3 ORDINANCE NO. ~ ~~- AN ORDINANCE AMENDING ORDINANCE NO. 1518 TQ CORRIECT THE DESCRIPTIONS OF CERTAIN PROPERTY IN ZONING CASE NUMBER ZC-03-080 AND TO DELETE CERTAIN TRACTS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PRQVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION AND NA11rZING AN EFFECTIVE DATE WHEREAS, on April 8, 2003, the City Council approved a request by Wide Open Spaces to rezone the 500 block of East Bluff Street, the 800-1000 blocks of East Peach Street, the 300-400 blocks of Cummings Street and the 600 black of West Belknap Street to a Planned Development for all uses in the "1-I" Central Business District, with certain exceptions, under Case No. ZG03-080, WHEREAS, the subject property consists of numerous lots on the northern edge of the downtown area, many of which were platted decades ago and have been subsequently subdivided; WHEREAS, the legal descriptions used to describe the subject property were compiled from subdivision records, Tarrant Appraisal District ("TAD"} records and City zoning maps; «'HI~:I21~::~5, Ordinance No. 15518 reflecting the zoning decisions made by the C~it~ C~~tin~i( ~~,i~ .1~>>~il `~, ~~~t~;, ~rrt~ncc?u~l~, lip(<~~1 lr~u~t 1; ,n1~~ ~Ir;ict 1-i as property WHEREAS, it is advisable to amend Ordinance No. 15518 to delete Tract 13 and Tract 14 and to correct inconsistencies in property descriptions by identifying the subject property using designations obtained from TAD records; WHEREAS, identification of the property according to TAD records will be consistent with the method used to identify additional property rezoned by the City Council for the Wide Open Spaces project on September 9, 2003, in Case Nos. ZC-03- 198 and ZC-03-199; WHEREAS, this ordinance amends Ordinance No. 15518 with regard to Case No. ZC-03-080, only; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of C}rdinanee No. 13896 or of any amendments thereto that have accrued at the time of the effective date of this ordinance; and as to such accrued violations, and all pending litigation, both civil or criminal, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. DISCUSSION: On April 8, 2003, the Gity Council approved the zoning request by Wide Open Spaces for three planned development districts far property in the northern section of the downtown area, as reflected in Ordinance No. 15518. The subject property was platted many years ago and had been subsequently subdivided on numerous occasions, with the result that legal descriptions for the property are complicated. The property descriptions used in the ordinance were a combination of legal descriptions derived from Tarrant Appraisal District {TAD) records, subdivision plats and City zoning maps. The attached ordinance revises and clarifies the legal descriptions by identifying the property according to Tarrant Appraisal District designations. The use of TAD designations for the property is consistent with the description of property in two additional Planned Developments for the Wide Open Spaces property that were approved by the City Council on September 9, 2003, in Case Nos. ZC-03-198 and ZC-03-199. In addition, Ordinance No. 15518 erroneously included Tracts 13 and 14, which had been deleted from the zoning application at the owner's request prior to notification to surrounding property owners of the Zoning Commission hearing on the case. The attached ordinance corrects Ordinance No. 15518 by deleting Tracts 13 and 14. The affected properties are located in COUNCIL DISTRICT 9, FISCAL IN~ORMATION!CERTIFICATION ._ _ ,. ..
