THE CODE OF THE CITY OF FORT WC}RTI-I, 198 {AS AI~IENDED);
MAKING THIS ORDINANCE CUMULATIVE OF OTFIER
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION
AS REQUIRED BY LAW; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FART
WORTH, TEXAS:
SECTION 1.
Section 30-52, "License; bond; permit -Required", of Chapter 30, Streets and
Sidewalks, of the Code of the City of Fort Worth, as amended; is hereby further amended
to be and read as follows:
Sec. 30-52. License, bond; permit--Required.
It shall be unlawful for any person or firm to perform the work of a street
and storm drain contractor, as defined in this article; without first having
obtained a street and storm drain license, the fee for which shall be five
hundred dollars ($540.04), and without having made and executed a bond
to the city in the sum of twenty-five thousand dollars ($25,400.00). The
license provided for in this article shall be renewed annually, and the
renewal fee shall be five hundred dollars {$544.00}.
SECTION 3.
This ordinance shall be cumulative of all other ordinances or provisions of the
Fort Worth City Code not in conflict herewith. It is specifically provided that this

paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5.
Any person, firm or corporation ,rho violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall
be fined not more than Two Hundred Dollars ($200.00) for each offense. Each day that a
violation is permitted to exist sha11 constitute a separate offense.
SECTION 6.
The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish
the caption and penalty clause of this ordinance for two (2} days in the official newspaper of
the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government
Code.
SECTION 7.
This ordinance shall take effect upon adoption and publication as required by law.

Adoption of Ordinance Amending Section 30-52 of Chapter 30, "Streets and Sidewalks," by
Increasing the License Fee and Approval of Other Fees and Charges for the Transportation and
Public Works Department
RECC}MMENDATItJN:
It is recommended that the City Council:
1) Adopt the attached ordinance amending Section 30-52 of Article lll, Street and Storm Drain
Contractors, Section 30-52, to increase the Utility License Fee from $300 per annum to $500; and
2) Approve other fees and charges as shown on Attachment "A" for the Transportation and Public Works
Department.
DiscussroN:
The attached ordinance amends Section 30-52 of the City Code by increasing the Utility License Fee from
$300 to $500 per license for contractors desiring to work within the public right-of-way. This amendment
will provide uniformity in fees for Parkway and Utility Contractors working in the City right-of-way. It is
estimated that the fee increase will generate additional revenues of approximately $23,400 in FY2003-
2004, which will be used to offset administrative costs.
During the FY2003-2004 budget process, the Transportation and Public Works Department reviewed
current fees and other charges to determine if any changes should be made in comparison with other cities
of comparable size and nature. At the City Council budget session an August 19, 2003, staff briefed the
City Council on proposed new and revised fees. The following fee schedule is recommended.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Transportation and Public Works Department will be responsible for
the collection and deposit of revenues due to the City.
