HomeMy WebLinkAbout6205-12-2025 - City Council - ResolutionA Resolution NO. 6205-12-2025 A RESOLUTION AUTHORIZING EXECUTION OF AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $6,771,682.00 WITH FEDERAL PARTICIPATION IN THE AMOUNT OF $4,870,400.00, STATE PARTICIPATION IN THE AMOUNT OF $322,055.00 AND LOCAL PARTICIPATION IN THE AMOUNT OF $1,579,227.00, FOR CONSTRUCTION TO WIDEN LAS VEGAS TRAIL FROM INTERSTATE HIGHWAY 820 TO APPROXIMATELY QUEBEC DRIVE IN WHITE SETTLEMENT WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 116752 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as reconstruct and widen from two lanes to four lanes with sidewalks, stormwater, and intersection improvements; and WHEREAS, the Cities of White Settlement and Fort Worth identified the need to widen Las Vegas Trail from IH 820 to approximately Quebec Drive with intersection, traffic signal, pedestrian and stormwater channel improvements; and WHEREAS, the City of Fort Worth and Texas Department of Transportation have negotiated terms of an Advance Funding Agreement in the Amount of $6,771,682.00, with federal participation in the amount of $4,870,400.00, state participation in the amount of $322,055.00 and local participation in the amount of $1,579,227.00, plus cost overruns, for construction to widen Las Vegas Trail from two -lanes to four -lanes from Interstate Highway 820 to approximately Quebec Drive. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager, or their designee, is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ: 0902-90-176) in the Amount of $6,771,682.00, with federal participation in the amount of $4,870,400.00, state participation in the amount of $322,055.00 and local participation in the amount of $1,579,227.00, plus cost overruns, for construction to widen Las Vegas Trail from two - lanes to four -lanes from Interstate Highway 820 to approximately Quebec Drive. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-176) in the amount of $6,771,682.00 with Federal participation in the amount of $4,870,400.00, State participation in the amount of $322,055.00, and Local participation in the amount of $1,579,227.00 for the construction to widen Las Vegas Trail from Loop 820 West to Quebec Drive, Las Vegas Trail project (City Project No. 103085), 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation and Public Works Department General Fund, in the amount of $1,419,505.00, from the Fiscal Year 2024 Assigned Fund Balance, for the purpose of transferring to the General Capital Projects Fund for funding the Las Vegas Trail project (City Project No. 103085), 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Capital Projects Fund, in the cumulative amount of $1,419,505.00, transferred from fund balance within the General Fund, for the purpose of funding the Las Vegas Trail project (City Project No. 103085); 4. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund, by increasing estimated receipts and appropriations in the Las Vegas Trail project (City Project No. 103085) in the amount of $680,495.00 and decreasing estimated receipts and appropriations in the Stormwater Hazardous Road Overtopping programmable project (City Project No. P00120) by the same amount, 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, subject to receipt of the grant, (i) in an amount up to $4,870,400.00, for Federal participation and (ii) in an amount up to $1,579,227.00, for City participation, transferred from the General Fund, Fund Balance and the Stormwater Capital Projects Fund with the Stormwater Hazardous Road Overtopping programmable project, for the purpose of funding the Las Vegas Trail from Loop 820 West to Quebec Drive, Las Vegas Trail project (City Project No. 103085); and 6. Amend the Fiscal Year 2026 Adopted Budget and Fiscal Year 202E-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $6,771,682.00 of which the State participation amount is $322,055.00 and City participation in the amount of $1,579,227.00 for the Las Vegas Trail project (City Project No. 103085), and to appropriate funds for construction of the project. TxDOT will absorb the indirect costs of $322,055.00 for providing statewide support services to this project These state indirect costs will not be appropriated in the City's finance system. In 2019, the North Central Texas Council of Governments, TxDOT, and the Cities of Fort Worth and White Settlement met to discuss potential improvements to redesign Las Vegas Trail from Loop 820 West to Quebec Drive, to include reconstructing and widening from 2lanes to 4lanes with sidewalks, intersection and traffic signal improvements. In addition, stormwater crossing improvements to address hazardous roadway overtopping at Las Vegas Trail between Heron Drive and Shoreview Drive were identified. TxDOT is managing and implementing the project, which is within the Cities of Fort Worth and White Settlement The portion of the project within the city limits of Fort Worth will be a City of Fort Worth asset TxDOT executed two separate preliminary engineering and environmental services agreements: one with the City of Fort Worth and one with the City of White Settlement The first AFA with the City of Fort Worth was approved on December 1, 2020 (M&C 20.0875) in an amount of $315,003.00. A second AFA was authorized on October 11, 2022 (M&C 22-0845), allocating $504,004.00 to TxDOT for right-of-way, utilities, final design, and environmental services. This M&C will provide construction phase funding to TxDOT for the project Upon project completion, a Joint Ordinance and Boundary Agreement will be executed with the City of White Settlement to adjust the city limit boundaries so that the roadway project is entirely within the City of White Settlement after execution of the boundary agreement A separate maintenance agreement will assign roadway and traffic signal maintenance to White Settlement, while Fort Worth will maintain stormwater drainage improvements. The stormwater drainage improvements consist of installing a 4-barrel, 7-foot by &foot reinforced concrete box culvert system, approximately 400 feet in length, at the Wildcat Canyon (tributary to Lake Worth) crossing of Las Vegas Trail, between Heron Drive and Shoreview Drive, to improve stormwater conveyance and reduce hazardous roadway overtopping. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09.2025. Due to current market conditions and higher inflation rates, additional funds are needed to cover estimated budget shortfalls. Orly the Business Support Division and Capital Project Division will charge salaries to this grant project as incurred. Indirect Cost recovery does not apply. Funding is available for appropriation in the fund balance of the General Fund. Funding will be budgeted in the General Capital Projects Fund for the Transportation and Public Works for the purpose of funding the project listed above. The Las Vegas Trail project is located with COUNCIL DISTRICT 7. A Form 1295 is not required because This contract will be with a governmental entity, state agency or public institution of higher education: TXDOT FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that funds are currently available in the fund balance within the General Fund and in the SW Hazardous Rd Overtopping programmable project within the General Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, in the Grants Cap Projects Federal Fund, the General Capital Projects Fund, and the Stormwater Capital Projects Fund for the Las Vegas Trail project to support the execution of the contract The Transportation & Pudic Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
