Section 1.
Section 22-1, Definitions, of Chapter 22, "Motor Vehicles and Traffic", of the
Code of the City of Fart Worth (19$6), as amended, is hereby further amended by
deleting the definition of "Loading Zone`' and adding definitions for "Commercial
Loading Zone" and "Passenger Loading Zone", which shall be and read as follows:
eammer^eial loading zone means a space ar section of the curb set
aside for the purpose of loading and unloading of persons or the purpose
of loading, unloading, delivery, or pick up of supplies or merchandise.

Section 2.
Section 22-158, "Standing for Loading or Unloading Only", of the Code of the
City of Fort Worth, Texas {1986, as amended, is hereby renamed t~ "Passenger Loading

Section 3
Article II, ``Traffic-control Devices, Suns and Signals'`, of Chapter 22, Motor
vehicles and Traffic, ofthe Code of the City of fort Worth, Texas {1986), as amended, is
hereby further amended by adding section 22-158,1, "Commercial Loading Zone, which
shall be and read as follows:
Sec. 22-158.1 Commercial loading zone.
(a} It shall be unlawful for the driver of a vehicle to stop, stand or park
such vehicle for a period of time longer than thirty (30} minutes for the
expeditious loading, unloading, delivery, or pick up of supplies or
merchandise.
(b) It shall be unlawful for the driver of a vehicle to stop, stand or park
such vehicle for a period of time longer than five (5) minutes for the
expeditious loading and unloading of persons in any place marked as a
commercialloading zone.
Section 4.
Article II, "Traffic-Carztrol Devices, Signs and Signals", of Chapter 22, Motor
Vehicles and Traff c, of the Code of the City of Fort Worth, Texas (1986), as amended, is
hereby further amended by adding section 22-158.2, "When Provisions Applicable",
which shall be and read as follows:
22-158.2 When provisions applicable.
The provisions of sections 22-15$ and 22-15$.1 shall apply daily between
the hours of 6:00 a.m. and 6:00 p.rn. except for Sundays and such other
days as shall be specifically designated by the city council,

(a} To determine and designate spaces for exclusive uses as bus stops,
taxicab stands, and passenger and commercial loading zones, and such
other zones as may be determined at his sole discretion to mark the same
with appropriate signs and markings.
(b) To determine and designate no parking zones and to mark such
spaces with appropriate signs or markings.
Section 6.
Subsections (a), (c) and (d} of Section 22-191, "Establishment of Zones and
Maximum Parking Time Therein; Establishment of Fees", of Article VI, "Stopping,
Standing and Parking", of Chapter 22, Motor Vehicles, of the Code of the City of Fort
Worth, as amended, are hereby further amended to be and read as follows:
See. 22-191. Establishment of rates and maximum parking time therein;
establishment of fees.
(a) There are hereby-established Parking Meter Rate No. 1, Parking
Meter Rate No. 2, Parking Meter Rate No. 3 and Parking Meter Rate No.
4.
(c) The traffic engineer may designate the maximum parking time for
each parking meter, basing his designation upon the investigation above
set forth.
(d) The fees for parking sha11 be paid in the coin of the United States
of America and are established as follows:
{1) Parking llleter Rate Na.I -One (I~ Hoar Parking: T~vo (2)
minutes for each five cent ($0.05) coin deposited in the meter, four (4)
minutes for each ten cent (50.10} coin dc}~osited in the meter; and ten

twenty (20} minutes for each twenty-five cent {0.25} coin deposited
in the meter.

Section 7.
Section 22-192, "Hours Meters to Operate; Information to be Shawn Meters" of
Article VI, "Stopping, Standing and Parking", of Chapter 22, Motor Vehicles, of the
Code of the City of Fort Worth, as amended, is hereby further amended to be and read as
follows:
Sec. 22-192. I-lours of operation of meters; information to be shotivn on
meters.
(a} Parking meters at the established rates shall regulate the parking of
vehicles between the hours of 8:00 a.m. and 6:00 p.m., unless otherwise
specified by sign, of any day, except Saturdays and Sundays; or when a
street sign specifically prohibits parking.
(b} In addition to Saturdays and Sundays, the following parking meter
holidays will be observed:

(9} Christmas Day--December twenty-fifth
(c} When a parking meter holiday falls on a Saturday and the holiday
is officially observed on the preceding Friday, the parking meter holiday
will be observed on Friday. When a parking meter holiday falls on a
Sunday and is officially observed on the following Monday, the parking
meter holiday will be observed on Monday.
(d} The city council may also from time to time designate parking
meter holidays for special events or activities when such action is in the
best interest of the city.
(e} Each parking meter shall bear thereon a legend indicating the days
and hours when the requirements to deposit coins therein shall apply and
the value of the coins to be deposited.
Section 8.
Subsections (a}, and {b} of Section 22-193, "Installation and Operation" of Article
VI, Installation and operation, of Chapter 22, "Stopping, Standing and Parking", of the
Code of the Cite of Fort Worth, as amended, are hereby further amended to be and read
as follows:
Sec. 22-193. Installation and operation.
(a} The city traffic engineer or duly authorized designee as he may
select is authorized to install or place parking meters at the established
parking meter rates. Each parking meter shall be placed upon the curb
alongside of or next to an individual parking space, such space to be
designated as hereinafter provided.

Section 9.
Section 22-194, "How Parking Meter and Space to Be Used", of Article VI,
"Stopping, Standing and Parking", of Chapter ~2, I~lotor Vehicles, of the Code of the
City of Fort Worth, as amended, is hereby further amended to be and read as follows:
Sec. 22-194. How parking meter and space to be used.
No person shall park a vehicle in any parking space upon a street
alongside of and next to which a parking meter has been installed during
the regulated time applicable, unless a coin or coins of United States
currency of the appropriate denomination shall have been deposited
therein, or shall have been previously deposited therein for an unexpired
interval of time, and such meter has been placed in operation.
Section 10.
Section 22-195, Parking overtime -unlawful, of Article VI, "Stopping, Standing
and Parking", of Chapter 22, Motar Vehicles, of the Code of the City of Fort Worth, as
amended, is hereby further amended to be and read as follows:
Sec. 22-195. Parking overtime--Unlawful.
(a} It shall be unlawful for any person to permit a vehicle to be parked,
to remain or to be placed in any parking space alongside of or next to any
parking meter during the restricted and regulated time applicable for the
established parking meter rate in urhich such meter is located while the
parking meter for such space indicates by signal that the lawful parking
time in such space has expired or has been restricted. This provision shall
not apply to the act of parking or the necessary dine that is required to
deposit immediately thereafter a coin or coins in such meter.

Section 11.
Section 22-196, "Same -Expired Meter Prima Facie Evidence", of rlrtiele VI,
"Stopping, Standing and Parking" and of Chapter 22, Motor Vehicles and Traffic, of the
Cade of the Cite of Fart North, as amended, is hereby further amended to be and read as
follows;
Sec. 22-196. Same--Expired meter prima facie evidence.
The displa~~ing of a signal by any parking meter indicating expired or
illegal parking while a vehicle is parked in a parking space adjoining such
parking meter shall be prima facie evidence that such vehicle has been
parked overtime and beyond the period of time established for the
particular parking meter rate in which such parking space and such meter
are located.
Section 12.
Section 22-205, "Same -Use of Metered Space", of Chapter 22, Motor Vehicles
and Traffic, of the Code of the City of Fort Forth, as amended, is hereby renamed to be
"Maximum Parking Time; Extending Time Prohibited" and is amended to be and read as
follows:
See. 22-205. Maximum parking time; extending time prohibited.
(a) It sha11 be unlawful for a person to park a vehicle in a space
controlled by a parking meter far a period of time longer than the
maximum time of the parking meter.
(b) It shall be unlawful for any person to deposit ar cause to be

Section 13.
Chapter 22, Motor Vehicles and Tratfc, of the Code of the City of Fort Vt~'orth, as
amended, is hereby further amended to add section 22-205.1, "Feeding Meters", «Thieh
shall read as follows:
Sec. 22-205.1. Feeding meters.
It shall be unlawful for the owner, operator or driver of any vehicle
or for a person on behalf of another person to deposit in any parking meter
any coin for the purpose of parking overtime or beyond the maximum
1ega1 parking time limit prescribed for any established parking meter rate.
Section 14.
Section 22-221, "Tow-away Zones", of Chapter 22, Motor Vehicles and Traffic,
of the Code of the City of Fort North, as amended, is hereby further amended to be and
read as follows:
Section 22-221. Tow-away zones.
In addition to signs regulating stopping, standing or parking of motor
vehicles upon any public street or highway within the city, the traffic
engineer may, in his discretion, supplement any such sign with an
additional sign designating a tow away zone. Such signs shall be in
substantial compliance with the Texas Manual an Uniform Traffic Control
Devices. The use of signs designating a taw away zone sha11 not prohibit
the removal by the City of any vehicle found in any other area if such
removal is in conformity Fvith any provisions of this Code or State Statute.

Section 16,
This ordinance shall be cumulative of all provisions of all ordinances and of the
Code of the City of fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Cade are hereby
repealed.
Section 17.
It is hereby declared to be the intention of the Cite Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause; sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council u~thout the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
Section 18.
rlny person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall
be fined not more than Two Idundred Dollars {$20.00} for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.

Adoption of (Jrdinance Amending Chapter 22, "Motor Vehicles and Traffic" of the City Code,
Redefining Loading Zones and Establishing Rates and Maximum Parking Time on Meters
RECOMMENDATION:
It is recommended that the City Counci{ approve certain amendments to the "Motor Vehicles and Traffic" of
the Code of the City of Fort Worth, Chapter 22, by adopting the attached ordinance.
DISCUSSION:
The Transportation and Public Works Department requests amendments to Chapter 22, "Motor Vehicles
and Traffic", of the Cade of the City of Fort Worth. These amendments are to implement recommendations
of the "Downtown Access and Circulation Study".
At the Pre-Council meeting an November 19, 2002, staff provided the City Council with an overview of the
various recommendations from this comprehensive study. The City Council was briefed on proposals to
provide consistency for passenger and {oading zones, as well as establish new parking meter time limits
and rates. These changes will improve parking for both businesses and employees in the downtown area.
At the Capital Improvement and Infrastructure Committee {CIIC} meeting on September 9, 2003, staff
briefed committee members on proposed parking changes which included an explanation of existing and
proposed differences between passenger zones, loading zones, meter zones, and meter
feeding. Proposed changes define commercial loading zones, passenger landing zones, establish new
parking meter rates by land use {not zone}, and eliminate "meter feeding". The CIEC committee
recommended that the Transportation and Public Works Department submit the proposed ordinance
changes to the City Council.
Amendment of this ordinance wiii constitute an increase to parking meter rates. As n resu{t of this
