A Resolution NO. 6178-10-2025 A RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TO INCREASE THE PROJECT AMOUNT TO $3,150,837.00 WITH FEDERAL PARTICIPATION IN THE AMOUNT OF $2,000,000.00, STATE PARTICIPATION IN THE AMOUNT OF $151,128.00, AND CITY PARTICIPATION IN THE AMOUNT OF $999,709.00 PLUS ANY COST OVERRUNS, FOR THE CONSTRUCTION OF THE OAKLAND-MILLER SAFE STREET PROJECT. WHEREAS, the City of Fort Worth and the Texas Department of Transportation entered into a Local Project Advance Funding Agreement (CSJ 0902- 90-296) ("AFA") (City Secretary Contract No. 61463; Resolution No. 5919-03-2024, M&C 24-0241) on March 26, 2024, for the construction of the Oakland -Miller Safe Street Project; and WHEREAS, it has become necessary to amend the AFA to in order to revise the scope of work and budget by adding CSJ 0902-90-350 to the project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, THAT: The City Manager is authorized to execute Amendment No. 1 to the Advance Funding Agreement with the Texas Department of Transportation (City Secretary No. 61463) to add CSJ 0902-90-350 and increase the project amount to $3,150,837.00 with federal participation in the amount of $2,000,000.00, state participation in the amount of $151,128.00 and city participation in the amount of $999,709.00, plus any cost overruns, for the construction of the Oakland -Miller Safe Street Project. Adopt the attached resolution authorizing execution of Amendment No. 1 to the Advance Funding Agreement with the Texas Department of Transportation (City Secretary Contract No. 61463) for the Oakland Boulevard and Miller Avenue Safe Streets project (City Project No. 104803) to increase the total Advance Funding Agreement amount from $3,131,127.00 to $3,150,837.00 with City participation in the amount of $999,709.00; and 2. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: This Mayor and Council Communication (M&C) is to adopt the attached resolution authorizing execution of Amendment No. 1 to the Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) for the Oakland Boulevard and Miller Avenue Safe Streets project (City Project No. 104803) to increase the total AFA amount from $3,131,127.00 to $3,150,837.00 with City participation in the amount of $999,709.00 plus overruns. The increase is within the state indirect cost and will not be appropriated in the City's finance system. On March 26, 2024, the City Council adopted Resolution No. 5919-03-2024 to authorize execution of the AFA with TxDOT (City Secretary Contract No. 61463, M&C 24-0241). Amendment No. 1 is needed because the project limits extended beyond the original limits on the grant application. The project's scope includes converting existing on -street bike lanes to protected bike lanes, enhancing pavement markings, installing pedestrian hybrid beacon (PHB) signals, modifying traffic signals, adding bike signals, replacing curb ramps, and improving streetlights. The project aims to improve safety by increasing visibility and separation for bicyclists and pedestrians and encouraging equitable mobility facilities. This project will not eliminate the roadway lanes or impact capacity. This AFA amendment No. 1 modifies the agreement to include funding as shown in the table below. The City of Fort Worth will be responsible for the overruns. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08-2022) provides liquidity to support the appropriation. Available resources will be used to make interim progress payments until the debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source by the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). The project is located in COUNCIL DISTRICTS 5, 8 & 11. No salaries will be charged to this grant. Indirect Cost recovery does not apply. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TxDOT FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2022 Bond Program Fund and the Grants Cap Projects Federal Fund for the Oakland Miller Safe Streets project to support the approval of the above recommendations and execution of the amendment. Prior to any expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
