WHEREAS, the Landowner is the owner of certain real property described s an
approximately 7.025 acre tract located in the Cevin tors Ha Survey, Abstract 256 ,
Tarrant County, Texas according to the deed recorded in Vol 1932, Pg, 6 Vol 2004, P

hereinafter called the "Property".
WHEREAS, the Landowner is Proceeding; tel build on and develop the Property
according to the Site Ply Subdivision Plan known as New Administration Building and
Counseling Center, Lena. Pope pan e-hereinafter called the, "Plan"', which is expressly
made a part hereof, as approved or to be approved by the City and the Landowner
provides for management of storm water within the con. nes of the Property; and

WHEREAS, the City requires, that on-site Storm Water Management Facilities
("Facility") as shown on the Flan be constructed and adequately maintained by the
Landowner, its successors and assigns, the location and dimensions of which is shown and
more particularly described by metes and bounds, in .the attached Exhibit "A" ("Facility
Property"' and
NOW, THEREFORE, in consideration of the foregoing premises, the mutual
covenants contained herein, and the following terms and conditions, the parties hereto
agree as follows:
1. The Landowner, its successors and assigns, shall adequately construct and
maintain the on-site Storm Water Management Facility (",Facility,"), at no
expense to the City of Fort Worth in accordance with the design specifications
for the Facility, attached as Exhibit "B", and the current standards then in force.
and effect in the City of Port Worth and with the Operations and Maintenance
Plan attached to this Agreement as Exhibit "C". The Storm Water Facility
includes all pipes, channels, or other conveyances built to convey storm water
to the facility, as well as all strnct*ures, improvements, and, vegetation provided
to control the quantity and quality of the storm water. Adequate maintenance
is herein defined as good working condition so that these facilities are
performing their design functions. The Storm Water Structural Control
Maintenance Checklists, attached to this Agreement as Exhibit "U", are to be
used to establish what good working condition is acceptable to the City.
2. The Landowner, its successors and assigns, shall inspect the Facility and
submit an inspection report to the City annually. The purpose of the inspection
is to assure safe and proper functioning of the Facility. The inspection shall
cover the entire Facility, beans, outlet structure, pond areas, access reads, etc.
Components, of 'the Facility, which need maintenance or replacement to
perform their des,ign function., shall be noted in.the inspection report along with
the corrective actions' to be taken.

3. The Landowner, its successors and assigns, hereby grant permission to the
City, its authorized agents, and employees,, to enter upon the Property and to
inspect the Facility Property whenever the City deems, necessary. The purpose
of inspection is to follow-up on reported deficiencies, and/or to respond to
citizen complaints. The City shall provide the Landowner, its successors and
assigns, copies of the inspection findings and a directive to commence with the
repairs if necessary.
4. In the event the Landowner, its successors and assigns, fails to maintain 'the
Facility in good working condition as specified herein, the City, its authorized
agents and employees,, may enter upon the Facility, Property and take whatever
ste ps necessar y to, correct deficiencies identified in the inspection report and to
charge the costs of such repairs to the Landowner, its successors and assigns.
It 'is, expressly understood and agreed that the City is under no obligation
to routinely maintain or repair said Facility, and in no event shall this
Agreement be construed to impose any such obligation on the City, such
obligation i's Landowner's,.
5. The Landowner, its successors and assigns, will perforn-i the work necessary to
keep the Facility in good working order as appropriate. In the event the City
pursuant to this Agreement, performs work of any nature, or expends any funds
in performance of said work for labor, use of equipment, supplies,, materials,
and the like, the Landowner, its successors and assigns, shall reimburse the
City upon demand, within thirty (30) days of receipt thereof for all actual costs
incurred by the City hereunder. In the event that Landowner or its successors
or assigns tali to pay the City for the costs incurred under this section, the City
shall impress a lien for the costs of such work upon other lots owned by the
Landowner. Such lien shall be perfected by filing in the office of the County
Clerk of Tarrant County, Texas an affidavit identifying the property to be
charged with such lien, stating the amount thereof, and making reference to
this Agreement.
6. This Agreement imposes no liability of any kind whatsoever on the City. THE
LANDOWNER AGREES TO HOLD THE CITY HARMLESS FROM

AND DOES HEREBY INDEMNIFY, HOLD HARMLESS AND DEFEND
THE CITY of FORT WORTH,, ITS AGENTS, SERVANTS AND
EMPLOYEES FROM AND AGAINST' ALL COSTS, EXPENSES,
LOlSSESl, DAMAGES, CLAI MS OR CAUSES of ACTION
WHATSOEVER ARISING, OIL WHICH MIGHT ARISE, FROM THE
FAILURE OF' LANDOWNER OR ANY FUTURE OWNERS of THE
ABOVE FA ILITITY PROPERTY TY To MAINTAIN THE FACILITY",
INCLUDING, B T NOT' LIMITED To THE TED AND BANKS of
TILE DETENTION POND; ANY DAMAGES CAUSED To PERSON OR
PROPERTY DUE TO (1) FLOODING of THE POND AND ITS
BANKS, 2) SLOPE FAILURE of THE BANKS OF THE POND, OR (3)
FAILURE of THE POND OR ITS BANKS To OPERAT E IN A,.
MANNER CONSISTENT WITH CITY OF FORT WORTH CRITERIA
TO PERFORM ANY OTHER DUTIES OR OBLIGATIONS
HEREUNDER,
7. Landowner covenants and agrees that no habitable building shall be erected
within the drainage easement outlined on Exhibit "A", but this paragraph shall.
not preclude construction of other improvements within the drainage easement,
which do not impede drainage. Landowner covenants and agrees that no
habitable building shall he erected on the above property abutting such
easement which shall have a. finished floor at are elevation less than two feet
above the maximum depth of Water in the detention pond Which would occur
during a loo year frequency flood.
8. This .Agreement shall be recorded among the land records of Tarrant County,
Texas, shall constitute a covenant running with the land, and shall be blinding
on the Lan.downer, its administrators, executors, assigns, heirs and any other

the building to the point of disposal.

1. Base Section'. 6-inch minimum thickness for floor slab, and 4-inch minimum thickness for
walls and base riser section, and having a separate base slab or base section with integral
floor.
2. Riser Sections: 4-inch minimum thickness, 48-inch diameter,and lengths to provide depth
indicated.
3. Top Section: Eccentric cone type, unless concentric cone or flat-slab-top,type, is indicated.
Top of cone to match grade rings.

PART 3- EXECUTION
3.1 PREPARATION OF FOUNDATION FOR BURIED STORM SEWERAGE SYSTEMS
A. Grade trench bottom to provide a smooth,firm,stable,and rock-free foundation,throughout the length,
of the pipe.
B. Remove unstable,soft, and unsuitable materials at the surface upon which pipes are to be laid,and
backfill with clean sand or pea gravel to indicated level.
C. Shape bottom of trench to fit bottom of pipe. Fill,unevenness with tamped sand backfiil. Dig bell holes
at each pipejoiint to relieve the bells of all loads and to ensure continuous bearing of the pipe barrel on
the foundation.

3.2 PIPE APPLICATIONS FOR UNDERGROUND STORM SEWER.
A. Pipe Sizes 15 Inches and Larger: Reinforced concrete sewer pipe and fittings,for all applications,
except where corrugated steel pipe slotted drain is specifically noted.
B. Pipe Sizes 12 Inches and Smaller: PVC gasket joint sewer pipe and fittings,.
C. Corrugated,galvanized steel pipe shall be used for underground storm water detention.
3.3 INSTALLATION,, GENERAL
A. Generall Locations and Arrangements: Drawings(plans and details)indicate the general location and
arrangement of the underground storm sewerage system piping. Location and arrangement of pipling
layout take into account many design, considerations. Install the piping as indicated, to the extent
practical.
B. Install piping beginning at low point of systems,true to grades and alignment indicated with unbroken
continuity of invert. Place bell ends of piping facing upstream. Install gaskets, seals, sleeves, and
couplings in accordance with manufacturer's recommendations for use of lubri,ca,n,ts,cements, and
other installation requirements. Ma,iinta,i,n swab or drag, in line and pull past each joint as it is
completed.,
C. Use manholes or catch basins,for changes indirection,except wheire a fitting is indicated. Use fittings
for branch connections, except where direct tap into existing sewer is indicated.
D. Use proper size increasers, reducers, and couplings, where different size or material of pipes and
fittings are connected. Reduction of the size of piping in the direction of flow is prohibited.
E. Install piping pitched down in direction of flow,at minimum slope of 1 percent,except where indicated
Otherwise.
3.4 PIPE JOINT CONSTRUCTION AND INSTALLATION
A. Join concrete pipe and fittings with rubber gaskets in accordance with ASTM C 443,and install piping
in accordance with applicable provisions,of CPA"'Concrete Pipe Installation Manual."
B. Join and install PV'C pipe as follows:
d. Pipe and gasketed fittings,joining with elastomeric seals in accordance with ASTM D 3,212.
2. Installation in accordance with AS,TM D 2321.
C Corrugated, Steel Pipe,:
1. Install CSP in accordance with manufacturer's recommendations utilizing premanufacturered,

3.5 MANHOLES
A. General: Install manholes complete with accessories as indicated. Form,continuous concrete or split
pipe section channel,and benches between inlets and outlet. Set tops of frames and covers flush with

B. Place precast concrete manhole sections as indicated,, and install in accordance with AST IVI C 891.
C. Construct cast-in-place manholes as indicated.
D. Provide rubber joint gasket complying with AS,TM C 443,at Joints of sections,.
E. Apply bituminous mastic coating at joints of sections.
3.6 CLEANOUTS,
A. Install cl,eanouts and extension from sewer pipe to cleanoutatgrade as indicated. Setclleanoutfr,ame
and cover in concrete block 18 by 18 by 12,inches deep,except where location is in concrete,paving.
Set top of cleanout I inch above surrounding earth grade or flush with grade when installed in paving.,
3.7 CATCH BASINS/AREA DRAINS
A. Construct catch basins to sizes and shapes indicated.
B. Set frames and grates to elevations indicated.
3.8 OUTFALLS
A. Construct outfalls of reinforced concrete which will attain 28-day compressive strength of not less than
3000 psi.
3.9 FIELD QUALITY CONTROL
A. Testing: Perform testing of completed piping in accordance with local authorities having jurisdiction.
Do not backfill trench until storm drainage system has been inspected.
B. Cleaning,-. Clear interior of piping and structures of dirt ands other superfluous material as work
progresses. Maintain swab or drag in piping and pull past each joint as it is completed.
1. In large, accessible piping, brushes and brooms,may be used for cleaning.
2. dace plugs in ends of uncompleted pipe at end of day or whenever work stops.
3. Flush piping between manholes, if required by local authority,to remove collected debris.
C. Interior Inspectiom, Inspect piping to determine whether line displacement or other damage has
occurred.
1. Make, inspections after, pipe between maniholes and manhole locations has been installed
and approximately 2 feet of backfill is in, place, and again at completion of project.
2. If inspection indicates poor alignment, debris, displaced pipe, infiltration, or other defects,
correct such defects and reinspect.

CITY OF FORT WORTH STORM WATER FACILITY
OPERATION AND MAINTENANCE PLAN
The only responsibility the City of Fort Worth has in the operation and
maintenance of this Facility is inspection.
General Maintenance Procedures,
The structural and functional integrity of the Facility shall be maintained at all
times by removing and preventing drainage interference, obstructions, blockages,
or other adverse effects into, through,, or out of the system.
Periodic slit removal shall occur when standing water conditions occur or the
pond's storage volume is reduced by more than 10%. Silt shall be removed and
the pond/basin returned to original lines and grades shown, on the approved
engineering plans. In addition, corrective measures are required any time a basin
does not drain completely within 72 hours, of cessation of inflow. NO STANDING
WATER IS ALLOWED in basins designed for dry detention purposes.
Accumulated litter, sediment, and debris shall be removed every 6 months or as
necessary to maintain proper operation of the basin. Disposal shall be in
accordance with federal, state and local regulations.,
Detention facilities shall be mowed monthly between the months of April and
October or anytime vegetation exceedi,s 1 2-inches in height.
To prevent debris from entering and clogging the downstream storm sewer
system a wire mesh screen or similar screening device shall be installed over the
outlet until final acceptance.
•4. PREVENTIVE MAI,NTENANCEIINSPECTION
Visual inspections of all components wili be conducted every 61 months.
A log shall be kept of' maintenance actions,, and inspections. The log
should document the condition of the detention system's primary
components, mowing, and silt, litter and debris removal dates. Document
aeration of the basin, bottoms and replanting to prevent the sealing of the
basin, bottom.
Written maintenance and repair records shall be maintained by the
party or parties signing the attached Agreement and shall be provided
to the City upon request.,

Lena Pope Home, Inc., is the owner of a 7.025 acre tract of land on which 0.336 acres of the property will be
used to construct an underground stort-nwater facility for the expansion of the Lena Pope Home. The
expansion will include a new administration building and counseling center. The underground improvements
are being constructed to capture and manage storrnwater run—off within the confines of the property to
pre—development levels.
The landowner and successors are required to maintain the stormwater facility at no expense to the City. The
Stormwater Facility Maintenance Agreement will ensure proper maintenance of the facility by Lena Pope
Home, Inc. However, if the landowner fails to properly maintain the improvements, the Agreement gives the
City the right to take all steps necessary to ensure the stormwater facility is operating according to City
standards and to correct any deficiencies.This requirement and right run with the land.
