C-, 4 TO/ WHEREAS, the City of Fort Worth (City) and Everman ISD (Developer) entered into a Community Facilities Agreement, City Secretary Contract No. 39046 ("CFA"); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to add City participation in an amount not to exceed $143.983.92 for the City's portion of costs associated with the 16-inch water construction contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 2 to the CFA on the day of , 2010 via M&C &,Z4_701 r NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. The City's portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does not reimburse the Water Inspection and Material Testing Fees to the developer. The City's participation estimate shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 (or by public bid). DISCUSSION: Everman Independent School District (ISD), the developer of Everman ISD Junior High School, has executed a proposed contract for community facilities to serve a development located in Fort Worth (see attached map). Total construction cost for water and sewer improvements for this development is $ 247,018.72. There will be City participation for the construction of 16-inch water main that will improve service to the Everman ISD Junior High School and surrounding area.
