HomeMy WebLinkAboutContract 60352-A3AMENDMENT NO. 3 TO AGREEMENT Northwest Patrol Division Facility (101919) Design Build -Guaranteed Maximum Price 60352-A3 STATE OF TEXAS COUNTY OF TARRANT CITY SECRETARY CONTRACT NO. __ _ WHEREAS, The City of Fort Worth and FPI Builders, LLC of the City of Fort Worth County of Tarrant, State of Texas (Contractor) made and entered into City Secretary Contract No. 60352 (The Contract) which was authorized by the City Council by M&C 23-0771 the 12th day of September 2023, for NW Police Station Design Build Contract; and WHEREAS, further amendment is necessary to support contractors' ability to deliver the scope of work for the Northwest Patrol Division Facility and related costs refer to Attachment A; and NOW THEREFORE, City and Contractor, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: Paragraph 5.2.1 of the contract is amended as follows: "The Design-Builder shall submit a Conceptual Budget Update to the Owner for each preliminary construction phase while developing a final GMP. Each preliminary phase cost, as well as the final GMP, shall be inclusive of the Design-Builder's construction management fee of 4.00%. The City's currently authorized Design-Build Budget is the amount of $23,252,584.00 less Design Phase services costs, and inclusive of a 7.5% Owner's Construction Contingency Allowance. All unspent contingencies belong to the City at the completion of the project. Each Conceptual Budget Update and the GMP Proposal shall include the items in the following paragraphs 5.2.1.3 through 5.2.1.5." As detailed in Exhibit A, (i) this amount does not include design fees, which are instead covered by our Standard Agreement for Professional Services (CSC No. 60352); and (ii) this amount is inclusive of our Design-Builder's construction management fee of 4.00% of the cost of the work. The approved final Construction Documents consist of the following: See E�iibit B which is attached hereto and incorporated herein by reference. A complete set of the final Construction Documents has been provided via shared link to the CFW PMD Construction Team. A list of the assumptions and clarifications which we made in establishing the GMP is as follows: See Exhibit C which is attached hereto and incorporated herein by reference. The Contract Time upon which our proposed GMP is based is 399 calendar days. A list of allowances included in the GMP and a statement of their basis is as follows: There is an allowance of $22,256.00 for Spray Foam Insulation which includes 900 lineal feet of 1" thick spray foam insulation. Spray foam insulation in excess of this quantity will be priced as change order work. GUARANTEED MAXIMUM PRICE PROPOSAL PAGE 1 OF 2 The GMP is based on the following alternates, which are hereby accepted by the Owner: None at this time. The GMP is based upon the following unit price work: See Exhibit D which is attached hereto and incorporated herein by reference. For work performed on a unit price basis, the GMP is based upon the foregoing estimated quantities. If the actual quantities are more than or less than the estimated quantities, the GMP shall be adjusted accordingly by Change Order. The amount of the Change Order shall reflect (i) the difference between actual costs and the estimated cost based upon the above unit prices, and (ii) increases in the Design-Builder's Construction Management Fee. If the actual quantities for any item of unit price work vary by more than 20% of the estimated quantities, then Design- Builder shall be entitled to an equitable adjustment of the unit price and the GMP. The GMP includes the following Additional Services: Not Applicable This GMP Proposal shall remain open for acceptance until 5:00 p.m. at our letterhead address on Wednesday, June 18, 2025. If you do not accept the GMP Proposal by that time, then pursuant to paragraph 5.2.4 of the Agreement, the GMP Proposal shall be deemed withdrawn and of no effect. Pursuant to paragraph 2.5.1 of the Agreement, we hereby designate Eddie Garza as our safety representative. Pursuant to paragraph 6. L 1 of the Agreement, attached hereto as Exhibit E, which Exhibit is incorporated herein by reference, is a schedule of values consisting of a breakdown of the GMP. If this GMP Proposal, the Construction Documents, and the schedule of values meet with your approval, please so indicate with the signature below and return this fully executed GMP Proposal to us. The overall budget for the project is as follows: PROJECT COST Amount Design Build Cost (Owners Construction Contingency Allowance) $16,450,000.00 Amendment 1 $6,802,584.00 Staff Time, Materials Testing, IT, Security, Fixtures Furnishings and Equipment (FF&E), Exercise $1,226,335.00 Equipment, Contingency, etc. Total Project Cost $24,478,919.00 In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived. IRPC Plan Review Fees and other associated Development Fees will also be waived for this project. This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued.
