HomeMy WebLinkAboutOrdinance 27955-09-2025Ordinance No. 27955-09-2025 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL CAPITAL PROJECTS FUND, IN THE AMOUNT OF $180,108.32, FROM AVAILABLE PROCEEDS FROM CO 2013A WITHIN UNSPECIFIED — ALL FUNDS PROJECT (CITY PROJECT NO. UNSPEC), FOR THE PURPOSE OF FUNDING THE STOP SIX IMPROVEMENTS — RAMEY AVENUE PROJECT (CITY PROJECT NO. 104806); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2024-2025 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Capital Projects Fund, in the amount of $180,108.32, from available Proceeds From CO 2013A within Unspecified — All Funds project (City Project No. UNSPEC), for the purpose of funding the Stop Six Improvements — Ramey Avenue project (City Project No. 104806). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-221) for Stop Six Improvements — Ramey Avenue project in the amount up to $1,128,880.00 with Federal participation in the amount up to $640,000.00, State participation in the amount up to $47,380.00 and City of Fort Worth participation in the amount up to $441,500.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, subject to receipt of the grant, (i) in an amount up to $640,000.00 for Federal participation and (ii) in an amount up to $160,000.00 for City participation, transferred from the General Capital Projects Fund, for the purpose of funding the Stop Six Improvements — Ramey Avenue project (City Project No. 104806); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Capital Projects Fund, in the amount of $180,108.32, from available Proceeds From CO 2013A within Unspecified — All Funds project (City Project No. UNSPEC), for the purpose of funding the Stop Six Improvements — Ramey Avenue project (City Project No. 104806); 4. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the General Capital Projects Fund, by increasing estimated appropriations in the Stop Six Improvements — Ramey Avenue project (City Project No. 104806) in the amount of $552,022.68 and decreasing receipts and appropriations in the Caville/Stop Six Roadway Redev programmable project (City Project No. P00095) by the same amount, for the purpose of converting to a static project;and 5. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $1,128,880.00 with City participation in the amount of $441,500.00 for the Stop Six Improvements —Ramey Avenue project (City Project No. 104806). TxDOT will absorb the additional indirect costs of $47,380.00 for providing statewide support services to this federally funded project. These state indirect costs will not be appropriated in our finance system. The scope of work for the project consists of reconstructing a portion of Ramey Avenue as a context -sensitive roadway including the addition of sidewalks and lighting from South Hughes Avenue to South Edgewood Terrace. The project aims to improve comfort and safety by increasing visibility and separation for pedestrians and encouraging multi -modal mobility uses. This project has federal funding for construction improvements. The project is scheduled for construction in the summer of 2028. The City of Fort Worth is responsible for funding engineering, right-of-way (ROW) acquisition, environmental studies, utility relocations, project management services for this project, and a minimum of twenty percent of the construction cost. This project will be let by City of Fort Worth in winter of 2027. The funding appropriated by this M&C will be used for design, right-of-way acquisition, utilities, project management, and construction of the project. The Advance Funding Agreement (AFA) requires Fort Worth to fund cost overruns. At the end of the project, the asset will remain with the City of Fort Worth. This action is needed as funding for Stop Six Improvements —Ramey Avenue project (City Project No. 104806) is from other sources and the scope of this project differs from that of current programmable project. Funding is budgeted in the General Capital Projects Fund for the Transportation Public Works (TPW) Department to fund the Stop Six Improvements — Ramey Avenue project. Funding for the grant portion of the project was not included in the Fiscal Years 2025-2029 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024. The Business Support Division and Capital Delivery Division will charge salaries to this grant project as incurred. Indirect Cost recovery does not apply. This project is located in COUNCIL DISTRICT 5. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TXDOT FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the General Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund and the General Capital Projects Fund. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to any expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
