JACKSON CONSTRUCTION COMPANY, INC, AND FOR THE MAKING AND CONSTRUCTION OF SUCH IMPROVEMENTS AND AUTHORIZING ITS EXECU- TION; MAKING APPROPRIATION$ F70R THE PURPOSE OF PAYING THE INDEBTEDNESS THEREBY INCURRED; MAKING PROVISIONS FOR THE LEVYING OF ASSESSMENTS AGAINST ABUTTING PROPERTIES AND THE OWNtRS THEREOF FOR A PART OF THE COST OF SUCH IMPROVEMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE OF SUCH ASSESSMENTS; DIRECTING THE PUBLIC WORKS DIRECTOR OF THE CITY TO PRE- PARE ESTIMATES; DIRECTING THE CITY SECRETARY TO FILE A NOTICE OF ADOPTION OF THIS ORDINANCE WITH THE COUNTY CLERK OF TARRANT COUNTY, TEXAS; DECLAR- ING THAT THIS ORDINANCE AND ALL SUBSEQUENT PROCEEDINGS RELATING TO SAID STREET IMPROVEMENT ARE AND SHALL BE PURSUANT TO THE ACT OF THE FIRST CALLED SESSION OF THE FORTIETH LEGISLATURE OF THE STATE OF TEXAS, CHAPTER 106; COMMONLY KNOWN AS ARTICLE 1105b OF VERNON'S TEXAS CIVIL STATUTES AS AMENDED BY ACTS 1967, 60TH LEGISLATURE, PACE 365, CHAPTER 176, SECTION 1, EMERGENCY EFFECTIVE MAY 12, 1967; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND EN- ROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOKS OF THE CITY COUNCIL AND BY' FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THIS CITY' AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Public Works Director for the City of Fort Worth, Texas, has prepared Plans and Specifications for the improvements of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, and same having been examined by the City Council of the City of Fort Worth, Texas, and found to be in all matters and things proper, NOW THEREFORE: BE IT ORDAINED BY THE CITY CO'UN'CIL OF THE CITY OF FORT WORTH, TEXAS, THAT: 1, The hereinafter described Plans and Specifications are hereby approved and adopted. I There exists a public necessity for the improvement of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, to-wit: HANDLEY DRIVE From Spur 303 to East Lancaster Avenue, known and designated as Handley Drive, Project No. 104-35000-352,. ......................... ... Each of the above described portions of streets, avenues and public places in the City of Fort Worth, Texas, shall be improved by raising, grading, and filling same and by constructing thereon the following, to-wit. HANDLEY DRIVE From Spur 303 to East Lancaster Avenue, known and designated as Handley Drive, Project No. 104- 35000- 52; a seven-inch thick, reinforced concrete pavement on six-inch thick ceakent stabilized subgrade with seven-inch high superimposed concrete curb so that the finished roadway will be f-Ifty feet wide, and by construct- ing six-inch thick concrete drive- ways where specified. The above, together with concrete rurbs, gutters , driveways and in A dent a I a to such improvements, an proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances ; all of said improvements to be conStructed as and where shown on the Plans and Specifications therefor, l:it. The cost of said improvements as herein defined shall be paid for as follows, to-wit: A. The City of Fort Worth shall pay all of the remainder of the cost of said improvements after deducting the amounte herein specified to be paid by the &butting properties and the real and true owners thereof as set out in subsection A. Procedures concerning proposed improvements, owner, participation in costs and methods of payment were explained by Odell Schmidt to the two (2) people in attendance. Mrs. E. E. Nichols, 6700 Norms, owner of Lot 1 , Block 5, Handley Addition, was anxious to no if the upgrading of Handley Drive would cause water to drain onto her property. Mr. Schmidt assured her that the water from the stieet would drain into the inlet at the Hart Street intersection. Mrs. Nicholas also said she would need at least one or two more driveways for off street parking, as they planned to put another building on the west side of their property. She was to!d to notify the Engineering Division an soon as she knew where she wanted them, and they would be added to the plans. Mr. R. F. McConnell, a representative of Texas and Facific Railroad, had several questions. He wanted to know if adequate drainage would be provided so that the water would not stand an the Railroad property. Mr. Schmidt showed him the plans which propose two (2) four foot (W) square drop inlets and three (3) five Vot (5') street Inlets, which should afford good drainage. Mr. McConnell stated that, he thought that the enhancement of the property would be less in this case since it is being designed to tie in two main traffic arteries rather than for the benefit of the property ownere, also the enhancement would normally be more on a forty foot street than with a fifty foot street as proposed, due to the amount of traffic. Mr. Schmidt told him that the a3sessment would be the same at either width, as the abutting property owneig were assessed for the first twenty feet from each side and that the City-at-large assumed the rest of the cost. WIDTHS UNIT STREET LIMITS FEET FEET I Handley Drive Spur 303 to East Lancaster Avenue (Highway 80) 50' 80, This project will provide imptsved traffic facilities between Highway 303 and Highway 80, ExislIA& Conditions The above portion of Handley Drive is a major thoroughfare with a present traffic count of 8500 vehicles per day. The existing street varies in width from 25' to 50' , of sub-standard pavement , partially curbed and guttered, with two railroad track crossings. The two railroad crossings consist of a main line and a team track, all on railroad right-of-way, very close to each other, and on different grades, thereby, providing a poor riding quality. Imppyements The improvements will consist of widening to a 50-foot width by the construction' of 7" thick reinforced concrete pavement , with 7" high concrete curb , on a 6" lime stabilized subgrade, along with the necessary storm sewer appurten- ances , and 6" concrete drives. Improvements at the railroad crossings will consist of raising the team Track to the proposed paving grade, extending the plank crossings, relocating the existing crossing protection devices , and converting the existing flasher devices to cantilever type devices. Railload Aareement It will be necessary for the City to enter into an agreement with the Texas and Pacific Railway Company for the improvements to the railroad crossings. It is proposed that : (a) The City pay 2/3 of the cost of the railroad company's signal relocations and revisions, in accordance with present City policy. V The railroad company will extend the plank crossings at railroad expense. Q The City is to pay the cost of adjusting the team track to street grade by the railroad company, DATE REFERENCE SUBJECT: Award of Contract - Handley Drive PAGE 6/261`72 NUMBER C-2263 Project No, 104-35000-352 2 - Of 3 Calan-ty Participation In accordance with the agreement between the City Council and the Tarrant County Commissioners Court for the improvement of sub-standard streets within the City limits , a request was made by the County to resurface this section of Handley, Drive, Upoa notification of the City's plans for this project, Mr. R. L. Mebus, Tarrant County Commissioner, Precinct No. 2, has offered County participation in the amount of $5,000. Submission of Bids The following bids have been received-, Bidder Amount James W. The estimated cost to the City for, relocating the existing railroad crossing protection devices and converting the existing flashers to cantilever is $6,500.
