AN ORDINANCE VACATING AND EXTINGUISHING PORTION OF A
PUBLIC ALLEY ADJACENT TO LOT IAR OF E.E. CHASE
SUBDIVISION OF BLOCK 13 OF THE FIELDS SUBDIVISION OF THE
WILLIAM WELCH SURVEY, AN ADDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT
RECORDED UNDER CLERK'S FILE NO. D212119938, REAL
PROPERTY RECORDS, TARRANT COUNTY, TEXAS,; CONTAINING
APPROXIMATELY 220 SQUARE FEET OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND;® THE RETAINMENT OF
EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of a public alley adjacent to Lot IAR, E.E. Chase Subdivision of Block 13
of the Fields Subdivision of the William Welch Survey, an addition to the City of Fort Worth, as
recorded under Clerk's File No. D212119938 of the Real Property Records of Tarrant County,
Texas, and containing approximately 220 square feet or 0.0050 acre of land more or less, and as
more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by
reference be and the same is vacated and extinguished.
SECTION 2.
That the fee to the lands in the above-described vacated alley is hereby released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.

That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

SUBJECT:
Adopt Ordinance Vacating a Portion of an Alley Between West Rosedale Street and Oleander Avenue for
Additional Property to Provide for a Larger Building Footprint (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating e portion of an alley between West Rosedale Street and
Oleander Avenue for additional property to provide for a larger building footprint; and
2. Waive any and all purchase fee value of the vacated land in ononrdonue with City Policy (Mayor and
Council Communication G-15824)
DISCUSSION:
Grant Engineering, Inc., on behalf of Or. David Tillman, has requested the vacation of this portion of the
alley to replat it with the adjoining property for more room to expand the proposed building footprint. The
City Plan Commission recommended approval of this request at its meeting on August 28, 2013. An
acceptable final plat (FS-013'184) has been received in accordance with the Subdivision Ordinance.
The City nf Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
prnooae. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 8. 2007 (Mayor and Council Communication G-15624). Staff recommends waiving the hair market
value or any portion thereof of purchase price of the right-of-way easements for the alley.
This project is located in COUNCIL DISTRICT 9, [Wapsco76M.
