HomeMy WebLinkAboutContract 39779-A1 AMENDMENT No. 1 THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO 3Q 7 G"A I (M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Freese & Nichols, Inc., (Engineer) made and entered into City Secretary Contract No. 39779, (the Contract) which was authorized by the City Council by M&C 24059 on the 26ffi day of January, 2010; and WHEREAS, the Contract involves engineering services for the following project: North and South Holly Water Treatment Plant Ozone Upgrade Project WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C C-24828, adopted by the City Council on April 5, 2011, and further amplified in a proposal letter dated April 11, 2011, a copy of which is attached hereto and incorporated herein. The cost to the City for the additional professional services to be performed by the Engineer total $146,938.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid the Engineer for all work and services under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed $2,041,698.00. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. DISCUSSION: On January 26, 2010, (M&C C-24059)the City Council authorized the City Manager to execute an engineering agreement with Freese & Nichols, Inc., in the amount of$1,894,760.00 for the construction management of the North and South Holly Water Treatment Plant Ozone Upgrade Project. On July 27, 2010, (M&C C-24370)the City Council authorized the City Manager to execute a contract with Reynolds, Inc., in the amount of$23,293,500.00 for the construction of the North and South Holly Water Treatment Plant Ozone Upgrade Project. Construction of this project is anticipated to take approximately two years, with substantial completion scheduled for the summer of 2012. Freese and Nichols, Inc., will be on-site at the North and South Holly Water Plants during this duration as the construction manager. The city anticipates procuring two additional construction projects at the North and South Holly Water Plants, the North and South Holly Chlorine and Ammonia Conversion Project and the North Holly High Service Pump Station Discharge Pipe Replacement Project. Both projects will bid in May 2011 and have anticipated construction durations of about one year. Coordination of these two projects with the Ozone Project will be critical, as all projects must coordinate work activities with plant operations and be able to meet predefined shutdown and startup windows. The on-site construction manager for the ozone project is familiar with these activities. Amendment No. 1 compensates Freese & Nichols, Inc., for the additional work to perform construction management for the North and South Holly Chlorine and Ammonia Conversion Project and the North Holly High Service Pump Station Discharge Pipe Replacement Project. Freese& Nichols, Inc., is in compliance with the City's M/WBE Ordinance by committing to 30 percent M/WBE participation. The City's goal on this Amendment No. 1 is 20 percent. This project is located at the North and South Holly Water Treatment Plant, 1500 11th Avenue, COUNCIL DISTRICT 9. This contract amendment will provide construction management for these projects. Freese and Nichols staff is on site and can provide construction management for these projects; one additional project inspector is needed to observe the field work for approximately six months of field construction. The budget is based on the work being performed concurrently with the ongoing Holly Ozone Improvements project. The proposed cost ceiling of the Contract Amendment is$146,938. Copies of MIWBE Field Clerical and Materials Testing subcontractor proposals are also included. The construction is scheduled to advertise in April 2011,award in July 2011,start field construction in September 2011, be substantially complete in March 2012, with Final Completion in May 2012. The contract's MIWBE participation is 30.2% which exceeds the 17% goal established for the Construction Management Services for the Holly Ozone Project.
