HomeMy WebLinkAboutOrdinance 21111-01-2014Ordinance No. 21111-01-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC EVENTS CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,225,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF CONSTRUCTION OF A MULTI-PURPOSE PAVILION AT THE WILL ROGERS MEMORIAL CENTER (WRMC); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Public Events Capital Projects Fund in the amount of $1,225,000.00, from available funds, for the purpose of construction of a multi-purpose pavilion at the WRMC. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the retraining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those *instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Project 1 is the Multi-Purpose Pavilion which will provide a covered, performance-sized Open air arena bn allow equestrian shows tO hold performances or for performer exercise and warm-up before their performances. This pavilion can also be used for other activities, such as outdoor exhibitions. C)n July 18,2013.(K8&CC-26342) the City Council authorized the Architectural Design and Construction Administration Services Agreement with Hahnfe|d Hoffer Stanford, LLC. for the Multi-Purpose Pavilion in the amount Of$322.254.O0. On July 1O.2013,(1\4&CG-17937) the City Council adopted an ordinance for the issuance ofCertificates ofOb|igation(C[))iOtheanOOUntnottO8Xuead$13.0OO.00O.O0andauthohzedthis8rnOUnttob8UseUfor improvements to the Will Rogers Memorial Center. On September 17, 2013, (M&C G-18007) the City Council appropriated the proceeds of the CO, Series 20136 for funding the projects. The projects were jointly advertised in the Fort Worth Star - Telegram on October 3, 2013 and October 10, 2013 seeking firms which could provide the best value to the City for the whole project. On November 7, 2013, six Offerors submitted base proposals as follows: Imperial Construction, Inc. $15,648,000.00 Ratcliff Constructors, LP $16,266,000.00 Steele & Freeman, Inc. $16,500,000.00 Sedalco, Inc. $16,625,000.00 Rogers-O'Brien Construction Company, Ltd. $17,776,000.00 McCarthy Building Companies, Inc. $17,776,236.00 On November 12, 2013, all six Offerors submitted the required Post-Proposal Pre-Award documents. On November 15, 2013 and November 18, 2013, the Best Value Selection Committee met and reviewed the six proposals. The committee members included representatives from the Public Events Department, M[WBE Office, the project's design architect, and Transportation and Public Works Department. The six Offerors were evaluated and ranked as follows-. The bids exceeded the estimated cost as a result of incorrect steel quantities in the original plans. During the course of the discussions, it became clear that the overall project's scope would need to be reduced. The final decision was to proceed only with Project 1 in 2014, the Multi-Purpose Pavilion and delay Project 2, the Tower Drive/Cattle Barn 2/Milking Parlor until 2015 to provide time for complete design, planning and construction. The overall construction cost for the Multi-Purpose Pavilion is expected to be.- Construction (with Alternate Nos, 3 and 4) $4,792,450.00 Utilities, Materials Testing, ITS $ 162,150-00 Contingency, Staff $ 145,400.00 Total $5,100,000.00 The construction amount of $4,792,450.00 is based on the base proposal, Alternate Nos. 3 and 4, Addendum No. 1 structural revisions, and includes an allowance for use by the City only, M/WBE Office - Imperial Construction, Inc., is in compliance with the City's BIDE Ordinance by committing to 13 percent MBE participation on the base bid plus identified alternates. The City's MBE goal for this contract is 13 percent. The project is physically located in COUNCIL DISTRICT 7, but will serve Fort Worth residents in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Public Events Capital Projects Fund.
