AN ORDINANCE VACATING AND EXTINGUISHING PORTION OF A
15 FEET WIDE STRIP OF LAND IN BLOCK 20 OF HYDE PARK
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, ACCORDING TO THE PLAT RECORDED IN VOLUME 63,
PAGE 9, PLAT RECORDS, TARRANT COUNTY, TEXAS, SAID STRIP
BEING RESERVED AS A PUBLIC ALLEY IN THE DEED RECORDED
IN VOLUME 133. PAGE 258, DEED RECORDS, TARRANT COUNTY,
TEXAS; CONTAINING APPROXIMATELY 2,475 SQUARE FEET OF
LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of a fifteen foot wide alley, situated Block 20, of the Hyde Park Addition,
an addition to the City of Fort Worth, as recorded in Volume 63, Page 9 of the Plat Records of
Tarrant County, Texas, and containing approximately 2,475 square feet or 0.0568 acre of land
more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the fee to the lands in the above-described vacated alley is hereby released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
A 15 feet wide strip of land in Block 20 of Hyde Park Addition to the City of Fort
Worth, Tarrant County, Texas, according to the plat recorded in Volume 63, Page 9,
Plat Records, Tarrant County, Texas, said strip being reserved as a public alley in
the deed recorded in Volume 133, Page 258, Deed Records, Tarrant County, Texas,
and being more particularly described by ,metes and bounds as follows:
BEGINNING at a found X in concrete at the southwest corner of Lot 523R, Block
20 of Hyde Park Addition to the City of Fort Worth, Tarrant County, Texas,
according to the plat recorded in Volume 388-113, Page 200, Plat Records Tarrant
County, Texas, in the north line of said alley and in the east right—of—way line of
the South Freeway, Interstate Highway 35W;
THENCE East along the north line of said alley and the south line of said Lot
523R, 165,50 feet to a point;
THENCE South 00*50'00" West, 15.00 feet to a set P. K. nail in .asphalt at the
northeast corner of Lot 515 in said Block 20, and in the south line of said alley;
THENCE West along the south line of said alley and the north line of Lots 515
through 518 of said Block 20, 164.55 feet to a found X in concrete in the east
right—of—way line of said South Freeway;
THENCE along the east right—of—way line of said South Freeway the following three
calls:
North 00*50'00" East, 7,.50 feet to a point;
West, 0.95 feet to a point;
North 00'50'00" East, 7.50 feet to the Point of Beginning, and containing
0.0568 acres (2,475 square feet) of land, more or less.

Adopt Ordinance Vacating a Portion of an Alley Between South Freeway and Evans Avenue for a New Gas
Station and Convenience Store (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of an alley between South Freeway and Evans
Avenue for a new gas station and convenience store; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and
Council Communication G-15624).
DISCUSSION:
Grant Engineering, Inc, on behalf of Gary Weatherspoon, has requested the vacation of this portion of the
alley to replat it with the adjoining property for a new gas station and convenience store. The City Plan
Commission recommended approval of this request at its meeting on October 23, 2013, An acceptable
final plat (FS-13-091) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the alley.
This project is located in COUNCIL DISTRICT 8, Mapsco 77P.
