AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF
$102,681.50 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING A
CONTRACT WITH GARNER ENVIRONMENTAL SERVICES, INC. FOR THE REMOVAL,
TRANSPORTAION AND DISPOSAL OF LEAD-CONTAMINATED SOIL IN THE EVANS
AND ROSEDALE BUSINESS AND CULTURAL DISTRICT; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-2004 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Environmental Management Fund in the amount of $102,681.50 from available funds for the purpose of
funding a contract with Garner Environmental Services, Inc. for the removal, transportation and disposal of
lead-contaminated soil in the Evans and Rosedale Business and Cultural District.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15636 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropria#ions are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Approve the transfer of $102,681.50 in undesignated funds in the Environmental Management
Operating Fund to the Environmental Management Project Fund; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the Environmental Management Project Fund by $102,681.50; and
3. Authorize the City Manager to execute a contract with Garner Environmental Services, Inc. in the
amount of $102,681.50, for the removal, transportation and disposal of lead-contaminated soil in the
Evans and Rosedale Business and Cultural District.
DISCUSSION:
As part of the redevelopment of the Evans and Rosedale Business and Cultural District, the Environmental
Management Department tested shallow soils at City-owned properties within the project area for lead
cantaminatian. This area is bordered by East Leuda Street, Interstate 35W service road, East Rosedale
Street, and Evans Avenue. Levels of lead requiring cleanup were found at many of the properties,
requiring the removal of approximately 5,300 cubic yards of contaminated soil.

These are vacant lots except for 801 East Rosedale Street, 801 Missouri Avenue, and 924 Evans
Avenue. Structures at 801 East Rosedale Street and 801 Missouri Avenue are to remain within the project
area, and 924 Evans Avenue will be scheduled for demolition prior to soil removal at that location.
A Request for Proposal was issued on July 24, 2043, for the removal, transportation, and disposal of lead-
contaminated soil from the Evans and Rosedale Business and Guttural District. Proposals were received
on August 21, 2003, from the following six companies:
Apollo Environmental Strategies, Inc.
Eagle Gonstruction & Environmental Services LP
Entact Services, LL.C
'~ Garner Environmental Services, Inc.
Hulcher Services, Inc.
WRS Infrastructure & Environment, Inc.
Proposals were evaluated based on a predetermined combination of qualitative and quantitative {point)
measures to determine the recommendation for award of contract. These measures included evaluation of
such factors as: legal record, experience, qualifications, performance records, cost and references. Based
on the total point distribution of those measures, staff recommends award of contract to Garner
Environmental Services, Inc. Additionally, the proposal by Garner Environmental Services, Inc. contained
the lowest overall cost to the Gity for these services. The total cast of the contract shall not exceed
$102,681.50.
Garner Environmental Services, Inc. is in compliance with the City"s M1WBE Ordinance by committing to
the 26% MIWBE participation. The City's goal on this project is 12%.
All sites are located in COUNCIL DISTRICT 8.
FISCAL INF4RMATIONlCERTIFICATIUN:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Environmental Management Project Fund.
