HomeMy WebLinkAbout28077-10-2025 - City Council - Ordinance4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 1 of 7 ORDINANCE NO. 28077-10-2025 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 21653, AS AMENDED, CODIFIED AS APPENDIX “A” OF THE CODE OF THE CITY OF FORT WORTH (2015), TO AMEND CHAPTER 4, “DISTRICT REGULATIONS,” ARTICLE 13, “FORM-BASED DISTRICTS,” BY AMENDING SECTION 4.1304, PANTHER ISLAND (“PI”) DISTRICT, TO REVISE THE “PANTHER ISLAND FORM BASED ZONING DISTRICT ZONING STANDARDS AND GUIDELINES” TO CREATE CANAL C- PHASE 1 (“CC-1”) CORE ZONE; TO ESTABLISH DEVELOPMENT STANDARDS FOR THE CC-1 CORE ZONE; TO ESTABLISH THE MINIMUM HEIGHT OF 5 STORIES FOR THE CC-1 CORE ZONE, ESTABLISH THE MAXIMUM HEIGHT OF 15 STORIES, AND ALLOW FOR AN ADMINISTRATIVE APPROVAL OF CERTAIN EXCEPTIONS TO MINIMUM BUILDING HEIGHT REQUIREMENTS; TO AMEND APPENDIX B “MAPS”, EXHIBIT B.17 PANTHER ISLAND DISTRICT TO UPDATE THE DISTRICT’S BOUNDARY AND CORE ZONES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in 2003 the Fort Worth City Council adopted the Trinity River Vision Master Plan as a general guide for the use of land along the Trinity River and its tributaries; and WHEREAS, the Trinity Uptown Plan, released in 2004, proposes an urban lake and a publicly accessible waterfront surrounded by vibrant, mixed-use neighborhoods; and WHEREAS, the City Council adopted Ordinance No. 17273-08-2006 on September 7, 2006, established the Trinity Uptown District (“District”) and adopted development standards and guidelines applicable to certain development projects in the Trinity Uptown area; and WHEREAS, in 2010 the City Council adopted Ordinance No. 19268-08-2010 to revise the number of core zones from seven to nine within the District; revise the development standards and guidelines for the core zones; and 4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 2 of 7 WHEREAS, in May 2014 the project name was changed from Trinity Uptown to Panther Island to recognize the City of Fort Worth’s past as “Panther City”; and WHEREAS, in 2016, the City Council adopted Ordinance No. 22336-08-2016 to amend the standards and guidelines to update the height requirements for certain subdistricts; change the name of the District from “Trinity Uptown” to “Panther Island” and revise the urban design plan and street sections; and WHEREAS, in 2024, the City Council amended the standards and guidelines to increase the maximum building height of the PI-NM core zone to 20 stories and amend related graphics; remove the prohibition against floorplates greater than 16,000 square feet above 96 feet in height for towers; and allow for one-story buildings to be constructed under certain conditions. WHEREAS, based upon recommendations in the Panther Island Strategic Vision Update and to facilitate mixed-used developments along Canal C - Phase 1 from Commerce Street east to the levee, the City, in cooperation with the Tarrant Regional Water District, request that certain properties be rezoned to a new core zone “CC-1” Panther Island- Canal C - Phase 1. WHEREAS, this new core zone proposes a minimum height of 5 floors, a maximum height of 180 feet and 15 floors, and allows certain exceptions to minimum building height requirements. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS AS FOLLOWS: SECTION 1. The “Panther Island Form Based Zoning District Zoning Standards and Guidelines”, as adopted and incorporated into Ordinance No. 21653, the Zoning Ordinance in Chapter 4, “District Regulations”, Article 13 “Form Based Districts,” Section 4.1304, “Panther Island (“PI”) District”, 4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 3 of 7 Subsection 4.1304.D. “Other standards” is hereby amended as set out in Exhibit “A,” attached and hereby incorporated into the Zoning Ordinance by reference to create the Canal C- Phase 1 (“CC- 1”) Core Zone, to adopt the following development standards for the CC-1 core zone: the minimum height of 5 floors, the maximum height of 180 feet and 15 floors, add special use conditions for certain exceptions to minimum building height requirements, and add certain illustrations to illustrate acceptable developments within CC-1 core zone. A copy of the Panther Island Form Based Zoning District Zoning Standards and Guidelines is on file in the City Secretary’s Office and the Development Services Department. SECTION 2. Chapter 4, “District Regulations”, Article 13 “Form Based Districts,” of Ordinance No. 21653, the Zoning Ordinance of the City of Fort Worth, is hereby amended to revise Section 4.1304, “Panther Island (“PI”) District”, Subsection 4.1304 (c)(2) to add the CC-1 core zone boundary description immediately following the Tarrant County College (TCCD) Core Zone boundary description, which shall appear as follows: Canal C- Phase 1 (“CC-1”) BEING 15.404 acres of land located in the ADOLPH GOUHENANT SURVEY, Abstract No. 582, the FELIX G. MULLIKEN SURVEY, Abstract No. 1045, and the MITCHELL BAUGH SURVEY, Abstract No. 106, City of Fort Worth, Tarrant County, Texas. Said 15.404 acres of land being more particularly described by metes and bounds as follows: BEGINNING at a point at the intersection of Northeast 5th Street and North Commerce Street, from which an iron rod found at the Southeast corner of Block 21 bears N 81° 15' 34" W 44.90 feet, and a 5/8" iron rod found at the Southwest corner of Block 20 being located N 20° 41' 20" E 45.21 feet; 4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 4 of 7 THENCE N 59° 59' 19" E 1,032.74 feet, along the centerline of said Northeast 5th Street, to a point at the intersection of the centerline of Northeast 5th Street with the West proposed right-of-way line of Ring Road; THENCE S 26° 18' 46" E 663.91 feet, along the Southwest right-of-way line of proposed Ring Road, to a point at the centerline of Northeast 4th Street; THENCE S 59° 51' 02" W 720.26 feet, along the centerline of said Northeast 4th Street, to a point; THENCE S 59° 57' 21" W 269.19 feet, continuing along the centerline of said Northeast 4th Street, to a point at the intersection of the centerline of Northeast 4th Street and the centerline of North Commerce Street, from which a ½" iron rod found bears N 77° 07' 28" W 47.79 feet; THENCE N 30° 03' 05" W 664.41 feet, along the centerline of North Commerce Street, to the POINT OF BEGINNING containing approximately 15.404 acres (670,987 square feet) of land. SECTION 3. Chapter 4, “District Regulations”, Article 13 “Form Based Districts,” of Ordinance No. 21653, the Zoning Ordinance of the City of Fort Worth, is hereby amended to revise Section 4.1304, “Panther Island (“PI”) District”, Subsection 4.1304 (c)(2) to add the CC-1 core zone to the property development standard table and include the minimum and maximum height, which shall appear as follows.: Panther Island (“PI”) District Front Build-To Range* 80 percent of a building’s front façade must be located within 10 feet of the property line. Waterfront Build-To Range* 80 percent of a building’s front façade must be located no closer than 5 feet and no farther than 15 feet from the property line. Rear Yard* 5 feet minimum Side Yard* None required. SECTION 4. Appendix B: “Maps” of the Comprehensive Zoning Ordinance, Exhibit B.17 Panther Island District, is hereby amended to reflect the updated Panther Island District boundaries and core zones and replaced in its entirety with the Exhibit B.17 Panther Island District attached to this Ordinance. SECTION 5. 4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 6 of 7 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (2015), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7 Any person, firm, or corporation, who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinances No. 3011, 13896, 21653 and any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court 4.1304 - CC-1 - Panther Island Ordinance No. 28077-10-2025 Page 7 of 7 or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 10. All other provisions of the Zoning Ordinance of the City of Fort Worth not herein amended shall remain in full force and effect. SECTION 11.
