BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $120,000.00, transferred from available PayGO funds in the Water and Sewer Fund, for the purpose of funding the Water and Sanitary Sewer Replacement Contract 2021, WSM-A (City Project No. 103498). That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On April 25, 2023, Mayor and Council Communication (M&C) 23-0341, authorized an engineering agreement with TranSystems Corporation d/b/a TranSystems Corporation Consultants. (City Secretary Contract No. 59493) in the amount of $584,832.00 for design of the Water and Sanitary Sewer Replacement Contract 2021, WSM-A project. The agreement was subsequently revised by Amendment No. 1 in the amount of $56,045.00 administratively authorized November 5, 2024 that provided compensation for design of pressure reducing valve, meter near the Long Avenue and Pearl Avenue intersection. The $120,000.00 appropriation requested in this M&C will provide for additional real property acquisition costs to compensate property owners from whom easements must be obtained for construction of the project. This project will have no impact on the Water Department's operating budget when complete. It is the practice of the Water Department to appropriate its Capital Improvement Program plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is currently available in the Transfer to Water/Sewer account of the Water and Sewer Fund for the purpose of funding the Water and Sewer Replacement Contract 2021 WSM-A project.
