TO CITY SECRETARY CONTRACT No. 52517
WHEREAS, the City of Fort Worth (CITY) and CDM Smith, Inc., (ENGINEER)
made and entered into City Secretary Contract No. 52517, (the CONTRACT)
which was authorized by M&C C-29181 on the 25th day of June, 2019 in the
amount of $ 192,600.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in
the amount of $ 97,448.00 which was administratively authorized on May 29,
2020, Amendment No. 2 in the amount of $141,740.00 which was authorized by
M&C 21-0540 on August 3, 2021; Amendment No. 3 in the amount of $99,500.00
administratively authorized on November 2, 2022, Amendment No. 4 in the
amount of $904,827.00 authorized by M&C 24-0077 on January 23, 2024,
Amendment No.5 in the amount of $99,420.00 administratively authorized on
August 8, 2024; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Westside Water Treatment Plant Expansion, CPN 102052; and
WHEREAS, it has become necessary to execute Amendment No.6 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $234,232.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,769,767.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Subj: Request for Amendment #6 — Plate Settler Expansion Extended Construction Phase
Services, 24-MGD Expansion Chemical PLC Upgrade and RPR Services, and WS-III 16-inch
Pipeline Extension
Dear Mr. Upreti:
CDM Smith was requested to perform construction phase services for the Westside Water Treatment
Plant (WTP) Plate Settler Expansion construction contract. CDM Smith's original Contract included
engineering (office-type) services during construction. Amendment No. 2 added engineering services
during construction related to design items added by Amendment No. 1 and on-site inspection by a
resident project representative (RPR) for an anticipated construction duration of 13 months, which
concluded on November 29, 2022. Amendment No. 3 extended the above construction phase services
by 12 months to November 2023. Amendment No. 4 added design and bidding services and engineering
services during construction for the Westside WTP 20-MGD Re-rating and 24-MGD Expansion.
Amendment No. 5 added design and bidding services for the Westside WTP WS-IV Finished Water
Pipeline Extension. These last two amendments did not add or extend our construction phase services
for the original Westside WTP Plate Settler Expansion.
Due to construction delays generated by the construction contractor and beyond CDM Smith's control,
construction of the Westside WTP Plate Settler Expansion work has continued past the contract
completion date of November 30, 2023 until the present date, and the final completion date will likely
extend to at least September 2025.
When our contract for construction phase services expired at the end of November 2023, we initially
estimated that the extended work would last for a few months and could be absorbed by limiting the
extent of our RPR and other construction support services to only necessary activities. However, given
the significantly extended construction completion schedule, funds allocated in the Contract and
previous amendments to the above construction services were expended as of the end of November
2024. Thus, we respectfully request amendment to our current contract compensation so we can fund
the work that remained after November 2024 when all previously authorized funds became depleted.
Further, in relation to the Amendment No. 4 worl< (Westside WTP 24-MGD Expansion), Westside WTP
personnel requested that the exiting Programmable Logic Controller (PLC) at the Westside WTP
Chemical Building be upgraded as it is nearly obsolete due to its long service life. This PLC work was not
originally included in the Amendment No. 4 scope of work as part of the 24-MGD plant expansion

efforts, so it needs to be captured by a new amendment. A copy of e-mail correspondence where
operations personnel instructed CDM Smith to upgrade the above PLC is attached for documentation.
For the Amendment No. 4 project, the CITY has also requested that part-time resident project
representative (RPR) services by the ENGINEER be included for the duration of construction anticipated
in the project's bid documents (560 days), so the present amendment captures these added services.
In addition to the above work, the City recently requested that CDM Smith include in the worl< of the
previously approved Amendment No. 5 a second pipeline (i.e., a 16-inch pipeline that branches from the
existing WS-III pressure plane discharge pipeline towards the southwest corner of the WTP site). A copy
of e-mail correspondence that documents the City's request for this work to be included in the present
amendment is attached to this letter.
The attached scope of work provides a more detailed explanation of the Westside WTP Plate Settler
Expansion construction phase services that remained to be delivered after November 2024. Also
attached is our fee proposal table developed for the above scope of work. This fee includes anticipated
hours and travel expenses for CDM Smith personnel from December 2024 through March 2024. While
completion of the Plate Settler Expansion construction has gone beyond the above latter date and was
still ongoing as of the time this letter was submitted, the initial draft of this request submitted to the
City for review earlier this year (January 2025) anticipated that final construction completion would
occur by March 2024 and we have maintained the same assumption for this updated version of our
request to simplify this second review round given that the bulk of the anticipated remaining work
occurred during that period. Please note that our attached level of effort does not simply include
needed hours and expenses to extend our construction administration assistance services for four
months (i.e., additional construction progress meetings, invoicing, contractor follow-ups), but it includes
all construction services work that was pending after we run out of funds in November 2024 given that
those funds had to be utilized to cover a year of extended work after our construction services
agreement expired per Amendment No. 3.
The attached scope of work and fee proposal also include anticipated hours and expenses for CDM
Smith and Gupta and Associates, Inc. (GAI), who is performing the Electrical and Instrumentation &
Control work, for completion of the requested Chemical Building PLC upgrades, for the Westside WTP
24-MGD Expansion RPR services during construction, and for the recently requested WS-III 16-inch
Pipeline Extension. Please note that the proposed scope of work for the pipeline extension was
previously reviewed and accepted by the City (Matt Kusnir, Sr. Capital Projects Office, W/WW Planning
and Asset Management), as shown on the attached e-mail correspondence.
The requested fee for base services is $ 234,232.
