HomeMy WebLinkAboutContract 63044-A11st Amendment to Fort Worth City Secretary Contract 63044 Page 1 of 5 FIRST AMENDMENT TO FORT WORTH CITY SECRETARY CONTRACT 63044 BETWEEN CITY OF FORT WORTH AND MORRIS AND MCDANIEL, INC This First Amendment to Fort Worth City Secretary Contract 63044 (“Amendment”) is made between the City of Fort Worth (“City”), a Texas home-rule municipal corporation, and Morris and McDaniel, Inc (“Vendor”), referred to as a “party” and collectively as the “parties”. WHEREAS, the parties entered into an agreement identified as Fort Worth City Secretary Contract 63044 for a term beginning April 1, 2025, (“Agreement”); WHEREAS, the current term expires on March 31, 2026, unless terminated earlier in accordance with the Agreement; and WHEREAS, it is the collective desire of the parties to amend the Agreement to develop a Physical Agility and Work Simulation Assessment for the Fort Worth Marshals Division. NOW THEREFORE, known by all these present, the parties, acting herein by and through their duly authorized representatives, agree to the following terms, which amend the Agreement as follows: I. AMENDMENT Section 1, the Scope of Services provision of the Agreement, is hereby replaced by the following language: Vendor will provide Criticall Testing Validation for City’s civil service examinations, will create structured oral interview questions for the City’s Fire Department, and will develop a Physical Agility and Work Simulation Assessment for the City’s Marshals Division (“Services"), as set forth in more detail in Exhibit "A," attached hereto and incorporated herein for all purposes. Exhibit “A” is replaced by the attached Exhibit “A”. Exhibit “B” is replaced by the attached Exhibit “B”. Section 3, the Compensation provision of the Agreement, is hereby replaced by the following language: City will pay Vendor in accordance with the provisions of this Agreement, including Exhibit “B,” which is attached hereto and incorporated herein for all purposes. Total compensation under this Agreement will be an amount up to Ninety-Nine Thousand Dollars ($99,000). Vendor will not perform any additional services or bill for expenses incurred for City not specified by this Agreement unless City requests and approves in writing the additional costs for such services. 1st Amendment to Fort Worth City Secretary Contract 63044 Page 2 of 5 City will not be liable for any additional expenses of Vendor not specified by this Agreement unless City first approves such expenses in writing. II. ALL OTHER TERMS SHALL REMAIN THE SAME All other terms, provisions, conditions, covenants and recitals of the Agreement not expressly amended herein shall remain in full force and effect. III. ELECTRONIC SIGNATURE This Amendment may be executed in multiple counterparts, each of which shall be an original and all of which shall constitute one and the same instrument. A facsimile copy or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall have the same effect as an original. By: Name: David Morris Title: President Date: ____________________________ 1st Amendment to Fort Worth City Secretary Contract 63044 Page 4 of 5 EXHIBIT A SCOPE OF SERVICES Vendor will provide Validation of Critical Testing Modules for use in Telecommunicator Entry level testing: The Vendor will complete a properly structured validation and job task analysis to align the telecommunicator role with the Critical] modules to ensure the tool is calibrated and valid to align with the department's desired knowledge, skills, and abilities. Vendor will create Structured Oral Interview Questions: Vendor will meet with Department SMEs to ensure the questions align with the department's desired knowledge, skills, and abilities. Vendor will create five (5) scenario-based questions to be used for both Single Role Entry Fire Fighters and Dual Role Entry Fire Fighters. Vendor will review feedback from the City on the questions created and adjust the questions as necessary. Through virtual sessions, Vendor will train the interviewers / assessors in the department on how to properly score answers to the created questions. For the Marshals Division: The Vendor will perform a job analysis and equipment survey. The Vendor will execute an employee survey. The Vendor will develop and validate a Physical Agility and Work Simulation Assessment. The Vendor will standardize minimum scores and times. The Vendor will assist in set-up of the Physical Agility and Work Simulation assessment sequence on site which will have a swimming component. The Vendor will train members of the Fort Worth Marshals Division with setting up, executing, and scoring. Any additional required travel due to jurisdiction request or other extraordinary circumstances not critical to core contract performance will be an additional cost and will be invoiced, based on prevailing jurisdiction travel rules and regulations. Quote does not include cost of equipment; equipment will be the responsibility of the jurisdiction
