AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $1,366,148.00 AND THE
SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $357,703.00 FROM
AVAILABLE FUNDS FOR THE PURPOSE FUNDING A CONTRACT WITH WILLIAM J.
SCHULTZ, INC. D161A CIRCLE "C" CONSTRUCTION COMPANY FOR LANCASTER
AVENUE WATER MAIN AND SANITARY SEWER MAIN IMPROVEMENTS {COMMERCE
STREET TO LAMAR STREET}, UNIT 1; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-2flfl4 in the
Budget of the Gity Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $1,366,148.00 and the Sewer Capital Project Fund in the
amount of $357,703.00 from available funds far the purpose of funding a contract with William J. Schultz,
Inc. d/b/a Circle "G" Construction Company for Lancaster Avenue water main and sanitary sewer main
improvements {Commerce Street to Lamar Street}, Unit 1.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full farce and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 15636 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $1,723,851.00 from the Water and Sewer Fund to the Water Capital Project
Fund in the amount of $1,366,148.00 and the Sewer Capital Project Fund in the amount of
$357,703.00; and
2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Project Fund in the amount of $1,366,148.00 and the Sewer Capital Project Fund in the
amount of $357,703.00 from available funds; and
3. Authorize the City Manager to execute a contract with William J. Schultz, Inc. d/b/a Circle "C"
Construction Company in the amount of $1,575,851.00 far Lancaster Avenue water main and sanitary
sewer main (mpravements {Commerce Street to Lamar Street}, Unit 1.
DtSCUSSI4N:
On February 12, 2002 {M&C C-18963}, the City Council authorized the City Manager to execute an
engineering agreement {City Secretary Contract Na. 27571} with EDAW, Inc., in association with other
engineering and planning firms, to prepare plans and specifications for the reconstruction of Lancaster
Avenue from IN-35W to Henderson Street.
The improvements proposed under this project are necessary in order to facilitate the proposed paving

The Unit 1 project was advertised for bid on September 18 and 25, 2003. On October 16, 2003 the
following bids were received:

* Atkins Brothers Equipment Company, tnc. was determined to be non-responsive to the project
specifications by failing to submit the necessary MI~JVBE documentation within the stipulated time frame.

bond at the time of bid opening as required in the contract documents.
to addition to the contract cost, $99,xxx.00 {water: $79,040.x0; sewer: $20,a0a.0a} is required for
inspection and survey, and $49,x00.00 {water: $34,a0a.0a; sewer: $15,404.0x} is provided for water and
sanitary sewer project contingencies.
William J. Schultz, Inc. d/bla Circle "C" Construction Company is in compliance with the City's M1WBE
Ordinance by committing to 22°Io MNVBE participation. The City's goat an this project is 22°Io.
This project is located in COUNCIL DISTRICT 9, Mapsco 76D and 77A.
FISCAt_ tNFQRMATION/CERTIFICATION:
The Finance Director certifies that upon approval and completion of Recommendation No. 1 and adoption
of the attached appropriation ordinance, funds will be available in the current capital budget, as
appropriated, of the Water and Sewer Capital Projects Funds.
