The ontractor has also requested an extension of the substantial and final completion dates. The contractual substantial completion date was November 1, 2023. The City will accept an early substantial com letion date based on when the lift station was started up on July 31, 20Z4 (273 days after contractual subs�antial completion). The contractual final completion date was January 1, 2�024. Provided that the Contractor provides outstandin O&M manuals and spare parts as part of warrant requirements, the City is willing to extend the fina� completion date and waive liquidated damages. �or purposes of the equipment warranty, the City will establish the equipment warranty date as August 15, 2025. The extended time period for completion has resulted in additional costs to the City, including a substantial settlement to the Biosolids vendor and $56,000 for additional third party construction management. In lieu of �I'guidated dama es and in order to compensate the City for actual costs incurred, the Contractor will provide a 329,000 CREDI�to the City. As part of this Change Order No. 3, the City agrees to accept the CREDIT, agrees to extend the Substantial Completion Date to July 31, 2024, establishes an equipment warranty date of August 15, 2025, and waives liquidated damages for late delivery. It is anticipated a final payment request will be submitted by the Contractor following approval of this Change Order. It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full (both time and money) for all costs arising out of, or incidental to, the above Change Order. The fine screen channel walls are not plumb and the width of the channel varies from 60.125" to 59.25". The fine screen was manufactured with and unit width of 58.375" however the bolt-to-bolt width is 60" and therefore the screen is too wide. Additionally, there are overhead concrete beams that Crescent had to clear to install and which caused damage to the roughly top 5- ft of the t-lock liner when Crescent tried to install the screen. The City has agreed to pay a shared cost $20,000 for Crescent to modify the fine screen channel walls and lining to allow installation of the fine scree. There are no additional calendar days requested. CDM Smith has reviewed the price proposal and is of the opinion that the cost is fair and reasonable. CDM Smith recommends the City accept this cost and issue a Change Order in the amount of $20,000. Please advise if the Water Department desires this CMR-12.2 be incorporated into a Change Order.
