TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 39307, (the
CONTRACT) which was authorized by M&C C-23796 on the 22 day of September,
2009 in the amount of $ 243, 046; and
WHEREAS, the CONTRACT involves engineering services for the
following study:
Lower Mary's Creek Open Channel Study; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated August 25, 2011, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals 1$281,173.
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of 1$524,219.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect .

AMENDMENTS TO THE STANDARD SCOPE OF SERVICES, ATTACHMENT "A"
In order to accurately map the 100- year floodplains on Marys Creek and take
advantage of the most recent hydrology developed for the stream, the hydraulic model
for Marys Creek will be extended upstream by approximately 8 miles to the Tarrant
County line. At completion of the project, the effective FEMA model will be replaced with
this newer more accurate hydraulic model, resulting in a more precise definition of
flooding risks.
Basic Services (Lump Sum)
Task 1: Project Management
The ENGINEER shall attend a maximum total of three (3) additional meetings with
CITY's Project Manager, CITY staff or the public.
Comprehensive report development for the project will be included in Task 1. Report
will be expanded to include additional data collection, additional field surveys and
additional hydraulic modeling and results.
Task 2: Data Search, Collection, Field Reconnaissance, Stream Condition
Assessment, and Surveys
a. Dataset Search and Collection
Coordinate with City and other consultants to obtain additional data that may be
needed.
Review previous studies that may be needed to extend the hydraulic model, prepare
basemap with all the collected information.
b. Field Reconnaissance
Perform one (1) field visit.
c. Stream Condition Assessment
No stream condition assessment will be performed for the additional study area.

d. Field Surveys
For the extension of the Marys Creek Open Channel study there are approximately 75
open channel cross-sections and approximately 13 bridges, 11 dams, and 2 diversion
structures to be surveyed. Survey within limits of the City of Fort Worth will include
pictures and sketches at all cross sections. This information will not be included for
sections within the limits of the City of Benbrook.
e. Finished Floor Elevations
Finished floor surveys will not be acquired as part of the Basic Services for this project.
Task 3: Development of Detailed Hydrologic Models
Detailed hydrology has already been completed as part of the original scope of
services.
Task 4: Development of Hydraulic Models and Floodplain Maps
a. Model Development
Hydraulics
• Develop a steady flow hydraulic model using HEC-RAS that will cover the
following area:
o On Marys Creek, between the Winscott-Vickery crossing and the City
Limits north of 1-30, approximately 8 miles.
• The model will be based on surveyed cross sections on the main channel
supplemented with 2009 LIDAR on the overbanks.
• This model will be used to delineate the 100-year flood plain and floodway for
existing conditions, and the 100-year floodplain for future conditions.
Task 5: Watershed Flood Hazard Assessment
No flood hazard assessment will be performed for the additional study area
Task 6: Proposed Flood Mitigation Alternative Analysis
No flood mitigation alternatives will be prepared for the additional study area.
Task 7: Quality Assurance and Quality Control Procedures
Additional QA/QC efforts include the hydraulic models, memorandums, floodplains,
report and LOMR.

Task 8: Additional LOMR Preparation
After analyzing the results of the hydraulic modeling if the City deems it necessary to
submit a LOMR to FEMA, FNI will proceed to prepare the LOMR. This includes
completion of FEMA forms, additional exhibits, cross section tables, water surface
elevation profiles and report summarizing methodologies and findings.

and frontage roads of 1-30, main lanes of US 80, FM 2871, main lanes and frontage roads of I-
820W, US 377 and one private crossing.
d. Finished Floor Elevations
No finished floor elevations will be surveyed.

Spooner and Associates, Inc. (S&A)will provide topographic surveying services in Fort Worth, Texas. The scope of work of the land
surveyor shall be to supply all supervision,technical labor,equipment,services,tools, consumables, insurance, and pay any applicable
sales/use taxes, and all other things required to perform land surveying in accordance with technical requirements specified in this

1.0 Locations of topographic survey and limits
Areas to be surveyed are along Mary's Creek, Tarrant County, Texas.
2.0 Scope of Services
Topographic Services
Survey cross sections along the above described site. Items to be detailed on each cross section including the following:
• We will locate vertically and horizontally existing natural creek features at engineer-defined cross sections along Mary's Creek.
• Sections will include top, toe, cl, toe, top with additional detail between toe to toe for back water analysis.
• Topographic data will be collected in and around each artificial and man-made dam to properly define its impact on the water
model. Cross-section data for dams include toe of dam at upstream and downstream face, and top of dam.
• Bridge cross section data includes 5 sections per bridge, 2 upstream, 2 downstream and a section representing the
abutments,piers,low cord and high cord.
• All sections collected within the City of Fort Worth will include pictures facing upstream and downstream from the point of
section.
• All bridge sections collected within the City of Benbrook will include pictures of each face of bridge and facing upstream and
downstream from the bridge.
• All sections collected within the City of Fort Worth will include FEMA style field sketches.
Right-of-Entry Services
• We will identify current ownership in and along each area of cross sections and produce a right-of-entry(ROE)letter request
for survey.
• Letters will be drafted per City of Fort Worth Standards.
• Letters will be mailed out using City of Fort Worth Transportation and Public Works letterhead.
Special Fees
• Due to the urgency of the right-of-entry, we may elect to rent special GPS equipment to expedite the data collection process.
The rentals are$150 a day per unit.
3.0 Methods and Accuracy
Land surveying will be conducted in order to determine the horizontal and vertical(XYZ) location of all pertinent locations and
elevations. The horizontal survey coordinates shall be reported in NAD83, Texas North Central, 4202 project coordinate system with
precision of+/-0.01 feet and the vertical survey coordinates shall be reported in the NAVD88 vertical system with a precision of+/-
0.01 feet.

4.0 Deliverables
Cross Section Survey Deliverables
• AutoCAD 2011 format CAD file.
• XML&ASCii file of all shots collected in the field
• Sketches for each section collected in Fort Worth including bridge, upstream and downstream JPG camera images.
• Bridge, upstream and downstream JPG camera images for all bridges surveyed in Benbrook.
Right of Entry Deliverables
• ROE letter for each parcel we need access from.
• Excel Database of existing ROE parcels, containing owners name, address and phone number if available.
5.0 Work Schedule
Cross Section Survey: The start for surveyor field activities is unknown but the surveyor. The surveyor will need approximately 45
days from the authorization to proceed before deliverables are ready. Variables such as weather and right-of-entry requirements may
alter this deliverable deadline.
6.0 Project Assumptions
Cross Section Survey Assumptions
• This estimate does not include the workup of property, easement or right-of-way lines. Ownership will not be shown on the
survey.
• This estimate does not include contours, TIN or any other surface deliverables.
• This estimate does not include topographic mapping of any features outside of each cross section or dam.
• This estimate does not include field sketches for sections collected in Benbrook. CAD will be utilized to show graphically all
collected data for bridge sections.
Right-of-Entry Assumptions
• The City will provide the surveyor with a ROE example to go by.
• This estimate does not include the workup of Maps or Exhibits for each ROE parcel.
• ROE letters will not be necessary in the City of Benbrook, according to City email 5-23-11 from Hector Olmos.
Invoicing assumption
• The project will be invoiced per section and ROE letter serviced.
• Data collected on Dams will include 3 cross sections, as described in Section 2, but will be invoiced as one section

RECOMMENDATION:
1. Authorize Execution of Amendment No. 1 to an Engineering Agreement with Freese and Nichols,
Inc., in the amount of$281,173.00 for a watershed study associated with the proposed water
reclamation facility in the upper portion of Mary's Creek, thereby, revising the total contract cost to
$524,219.00 for the Mary's Creek Master Plan; and
2. Authorize the City Manager to execute an amendment to City Secretary Contract No. 39306,
Interlocal Agreement with the City of Benbrook, to share costs for this Agreement in the amount of
$47,847.00 for the basic study tasks and$9,254.00 for optional work, for a total maximum
participation by the City of Benbrook of$57,101.00.
DISCUSSION:
This M&C addresses extending the on-going watershed study to include the proposed Water
Reclamation Facility in the upper portion of Mary's Creek watershed as part of a cooperative effort
with the Water Department, and the City of Benbrook. The purpose of the watershed study is to
determine the limits of the floodplain with new data and models, and evaluate flood mitigation
alternatives to protect buildings from flooding. The floodplain data has not been updated since the
last Flood Insurance Study in 1986. Currently, Stormwater Management is studying the lower portion
of Mary's Creek through a contract with Freese and Nichols, Inc. Survey data generated from the
study will also be used by the Water Department to meet the permitting requirement for the proposed
Water Reclamation Facility. The Lower Mary's Creek study was approved by the City Council, (M&C
C-23796) and executed by the City Manager with Freese and Nichols, Inc., on September 22, 2009.
Freese and Nichols, Inc., proposes to perform this study for a lump-sum fee of $281,173.00. The City
of Benbrook has agreed to participate in study costs through an amendment to its Interlocal
Agreement with the City Secretary Contract No. 39306. The City of Benbrook's share is $57,101.00,
with the remaining being the City of Fort Worth's share. Staff considers the study fee for the
amendment to be fair and reasonable for the scope of services proposed, based on size of the
watershed and length of the stream. The original study was funded through the Stormwater Utility
Fund. The current amendment will be funded through the Stormwater Utility Fund, with a 50-50 cost-
share with the Water Department for the $55,410.00 surveying fee.
Freese and Nichols, Inc., agrees to maintain the initial M/WBE commitment of 13 percent that it made
on the original Agreement and extend and maintain that same M/WBE commitment of 13 percent to
this first amendment. Therefore, Freese and Nichols, Inc., remains in compliance with the City's
M/WBE Ordinance and attests to the commitment by its signature on the Acceptance of Previous
M/WBE Commitment form executed by an authorized representative of its company.
