HomeMy WebLinkAbout6184-10-2025 - City Council - ResolutionA Resolution NO.6184-10-2025 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCED FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $926,780.00, OF WHICH FEDERAL PARTICIPATION IS $520,000.00, STATE PARTICIPATION IS $38,898.00 AND CITY OF FORT WORTH PARTICIPATION IS $367,882.00 PLUS ANY COST OVERRUNS FOR CONSTRUCTION OF STOP SIX IMPROVEMENTS — MILLER AVENUE. WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, a Master Agreement between the City of Fort Worth ("Local Government") and the State of Texas acting through the Texas Department of Transportation ("State") has been adopted and states the general terms and conditions for transportation projects developed through this Advance Funding Agreement (AFA); and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 116522 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as context -sensitive streetscape improvements on Miller Avenue from East Rosedale Street to where Windowmere Street would intersect if it connected in Fort Worth, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ4 0902-90-222) in the approximate amount of $926,780.00, with federal participation in the amount of $520,000.00, state participation in the amount of $38,898.00 and local participation in the amount of $367,882.00 plus any cost overruns for engineering and construction of Stop Six Improvements - Miller Ave. Adopted this 28t' day of October 2025 ATTEST: By: �� Jannette S. City of Fort Worth, Texas Mayor and Council Communication DATE: 10/28/25 M&C FILE NUMBER: M&C 25-0975 (REVISED) LOG NAME: 2025 AFA WITH TXDOT FOR STOP SIX IMPROVEMENTS -MILLER AVE - REV SUBJECT (CD 5 and CD 11) Adopt a Resolution Authorizing Execution of an Advance Funding Agreement with the Texas Department of Transportation in the Amount Up to $926,780.00 with Federal Participation in the Amount Up to $520,000.00, State Participation in the Amount Up to $38,898.00, and Local Participation in the Amount Up to $367,882.00, for the Stop Six Improvements — Miller Avenue Project and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-222) for Stop Six Improvements — Miller Avenue project (City Project No. 104805) in the amount up to $926,780.00 with Federal participation in the amount up to $520,000.00, State participation in the amount up to $38,898.00 and City of Fort Worth participation in the amount up to $367,882.00; Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, subject to receipt of the grant, (i) in an amount up to $520,000.00 for Federal participation and (ii) in an amount up to $130,000.00 for City participation, transferred from the 2018 Bond Program Fund, for the purpose of funding the Stop Six Improvements — Miller Avenue project (City Project No. 104805). DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $926,780.00 with City participation in the amount of $367,882.00 for Stop Six Improvements — Miller Avenue Streetscape project (City Project No. 104805). TxDOT will absorb the additional indirect costs of $38,989.00 for providing statewide support services to this federally funded project. These state indirect costs will not be appropriated in our finance system. The scope of work for the project consists of reconstructing a portion of Miller Avenue as a context -sensitive roadway including the addition of sidewalks and lighting from East Rosedale Street to where Windowmere Street would intersect if it connected. The project aims to improve safety by increasing visibility and separation for bicyclists and pedestrians and encouraging multi -modal mobility uses. This project will not impact roadway capacity or reduce any traveling lanes. This project has federal funding for construction improvements. The project is scheduled for construction in the summer of 2028. The City of Fort Worth is responsible for funding engineering, right-of-way (ROW) acquisition, environmental studies, utility relocations, project management services for this project, and a minimum of twenty percent of the construction cost. This project will be let by City of Fort Worth in winter of 2027. The funding appropriated by this Mayor & Council Communication (M&C) will be used for the construction of the project. The AFA requires the City to bear the responsibility of cost overruns. At the end of the project, the asset will remain with the City of Fort Worth. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TXDOT FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Miller Ave Streetscape project within the 2018 Bond Program Fund upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to any expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
