HomeMy WebLinkAbout058714-A2 - Construction-Related - Contract - James DeOtte Engineering, Inc.CSC No. 58714-A2 AMENDMENT No . 2 TO CITY SECRETARY CONTRACT No. 58714 WHEREAS, the City of Fort Worth (CITY) and James DeOtte Engineering, Inc., (ENGINEER) made and entered into City Secretary Contract No. 58714, (the CONTRACT) which was authorized by M&C 22-1008 on the 29th day of November, 2022 in the amount of $ 766,497.00; and WHEREAS, the CONTRACT was subsequently revised by Amendment No. 1 in the amount of $124,511.00 which was authorized by M&C 25-0605 on the 24th day of June 2025; and WHEREAS, the CONTRACT involves engineering services for the following project: 20SWM Cunningham Road HROM, CPN 104018; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $36,794.00. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $927,802.00. 3. The new model is significantly different from the model used for project development and original handoff to James DeOtte Engineering, Inc. (JDEI). Thus, impacting several of the contract task items. Additionally, the USACE requires that the cultural resources investigations be updated and submitted. Due to additional services that are outside the scope of the existing contracted agreements that have been requested by the City to be performed as part of the referenced project, JDEI will perform the work outlined in the following: Additional services shall include: Additional time on the agreement that extends the number of months. Per our 10/29/25 meeting, all Project Management tasks will be as approved by the project executed contract and executed Amendment 1. Invoicing will continue until the overall project completion of the LOMR post construction that per the updated schedule will occur in November 2028. The hourly effort apportioned to this task is the same hours previously used and approved in the original design agreement and Amendment # 1. 2. Revision to the easement parcels due to the updated hydraulic modeling provided by the City. Assumes 6 additional parcels previously prepared and submitted will need to be modified that would be impacted by the updated grading necessary to be Fort Worth design compliant. Revision the cultural resources investigations for additional USACE requirements. Based on the recent communication from Arlo McKee with (USACE) requesting the cultural resources investigations be revisited so that the Report of Investigations will need to be rewritten to include the USACE project number, designating the USACE as the lead agency, discussions about the USACE's APE, and investigations of historic structures. This revised report must be submitted to the USACE for review and comments, then resubmitted to the THC to replace the currently approved THC report. Additionally, the USACE may require a historic structures survey and/or deep mechanical investigations not previously required by the THC. The specific tasks to be accomplished with this Amendment are outlined within the attached Level of Effort spreadsheet. JDEI anticipates the fees listed above for the various elements of the project to be a not to exceed amount of $36,794.00. All costs, associated with the identified scope of work, will be lump sum for the scope provided and will be billed as a percentage of completed work as determined by JDEI. This scope of work assumes any services not specifically listed as part of this contract will be treated as an additional service. The owner will be notified before any additional services are performed.
