FOR, SANITARY SEWER REHABILITATION, CONTRACT 80, PART 2; PROVIDING FOR A SEVERAMLITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. TEXAS:BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, SECTION 1. That in addition to those amounts allocated to the various City depailtrients for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $70,454.00, from available funds, for the purpose of funding a contract with M.E. Burns Construction, Inc. for Sanitary Sewer Rehabilitation, Contract 80,Pail 2. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of corripetentjUrisdiction, such decision, opinion 01-judgment shall in no way impair the remaining portions, sections, or pails of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be Cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer from the Water and Sewer Operating Fund in the amount of$70,454.00 to the Sewer Capital Projects Fund, 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$70,454.00 from available funds; and 3. Authorize the execution of a contract with M.E. Burns Construction, Inc., in the amount of $1,181,784.00 for Sanitary Sewer Rehabilitation, Contract 80, Part 2. DISCUSSION: On July 12, 2011, (M&C C-25001) the City Council authorized an Engineering Agreement with Neel- Schaffer, Inc., for the preparation of plans and specifications for Sanitary Sewer Rehabilitation, Contract 80. On October 24, 2013, the following bids were received: Bidde AM ount 'Time_ of Completion M.E. Burns Construction, Inc. ,$1,181,784.00 1230 Calendar Days lUtilitex Construction, Inc. 1$1,824,073.50 Clean Water State Revolving Fund (SRF) funding in the amount of$1,181,784.00 is available towards this Construction Contract. In addition to the contract cost, $70,454.00 ($35,000.00 for construction staking, project management, material testing and inspection and $35,454.00 for project contingencies) is needed from the sewer capital project fund. M/WBE Office - M.E. Burns Construction, Inc., is in compliance with the City's BDE Ordinance by committing to 14 percent MBE participation on this project. The City's goal on the project is 14 percent. Additionally, M.E. Burns Construction, Inc., is a certified M/WBE firm. The project is located in COUNCIL DISTRICT 5, Mapsco 79U and 79T. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the Clean Water State Revolving Fund 2007 Series, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund.
