OPERATIONAL PERMITS,"
TABLE H104.3 "FEES FOR CONSTRUCTION PERMITS,' SECTION H105,
TABLE H105.1 "FEES FOR FALSE ALARMS," AND APPENDIX I, SECTION
I104, SECTION I105.4 "FLAMMABLE AND COMBUSTIBLE LIQUID
TANKS," TABLE I104.1 "FEES BASED ON TYPE OF FIRE PROTECTION
SYSTEMS AND EQUIPMENT," OF SUBSECTION (b) OF SECTION 13-2
"AMENDMENTS," OF CHAPTER 13, "FIRE PREVENTION AND
PROTECTION" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS
(1986), AS AMENDED, TO PROVIDE A SCHEDULE OF FEES FOR THOSE
ITEMS LISTED ABOVE; PROVIDING A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of t11e City of Fort Worth has commissioned TriData
Corporation to study the Fort Worth Fire Department Service Fees in order to
achieve fiill administrative cost recovery; and
WHEREAS, TriData Corporation has completed its study, determined that the
current service fee levels are inadequate to fully recover the Fire Department's
administrative costs and made recommendations to the City Council for the
changes in the Fire Department Service Fees listed below in order to promote fiill
administrative cost recovery; and
WHEREAS, the City Council finds that adopting the new service fees will
promote fiill administrative cost recovery for the Fort Worth Fire Department acid
lessen the burden on the taxpayers of the City of Fort Worth;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
Subsection (b) of Section 13-2 "Amendments," of Article I of Chapter 13 of the Code of the City
of Fort Worth, Texas (1986) as amended, is hereby fiu~ther amended, thus constihiting local
amendments to the International Fire Code of 2000, to set fees for the Fire Department services
listed herein by amending Appendix H Section H104 as follows:
(1) adding a iiew subsection H104.4 to read:
Section H104.4 Fees for Construction Pei7nits: The fee for construction permits will be as
set forth in Table H104.3.
And,
(2) amending the Tables nuumbered H104.1, H104.2 and H104.3 for Section H104 as they
appear below, and the Table numbered H 105.1 of section H 105 of Appendix H of the City of Fort
Worth Fire Code to set forth the amotult of each fee, and to read as follows:

SECTION 2.

of Fort Worth, Texas (1986) as amended, is hereby further amended, thus constituting additional
local amendments to the International Fire Code of 2000, to set fees for the Fire Department
services listed herein by amending Appendix H Section H105.4 and Table H105.1 as follows:
H105.4: Fees A fee will be assessed for each false alarm reported to the Fire Prevention
Bl~reau after written notification is issued in accordance with Section 105.3.2 of this
Appendix. The fees for False Alarms will be set forth in Table H105.1.

SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and such Code, in which event conflicting
provisions of such ordinances alld such Code are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that .the sections, paragraphs,
sentences, clauses a11d pleases of this ordinance are severable, asld if any please, clause, sentence,
paragraph or section of this ordinance shall be declared Lulconstihrtional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitLrtionality shall not affect any of the
remaiiung pleases, clauses, sentences, paragraphs acid sections of this ordinance, since the same
would have been enacted by the City Coiuzcil without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6.
This ordinance shall take effect and be in fiill force axzd effect from and after October 1st,
2003, acid it is so ordained.

Adopt Ordinance Amending the Fort Worth Fire Code Providing for Service Fees
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance amending Sections H104, Fees for
Inspections and Operational Permits; H105, Fees for False Alarms; and 1104, Fees, of the Fort Worth Fire
Code, to set Fire Department service fees effective October 1, 2003.
DISCUSSION:
The proposed changes to the Fire Code fee structure will provide full cost recovery for various Fire
Department services and permits as recommended by the TriData Corporation review of Fort Worth Fire
Department fees. The proposed changes were discussed at the August 19, 2003, City Council budget
session, and are included as revenue in the 2003-04 Proposed Budget. The following is a description of
the proposed charges:
Inspection Fees for Commercial. Structures (GG09-462574-0362020)
Commercial structures within the City Limits of Fort Worth are inspected annually to ensure compliance
with the Fire Code. Fees are set based upon the square footage of the structure.

Fire Protection Systems and Equipment (GG01-462252-0362020)
Permits are issued for the installation of fire protection systems and equipment in new structures and/or
changes or upgrades to existing systems. Fees are based upon the number and types of devices per
structure. The adopted budget for FY 02/03 is $506,665 however the actual revenue collected is expected
to be around $400,000.

False Fire Alarm Fees for Commercial Establishments (GG01-461314-0362020)
Fees are assessed after the Fire Department has responded to a fire alarm at a commercial establishment
and further investigation has revealed the fire alarm to be false in nature: Subsequent occurrences at the
same establishment within a specified time period result in an increase in the amount invoiced.

Permits are issued to businesses that have special requirements such as welding, public assembly, paint
booths, high-stacked materials, etc. that due to the nature of their business could pose fire hazards.
