HomeMy WebLinkAboutOrdinance 15783ORDINANCE M~JNIBER ~ ~ AN ORDINANCE AMENDING THE FORT WORTI-I BUILDING CODE, BIB PROVIDING FOR AN INCREASE IN THE FEES CHARGED; PROVIDING FOR AN INCREASE IN THE PERCENTAGE OF FEES COLLECTED FOR THE PLAN REVIEW A.ND THE INSPECTION OF BUILDINGS BY APPROVED THIRD PARTY ORGANIZATIONS; PROVIDING FOR THE HOLDING OF A DEPOSIT TO COVER THE PLUMBING INSPECTION OF BUILDINGS BY APPROVED THIl2D PARTY ORGANIZATIONS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; PROVIDING THAT THIS ORDINANCE SHALL BE CLfN1ULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth has determined that it is appropriate to increase the fees charged far permits and other services performed; WHEREAS, the City of Fort Worth has heretofore enacted provisions allowing for the plan review and inspections of construction projects by separate third party organizations, has enacted an amendment to the fees charged for those individuals taking advantage of the third party option, and at this time considers it appropriate to increase the amount of percentage collected by the City for third party projects; WHEREAS, the City of Fort Worth wi11 continue to provide for the holding of a deposit to cover third party plumbing inspections as required by the Texas State Board of Plumbing Examiners; NUW, THEREFORE, BE IT ORDAINEll BY THE CITY C(JUNCIL aF THE CITY flF FC}RT W(JRTI~, TEXAS, A Ff3LLt~WS: SECTION I. Shell buildings shall be charged a fee based upan the expected use group of the building with no reduction far being a shell. 3. When work involves bath remodel and new construction/addition, the fee far the remodel will be based upan the remodel value and the fee for the new constructianladditian shall be based upan square footage. 4. Uther fees shall be as specified in Table No. 1-B. At the time of application, clang with any other fees required, anon-refundable permit application fee as specified in Table No. 1-~ shall be required. EXCEPTIQNS: 1. Buildings ar structures awned and occupied by a Federal, State, ar County entity an property owned by the Federal, State, ar County entity shall be exempt from the permit fees. This exception does not apply to public school districts or county community colleges. 2. Work by non-City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the wark is far action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived. 3. Work by City personnel an property under the control of the City of Fart Worth shall be exempt from the permit fees only if the application is accompanied by a copy of the work order for the project. 4. When the project is to be plan reviewed ar inspected by an approved third party organization as described in Section 111, the fee shall be reduced as follows: a. When plan review and field inspections are performed by Third Party, the permit fee shall be reduced by multiplying the sum by 2S°lo (Q.2S}. The resulting amount will be calculated to the penny with na rounding far the tenth of a penny figure. b. When plan review is performed by Third Party with field inspections performed by City Staff, the permit fee shall be reduced by multiplying the sum by 70°l0 ~Q.70}. The resulting amount will be calculated to the penny with na rounding far the tenth of a penny figure. c. When plan review is performed by City Staff with field inspections performed.. by Third Party, the permit fee shall be reduced l?y multiplying the sum by SS°lo {{}.55}. Exemption or reduction of the permit fees udder this section shall not waive the requirements to pay a full investigation fee for doing work without a permit as required under Section 107.5.2. The determination of value or valuation under any of the provisions of this code, or the determination of the applicable Use Group, shall be made by the Building Official. The value to be used in computing the building permit fee shall be the total value of all construction work for which the permit is issued, as well as all finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any other permanent equipment. EXCEPTIONS: 1. When other than new construction or addition, individual permit fees shall be required per trade. The building permit fee will be based upon the valuation as determined by the Building Official for that work only. The fee far other trade permits will be subject to the appropriate codes. 2. When an umbrella Building Permit is issued for new construction or additions to one- and two-family dwellings and townhomes under the Fort Worth Residential Code and which contain a fireplace under that Building Permit, fireplace permits shall not be required. When the value of work presented appears to be less than the amount of work being permitted, the Building Official may request acceptable bid price documentation. *Section 1(17.3; changed to read as oZZaws: 1 Q1.3 Plan Review Fees. When a plan or other data are submitted for review, a non- refundable plan review deposit shall be paid at the time of application. Said plan review deposit shall be as specified in Table Igo. 1-B. EXCEPTIONS: 1. The deposit will not be required for those applicants meeting exceptions 1, 2 or 3 of Section 107.2. 2. The deposit will not be required for additions and remodels to existing Group R-3 Occupancies, and for additions, remodels or new construction of their accessory structures. This filing fee shall only be applicable to the Building, Electrical, 1~lechanical, Plumbing and Energy submittals. Changes in other plans, e.g. site, landscaping, fire, civil, water service, etc. will be charged the fee as shown in Table Na. 1-B. If after the permit expires, a new permit must be applied for. SECTION 2. This article shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas {198b}, as amended, except where the provisions of this article are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy, or maintain any building or structure in the City or cause the same to be done contrary to or in violation of any of the provisions of this Code. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed Two Thousand Dollars {$2,000.00} for all violations involving fire safety, or public health and sanitation and shall be fined not more than Five Hundred Dollars {$504.00) for all other violations of this ordinance. Each day or any portion thereof during which any violation of this ordinance occurs or continues shall be deemed a separate offense and upon conviction thereof shall be punishable as herein provided. SECTION 4. DISCUSSION: During budget deliberations and approval of the FY2003-2004 budget, a number of improvements were included in the Development Departments budget Those improvements included additional staffing, increased technology applications and workspace improvements. Ta offset the costs of these improvements, adjustments in various development fees were proposed. It is proposed to increase the building and trade permit fee by 7°l~ and decrease the fee waiver for third party plan review and inspection services from 80°l~ to 75°l0. Fees related to licensing and registration of various trades are not subject to an increase at this time.
