HomeMy WebLinkAbout6204-12-2025 - City Council - ResolutionA Resolution NO. 6204-12-2025 A RESOLUTION AUTHORIZING AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $2,405,510.00, OF WHICH FEDERAL PARTICIPATION IS IN THE AMOUNT OF $2,000,000.00, STATE PARTICIPATION IN THE AMOUNT OF $5,510.00, AND CITY OF FORT WORTH PARTICIPATION IN THE AMOUNT OF 400,000 PROVIDED BY TRANSPORTATION DEVELOPMENT CREDITS, FOR THE LTJG BARNETT BRIDGE PROJECT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 116522 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as construction of second bridge at the east entrance to NASJRB. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager, or their designee, is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-335) in the approximate amount of $2,405,510.00, with Federal Participation in the amount of $2,000,000.00, State Participation in the amount of $5,510.00, and Local Participation in the amount of 400,000 provided by Transportation Development Credits, for the LTJG Barnett Bridge project. Adopt the attached resolution authorizing execution of an Advanced Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-335) for LT JG Barnett Bridge Construct project (City Project No. 106110) in the amount up to $2,405,510.00 with Federal Participation in the amount up to $2,000,000.00, State Participation in the amount up to $5,510.00, and City Participation in the amount of 400,000 through available Transportation Development Credits; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, subject to the receipt of the grant, (i) in an amount up to $1,900,000.00, for Federal participation and (ii) $100,000.00 for non -spendable in - kind, for the purpose of funding the LT JG Barnett Bridge Construct project (City Project No. 106110); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project Other Fund, in the amount of 400,000, subject to the receipt of the grant, for the purpose of funding the LT JG Barnett Bridge Construct project (City Project No. 106110); and 4. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of the project is to enhance pedestrian and bicycle mobility and improve vehicular turnaround movements at the Naval Air Station Joint Reserve Base (NASJRB) entrance on the LT JG Barnett Bridge. The project scope includes planning, design, and environmental assessment for a second bridge design option at the east entrance to the NASJRB, to finalize the design scope. The initial payment to TxDOT for the City participation is $0.00. The state indirect costs will not be appropriated in the City's finance system. The City's required local match is being made with Transportation Development Credits (TDCs) in the amount of 400,000, which are appropriated and tracked as a non -spendable item in the Grants Capital Project Other Fund. The action in this Mayor & Council Communication will amend the FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. The Business Support Division and Capital Delivery Division will charge salaries to this grant project as incurred. Indirect Cost recovery does not apply. The project is located in COUNCIL DISTRICT 7. The Transportation and Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
