Fort Wortk�, T.exas a�d.�he City of Haslet, '�'exas ("Agreement") on Novernbear 16, 2010, �led wit�i Far� Worth's City Secreta�y as City Secreiary Contract Number 41908; and WHEREA,S, Exhibit "A" to the Agreement ("�riginal Exhibit A") showed the area in which Custo7ner could retail water service to its customers as we11 as the points of delivery af wl�olesale water by Fort Worth to C�istomer; and ��-IEItEA,S, after the Parties exec�,ited the A�reement, the Texas Public Utility Commissian af Texas {"I'UCT") adjusted the ar�a governed by Cusiomex's Certxficate oi Conv�niance and Necessity ("CCN") to include a 95 acre i�act which is not within the Custamer's Service Area ("95 Acre Tract"}; and WH�I2EAS, Article 12.1 oF the Agreernent states "Custarner agrees it will not share Facilities for water system use with any atXaer �a�ernmental or corporat� entity ouiside af CustQmer's Service Area v�rithout lhe express written cansent of Fort Worth, which cansent shali not be ur�reasonably withheld"; and W�IERE�5, Fort Worth has no objectian to Customer providing retail vvater sezvice to the 9S Acre Tract located within rhe CCN; and �V��ER.EAS, the Paxties �eek to a�end tlie A�reement to confarm the Customer's Service Area map with the CCN map by substituting a Exh�bit A�or th� Original Exhibit A; 1'�OW TI��REFORE, for and in consideration of tlie mu�,ial covenants, promis�s and agreements contained herein, the s�tf�iciency of which are hereby acknowledged, Fart Worth and Custornsr hereby agree to amend the Agt'eement as follows: OFFICIAL RECORD CITY SECRETARY FT.
