HomeMy WebLinkAboutOrdinance 27898-08-2025Ordinance No. 27898-08-2025 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ARPA ITS INITIATIVES PROJECT (CITY PROJECT NO. 103746) IN THE AMOUNT UP TO $300,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MEADOWBROOK GC - MAINT BLD PROJECT (CITY PROJECT NO. 104389) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Grants Capital Projects Federal Fund, by increasing estimated receipts and appropriations in the ARPA ITS Initiatives project (City Project No. 103746) in the amount up to $300,000.00 and decreasing estimated receipts and appropriations in the Meadowbrook GC - Maint BLD project (City Project No. 104389) by the same amount. E•�=MI[a]►14 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Approve the reallocation of American Rescue Plan Act, Subtitle M (Coronavirus State and Local Fiscal Recovery Funds) in the amount of $300,025.00 in support of Infrastructure and Data Protection Initiatives (City Project No. 103746); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount of $25.00, transferred from available funds within the Grants Operating Federal Fund, for the purpose of funding the ITS initiatives project (City Project No. 103746); 3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Grants Capital Projects Federal Fund, by increasing receipts and appropriations in the ARPA ITS Initiatives project (City Project No. 103746) in the amount of $300,000.00 and decreasing receipts and appropriations in the Meadowbrook GC - Maint BLD project (City Project No. 104389) by the same amount and 4. Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The City of Fort Worth received a total American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF) allocation of $173,745,090.00, consisting of $87,024,408.00 to be spent in the areas of Public Health and Negative Economic Impacts (Non -Revenue Recovery), and $86,720,682.00 to assist the City of Fort Worth (City) with the provision of governmental services (Revenue Recovery). Per U.S. Treasury requirements, $173,745,090.00 has been allocated to ARPA eligible initiatives established in Mayor and Council Communication (M&C) 21-0445 on June 22, 2021, and contracts have been executed to obligate funds by the established deadline of December 31, 2024. Current Treasury guidelines allow identified ARPA residual revenue to be reallocated to established ARPA projects to cover shortfalls in funding as a result of unforeseen but necessary expenditures. The Financial Management Services Department (FMS), in coordination with department project managers, has identified residual ARPA Revenue Recovery funds in the following completed or substantially completed ARPA projects: Project MSC Amount Meadowbrook Maintenance Facility 24-0496 $300,000.00 WRMC Mural Project 21-0820 25.00 Total Available for Reallocation $300,025.00 This Mayor and Council Communication (M&C) is to authorize the reallocation of $300,025.00 of ARPA SLFRF Revenue Recovery funds from the Meadowbrook Maintenance Facility and WRMC Mural Project projects to increase the resiliency, capabilities, and delivery efficiency of City of Fort Worth (City) technology services as those items relate to infrastructure and data protection initiatives. The identified Information Technology Solutions (ITS) capital project was initially approved by City Council on May 24, 2022 by M&C 22-0366 after being determined to be a qualified priority by City Management for ARPA funding as approved by the City Council in M&C 21-0445 on June 22, 2021. Upon approval by Council, the requested funds will be allocated to the ARPA for the ITS Initiatives project (City Project No. 103746). Funding for this project was not included in the Fiscal Years (FY) 2025-2029 Capital Improvement Program. The action in this M&C will amend the FY2025-2029 Capital Improvement Program as approved in connection with Ordinance 27107-09-2024. Allocation of ARPA Subtitle M Funding ARPA Section 9901, Subsection 603(c)(1)(C) provides funding to offset government entities' lost revenue as a consequence of the pandemic. Per U.S. Treasury guidelines, all general ARPA funds must be fully obligated by December 31, 2024 and fully expended by December 31, 2026. Prior to any expenditures being incurred, the IT Solutions Department shall be responsible for ensuring funds are available and that only expenditures allowable under the American Rescue Plan Act are charged to the ARPA funding source. Grant funds will be transferred to the Grants Cap Projects Federal Fund for the project on a reimbursement basis.
