AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. �$ 4"A` (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and ARS Engineers, Inc. , (Engineer) made and entered into City Secretary Contract No. 38654, (the Contract) which was authorized by the City Council by M&C C-23510 on the 12th day of May 2009; and WHEREAS, the Contract involves engineering services for the following project: Street Reconstruction, Water & Sanitary Sewer Replacement on Belle Place, Dorothy Lane, Western Avenue, Sutter Street, 2008 CIP Contract 7A, DOE 6178, Project No. 01270 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 2X 2010, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $28, 891. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $208, 420. Senior Professional Engineer City of Fort Worth 1000 Throckmorton Street Fort Worth, TX 76102 Re: Amendment No. 1 Street Reconstruction, Water & Sanitary Sewer Replacement on Belle Place, Dorothy Lane, Western Avenue, Sutter Street 2008 CIP, Contract 7A, DOE 6178, Project No. 01270 Dear Mr. Sahu: As we were working towards the 60% design plans, the Storm Water Group requested that we add a portion of Washburn Avenue between Sutter Street and the west dead-end of Washburn Avenue to our project due to a drainage issue. In the current situation storm water ponds at the western dead end of Washburn Avenue, and the street needs to be redesigned to direct storm water to Sutter Street, which is included in the current contract. This issue can be resolved during the design of Sutter Street. We request that our contract be amended to include this portion of Washburn Avenue. The following are the additional scope items broken down by tasks: Tasks 1. Topographic survey of Washburn Avenue 2. Paving Plan and Profile of Washburn Avenue resolving drainage issue 3. Water Main design 4. Geo-Technical Investigation Report 5. S WPPP 6. Traffic Control Plans In accordance with our contract, Article V, Section K of the STANDARD AGREEMENT FOR ENGINEERING SERVICES, ARS Engineers, Inc. requests an equitable adjustment to our contract to account for the additional cost incurred to perform additional services to the City. The proposed fee of $28,891 which also includes $2,792 for surveying was determined based on the time estimated to complete the task at the hourly rates outlined in Exhibit B-2, STANDARD AGREEMENT FOR ENGINEERING SERVICES. This also includes $6,762 for M/WBE sub consultants for doing geo-technical investigation, SWPPP, and Traffic Control Plans resulting in 23.40% (approx.) M/WBE participation for this amendment.
