Exhibit A, Land Use Assumptions for Water, incorporated by reference into Section 35-702(x} of the Code of the City of Fort Worth {1986}, as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit A, attached hereto. Schedule 1, the Maximum Assessable Impact Fee per Service Unit, incorporated by reference into Section 35-70.3(a} of the Code of the City of Fort Worth (1986}, as amended, is herby amended and, after having been so amended, and shall be and read as show on Schedule I, attached hereto. SECTION 4. Schedule 2, Collection Schedule, incorporated by reference into Section 35- 70.3(B} of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Schedule 2 - A, which is to be effective from May 18, 2044 until August 15, 2004, and on Schedule 2 - B, which is to be effective from August 16, 2004 until May 1$, 2009, both of which schedules are attached hereto. SECTION 5. Exhibit C, Water Benefit Area, incorporated by reference into Section 35-71{a) of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit C, attached hereto. Exhibit F, ~~astewater Capital Improvements Plan, incorporated by reference into Section 35-T7{a} of the Code of the City of Fort Forth (1986), as amended, is hereby amended and, after having been so amended, sha11 be and read as shown on Exhibit F, attached hereto. SECTION 9. This ordinance sha11 be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986}, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 10. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality sha11 not affect any of the remaining phrases, clauses, sentences, paragraphs and section of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 11. DATE: Tuesday, November 1 ~, 2003 LOG NAME: 60REPORT REFERENCE NO.: ~'~C-19850 SUBJECT: Appropriation Qrdinance and Award of Engineering Agreement to Camp Dresser & McKee to Update Water and Wastewater Impact Fee Report .:_ RECQMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the amount of $75,142.50 in the Water Capital Projects Fund and $75,142.50 in the Sewer Capital Projects Fund from available funds in Wholesale and Retail, Water and Wastewater Impact Fees; and 2. Authorize the City Manager to execute an engineering agreement with Camp Dresser & McKee, in an amount not to exceed $150,285.00 for updating the [Water and Wastewater] Land Use Assumptions and Capital Improvements Plan for the purpose of revising the impact fee ordinance. DISCUSSIi?N: Chapter 395 of the Local Government Code provides authorization for local governments to enact and impose impact fees for capital improvements related to water and wastewater facilities, storm drainage and flood control facilities, and roadway facilities. On June 6, 1990, the Fort Worth City Council adopted Ordinance No. 10601, which was subsequently amended and replaced by Ordinance No. 10871 on July 2, 1991, implemen#ing water and wastewater impact fees. The state law requires that the City update the Land Use Assumptions and Capital Improvements Plan at least every five years, commencing from the date of the adoption of the Capita! Improvements Plan. On May 25, 1999, the City Council adopted Ordinance No. 13810, which implemented the updated water and wastewater impact fee. The Capital Improvements Plan was adopted on May 25, 1999. In accordance with the state law the impact fee update needs to be adopted by May 25, 2004.
