HomeMy WebLinkAbout28126-11-2025 - City Council - OrdinanceOrdinance No. AN ORDINANCE REALLOCATING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CITY SECRETARY’S OFFICE OF THE GENERAL FUND BY DECREASING APPROPRIATIONS IN THE GENERAL FUND NON-DEPARTMENTAL CATEGORY IN THE AMOUNT OF $285,000.00,AND INCREASING APPROPRIATIONS FOR THE CITY SECRETARY’S OFFICE BY THE SAME AMOUNT,FOR THE PURPOSE OF COVERING ELECTION COSTS;PROVIDING FOR A SEVERABILITY CLAUSE;MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09- 2024, as amended, is hereby further amended to make the following reallocations to the City Secretary’s Office of the General Fund by decreasing appropriations in the General Fund Non-Departmental category in the amount of $285,000.00, and increasing appropriations for the City Secretary’s Office by the same amount, for the purpose of covering election costs. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize payment to Tarrant County Elections Administration in the additional amount of $9,089.25 for the actual costs of the General Election held on May 3, 2025 for the purpose of electing a Mayor and Council Members for Council Districts 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11, and authorize payment to Tarrant County Elections Administration for the balance due in the amount of $235,174.74 for the Runoff Election held on June 7, 2025 for District 6; and 2. Adopt the attached appropriation ordinance reallocating appropriations in the General Fund by increasing the City Secretary budget by a total of $285,000.00 and reducing the Non -Departmental department in the General Fund by the same amount for the purpose of covering election costs. DISCUSSION: On January 28, 2025, the City Council adopted Ordinance No. 27440-01-2025 calling a General Election for Saturday, May 3, 2025 for the purpose of electing a Mayor and Mayor and Council Members for City Council Districts 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11. The General Election was held and afterwards on June 7, 2025, a Runoff Election was held for the purpose of electing a Council Member for District 6. Tarrant County Elections Administration originally estimated the cost of the General Election at $247,943.00. Council authorized expenditure of that amount plus a 25% contingency for a total authorized expenditure of $309,929.00 in Mayor and Council Communication 25-0295. The final invoice for the May 3, 2025 election amounted to a total amount of $319,018.25 and was received in the City Secretary's Office on September 29, 2025. The final invoice for the June 7,2025 runoff election amounted to a total amount of $235,174.74 and was received in the City Secretary's Office on September 29, 2025. Funding is budgeted in Other Contractual Services account of the City Secretary and Non -Departmental Departments within the General Fund. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Tarrant County FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget, as previously appropriated, in the General Fund to support the approval of the above recommendations and execution of the contract. Prior to any expenditure being incurred, the City Secretary Department has the responsibility to validate the availability of funds.
