CSC No. 53627-A1 FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 53627 AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH AND TARRANT COUNTY FOR PARTICIPATION IN THE CITY OF FORT WORTH'S DROP-OFF STATION VOUCHER PROGRAM This First Amendment to City Secretary Contract No. 53627 ("First Amendment") is entered into by and between the City of Fort Worth (hereafter "Fort Worth"), a home rule municipality, with its principal place of business at 100 Fort Worth Trail, Fort Worth, Texas, and Tarrant County, Texas ("County"). City and County may be referred to individually as a "parry" and collectively as the "parties." WHEREAS, on March 6, 2019, the Parties entered into an Interlocal Agreement identified as Fort Worth City Secretary Contract 53627 (the "Agreement) for participation in the Fort Worth Drop -Off Station voucher program; and WHEREAS, Fort Worth and County desire to amend the Term of the Agreement; and WHEREAS, Fort Worth and County desire to repeal and replace Exhibit A of the Agreement; NOW THEREFORE, Fort Worth and County, acting herein by and through their duly authorized representatives, agree to amend the Agreement as follows: 1. AMENDMENTS 1. Section 3 "Term" of the Agreement is hereby deleted in its entirety and restated as follows: This Agreement shall be effective from the date the last party has signed this Agreement. This Agreement may be renewed automatically on a yearly basis. Either party may terminate this agreement by providing 45 days' advance notice. Fort Worth shall be compensated for any services provided to Tarrant County and shall provide such services up to the 45th day or as otherwise agreed to and provided in the notice. 2. 2. Exhibit A of the Agreement is hereby repealed and replaced with Attachment 1 to this First Amendment, which is attached hereto and incorporated herein by reference. 3. ALL OTHER TERMS SHALL REMAIN THE SAME OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. 4. WORTH, TX ATTACHMENT 1 EXHIBIT A 1. Purpose: To provide Unincorporated Tarrant County residents with access to the City of Fort Worth Drop-off Stations through pre -issued vouchers. This partnership will allow these residents to dispose of excess solid waste, brush, recyclables, acceptable donations, and other specific materials. 2. Background A. The City of Fort Worth ("City") operates four Drop -Off Stations (DOS) to support waste disposal and diversion for Fort Worth residential and voucher customers. DOS personnel are trained to collect and consolidate brush, bulky waste, recyclable materials, and household hazardous waste (HHW). B. Unincorporated Tarrant County currently has a separate interlocal agreement with the City to properly dispose of its household hazardous waste at the City's Environmental Collection Center. The City's two (2) voucher programs for the City's Drop Off Station and the City's Environmental Collection Center are separate programs and are not combined. C. DOS hours of operation: i. Tuesday- Friday, 8 a.m.- 5 p.m. ii. Saturday, 8 a.m. - 12 p.m. iii. Sunday & Monday: Closed iv. City observed Holidays: 1. Martin Luther King Jr Day 2. Memorial Day 3. Juneteenth 4. Independence Day 5. Labor Day 6. Thanksgiving Day 7. Friday after Thanksgiving 8. Christmas Day 9. New Year's Day 3. Collection Options and Acceptable Items included in the DOS Voucher Program A. Basic Waste (not to exceed 5 cubic yards per voucher): Brush, bulky trash, excess bagged putrescible garbage, mixed items, recyclable materials, small appliances and electronics. B. Limited Special waste (not to exceed 5 cubic yards per vouchers Small home repair and remodel waste, tires (limited to four tires per voucher — rims and tires must be separated), Freon -containing items (limited to three items per visit), and specifically televisions and computer monitors/screens (limited to two items per voucher). 4. Options and Prices for Basic Waste and Limited Special Waste. Material List Pricing (Basic Waste) $19.50 per voucher, not to exceed 5 cubic ards er voucher. Combination Basic Waste and Limited Special $32.50 per voucher for Material List "A" & Waste Limited Special Waste Items Special combined not to exceed 5 cubic yards per voucher. 5. Drop Off Station Guidelines and Requirements A. Residents must present a valid Driver's License and an issued Voucher at the Drop -Off Station check -in station. B. All loads must be covered and secured to prevent loose debris from falling out and becoming litter or causing safety concerns during transit C. Only single -axle trailers up to 8 feet long and 6 feet wide, with a height of 3 feet are allowed. This is approximately 5 cubic yards of waste. D. No vehicles or trailers can be labeled with commercial names or markings, except when renting a truck from U-Haul, Home Depot, or Lowe's for transporting materials. Box Trucks areprohibited. E. Specific items or materials that cannot be accepted: commercial or industrial - based waste, ammunition, hazardous waste as classified by TCEQ, medication, flammable gas cylinders, one (1) pound or greater compressed gas cylinders. 6. DISCUSSION: The Fort Worth's Citizen Drop Off Station Program is now in its 14th year of operation and collecting excessive household bulk items, bagged garbage, brush and storm debris, recyclables, reusable materials (donations), sensitive documents for shredding, household chemical waste and other various items from the residents of Fort Worth. As a 2017-2037 Comprehensive Solid Waste Management Plan Action Item and supported within the 2018 Matrix evaluation, this program was identified as an opportunity for better utilization through interlocal partnerships similar to the Environmental Collection Center agreements. Therefore, City & Tarrant County staff developed the following "voucher -based" partnership program to allow unincorporated Tarrant County residents to participate at each of the four (4) existing centers: Brennan, Southeast (MILK), Old Hemphill and Hillshire. Upon executing the Interlocal Agreement with the City of Fort Worth, unincorporated Tarrant County residents must obtain a Tarrant County issued voucher directly from the Transportation Department and to be submitted during their visit to drop off the allowable materials. Two different vouchers (Type A and Type B) are available based on type and volume of materials the unincorporated residents will be dropping off at the centers. The term for this Agreement will be for the remaining portion of Fiscal Year 2020 beginning upon the execution of the agreement. Tarrant County approved the Agreement on December 10, 2019. Annual renewals may be effective by mutual written agreement and does not require specific City Council approval. For Fiscal Year 2020, the rate per voucher for the period covered by this Agreement is $19.50 per "Type A" and $32.50 per "Type B" vouchers; these rates may be increased or decreased to meet program costs in future fiscal years. It is foreseeable that up to $61,750.00 may be collected annually under this agreement based on an anticipated allocation of vouchers being 60\% "Type A" and 40\% "Type B" for the initial annual limit of 2,500 vouchers. The Agreement outlines the responsibilities of each party, establishes the rates for participation, details procedures and acceptable materials by voucher type, and delineates the usage of service marked public education materials. The City of Fort Worth is responsible for the overall operation of each the Drop Off Stations; including contracting with disposal, recycling & reuse companies for transportation and disposal or processing of all materials collected. The City will evaluate this partnership upon completing the initial year to determine if there are additional benefits to the City and surrounding communities to incorporate additional communities.
