AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE
EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT
WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY
CONSISTING OF` 9.5 SQUARE MILES, MORE OR LESS, OF LAND,
WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE
PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS;
PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS
PRO RATA SHARE OF TAXES; PROVIDING THAT THE INHABITANTS
THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE
CITIZENS OF FORT WORTH, TEXAS; PROVIDI6i(l' THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE
OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING
A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of Fort Worth,
Texas , wherein all interested persons were provided with an opportunity to
be heard on the proposed annexation of the territory hereinafter described,
was held at the City Council Chamber in the City Hall of Fort Worth, Texas ,
on the 2nd day of November 1970, which date is not more than twenty (20)
nor less than ten (10) days prior to the institution of annexation
proceedings; and
WHEREAS, notice of such public hearing was published in a news-
paper having general circulation 'in the City of Fort Worth, Texas, and in
the hereinafter described territory on the 21st day of October 1970, which
date is not more than twenty (20) nor less than ten ( 10) days prior to the
date of such public hearing; and,
WHEREAS, the population of the City of Fort Worth, Texas , is in
excess of 375,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas was
211 .813 square miles on January 1 , 1970; and,
WHEREAS, the hereinafter described territory lies within the
extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the i°iereinafter described territory lies adjacent to and
adjoins the City of Fort Worth, Texas; and
WHEREAS, the territory hereinafter described contains approximately
9.5 square miles ;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1 .
That the following described land and territory located
approximately 8 miles north of the Tarrant County Court House, lying
adjacent to and adjoining the City of Fort Worth, Texas , is hereby
added to and annexed to the City of Fort Worth, Texas, and said
territory hereinafter described shall hereafter be included within
the boundary limits of the City of Fort Worth, Texas , and the present
boundary limits of said City, at the various points contiguous to the
area hereinafter described, are altered and amended so as to include
said area within the corporate limits of the City of Fort Worth, Texas,
to wit:
Being a tract of land out of the M. Gilbert, Heirs of W. Smith ,
J. Walker Abstr. 1600, J. Walker Abstr. 1603, H. Robertson,
J. P. Alford, J. Wagley, E.H. Elkins, G. Mathews, W. Redfield,
S. Lockhart, Wm. McCowan, J. Hibbins, J. Armend'aris , and T. Peck
Surveys, and being more particularly described as follows:
BEGINNING at a point in the present corporate boundary of the
City of Fort Worth, said point being in the westerly right-of-way
line of County Road No. 4048, Old Denton Road, and the north
right-of-way line of County Road No. 4020, Saginaw East Road;
Thence west along the north line of County Road No. 4020 to its
intersection with the east right-of-way line of State Farm to
Market Road No. 156; Thence northerly along the easterly right-
of-way line of said Farm to Market Road No. 156 to a point
for corner, said point being the same as described in Fort
Worth Ordinance No. 6182 as being due east of the northeast
corner of a 100-acre tract of land described in a deed from
K.M. Van Zandt and wife, Octavia Van Zandt, to E.P. Van Zandt,
dated August 14, 1926, and recorded in Volume 926, at page
472 of the Deed Records of Tarrant County, Texas; Thence due
west along a straight "line to its intersection with the

east line of County Road No. 4108, Wagley Robertson Rd;
Thence north along the east line of said County Road
No. 4108 to its intersection with the south right-of-way
line of County Road No. 4005, Hicks Road; Thence east
along the south line of said County Road No. 4005 to its
fntersecti'on,-i with the east right-of-way line of the
A.T. & S. F. Railroad; Thence northerly along said east line
of the A.T. & S.F. Railroad to a point for corner, said
point being 500 feet northerly, measured at right angles,
of the northeasterly right-of-way line of U.S. Highway
81-287; Thence southeasterly along a line 500 feet
from and parallel to said northeasterly line of U.S. Highway
81-287 to its intersection with the east line of the
S. Lockhart Survey Abstract 977; Thence south along the
east line of said Lockhart Sury ey to a point fvr corner,
said point being 4010 feet northeasterly of, measured at
right angles, the northeasterly right-of-way line of U.S.
Highway 81-287'; Thence southeasterly along a line 400 feet
from and parallel to said northeasterly line of Highway
81-287 to a point for corner, said point being in the north
line of a 15.4 acre tract in the J. Walker Survey Abstract
1600, conveyed by T.B. dart to Allen Blair, Don Chambless,
Bob O'Dell , Don Norris , (Vista Industries) ,February 11 , 1969,
and recorded on Page 4682, Volume 351 of the Deed Records
of Tarrant County; Thence east along the north line of said
15.4 acre tract to a point for corner, said point being 500
feet from, measured at right angles, the northeasterly right-
of-way line of U.S. Highway 81-287; Thence southeasterly
along a line 500 feet from and parallel to said northeasterly
line of Highway 81-287 to its intersection with the south
right-of-way line, projected west, of County Road No. 4104,
Thompson Road; Thence east along said projected right-of-way
line to its intersection with the west right-of-way line of
County Road No. 4048, Old Denton Road; Thence south and west
along the west and north right-of-way lines of said County

Road No. 4048 to the place of beginning and containing 9.5
square miles more or less.
SECTION 2.
The foregoing-described territory and the area annexed shall
be a part of the City of Fort Wort[ , Texas, and the property so added
hereby shall bear its pro rata share of the taxes lev ied by the City of
Fort Worth, Texas, and the inhabitants thereof shall be entitled to all
of the rights and privileges of all the citizens and shall be bound by
the acts, ordinances, resolutions and regulations of the City of
Fort Worth, Texas.
SECTION 3.
That this ordinance shall and does hereby amend every prior
ordinance in conflict 1"ierewith, but as to all other ordinances or sections
of ordinances not in direct conflict herewith this ordinance shall be and
is hereby made cumulative.
SECTION 4.
If any section, subsection, clause, sentence, phrase, or
word cf this ordinance is for any reason held void or unconstitutional ,
by a court of competent jurisdiction, such invalidity shall not affect
the validity of the remaining sections, subsections , clauses, sentences ,
phrases, or words except as the same are inseparable from and indispen-
sable to the remaining portions of the ordinance.
SECTION 5.
This ordinance shall be in full force and effect from and
after the date of its passage on first reading and publication and
its passage on second reading as provided for in Section 40 of
Chapter XXVIII of the Charter of the City of Fort Worth and it is so
ordained.

As part of the continuing annexation program of the City of Fort Worth, the
City Plan Commission, at its regular meeting of September 30, 1970, recommend-
ed to the City Council the annexation of 9 and one--half square miles of land
north of Fort Worth on Interstate Highway I-35W and U.S. 81-287 North of Fort
Worth,
There is considerable activity by developers and speculators purchasing land
near the intersection of I-35W and U.S. Highway 81-287 north of the city.
The Plan Commission feels that municipal controls should be placed on this
property to avoid undesirable development along a major approach to the
City. These new highways will be the main entrances to Fort Worth from the
north and nor^thwest.
Boundary Agreement with Saginaw
As a result of the boundary agreement with the City of Saginaw in settle-
ment of a lawsuit the City of Fort Worth lost its protective corridors in
the northwest portion of Tarrant County. The proposed annexation would ex-
tend Fort Worth's jurisdiction five miles beyond the city limits, into the
potential growth area of northwestern Tarrant County.
Annexation Allotment
Under Article 970a of the Revised Civil Statutes of Texas the City is per-
mitted to annex up to ten per cent of its net land area in any one calendar
year. The city currently has a net land area of 212 square miles and as
of this date in 1970 has annexed only 0.56 square miles.
The annexation process takes ten weeks to complete and if Fort Worth is to
utilize its 1970 annexation allotment of 21 square miles, City Council action
on October 19 for adoption of a resolution setting a public hearing will be
necessary,
Recommendation
It is recommended that the City Council approve the report of the City Plan
Commission and adopt that resolution that has been proposed setting the
date for public hearing on the contemplated annexation of 9 and one-half
square miles on November 2, 1970 and instruct the staff to proceed with
the preparation of the necessary ordinances
