AN ORDINANCE AMENDING SECTIONS 35-56(g) and 35-56(h) OF
CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH
(1986), AS AMENDED, BY REVISING AND ADDING CERTAIN
RATES AND CHARGES; MAKING THIS ORDINANCE CUMU-
LATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES
AND PROVISIONS OF THE FORT WORTH CITY CODE IN
CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION 1.
That Section 35-56(g) of Chapter 35 of the Code of the City of Fort Worth(1986),
as amended, is hereby amended to be and read as follows:
(g) The following schedule of rates per month, or fraction thereof, shall be the
charges to all wholesale customers for furnishing water to such customers:

SECTION 2.
That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986)
as amended, is hereby amended to be and read as follows:
(h) The following schedule of rates per month, or fraction thereof, shall be the
charges to all wholesale customers for furnishing wastewater services to such
customers:

SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort worth, Texas (1985), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinance and such
Code, in which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5,
Section 1. of this ordinance shall take effect on January 1, 2011. Section 2. of this
ordinance shall take effect on October 1, 2010

Adopt an ordinance Revising Wholesale Water, Wastewater and Raw Water Service Rates and Amending
Chapter 35 "Water and Sewer", Article III "Charges", Sections 35 (g) and 35 (h)
RECOMMENDATION:
It is recommended that the city council adopt the attached ordinance, which revises wholesale
wastewater, water and raw water service rates and provides effective dates of billing on or after November
1, 2010, for wastewater usage of flows from and after October 1, 2010, and on or after February 1, 2011,
for water usage of flows from and after January 1, 2011.
DISCUSSION:
Each year a wholesale wastewater rate study is prepared in accordance with the terms of the uniform
wholesale customer contracts.
Red Oak Consulting completed the wholesale wastewater cost of service study for Fiscal Year 2011. The
wholesale water cost of service study was performed by the Water Department staff based on the
wholesale water cost of service study completed by Black& Veatch Corporation for Fiscal Year
2009. The result of these studies indicated the rates, as proposed below, will lawfully recover the cost of
providing wholesale water and wastewater service.
A joint meeting of the Wholesale Water Advisory committee and the Wholesale Wastewater Advisory
Committee was held July 15, 2010, to present the study and the rate requirements.
Since a new wholesale water contract will become effective on January 1, 2011, staff recommends
making the new water rates effective on that date and maintaining the Fiscal Year 2010 rates in effect until
the end of calendar year 2010. The rates for wholesale water were calculated under terms of the new
contract.

RAW WATER RATES
The cost of untreated water(per 1,000 gallons) supplied by the Tarrant Regional Water District is $0.7524
for use inside the district and $0.7794 outside the district. Adjusted for street rental and system loss, the
raw water charge to customers is $0.8201 inside the district and $0.8496 outside the district and is a direct
"pass through"to wholesale water customers.
