TO CITY SECRETARY CONTRACT No. 59361
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 59361,
(the CONTRACT) which was administratively authorized on the 9t�' day of May,
2023 in the amount of $ 97,594.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $716, 095. 00 which was authorized by M&C 23-0638 on August
Sth, 2023; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Long Avenue Pedestrian Safety Improvements Project CPN 104299; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $49,955.00. (See Attached Funding
Breakdown Sheet, Page
-4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for
all work and services shall be an ar�ount of $863, 644. 00. OFFICIALRECORD

Scope for Enqineerinq Desian Related Services for
Lonq Avenue Pedestrian Safetv Improvements Proiect
The scope set forth herein defines the work to be performed by the ENGINEER in completing
the project. Both the CITY and ENGINEER have attempted to clearly define the work to be
performed and address the needs of the Project.
OBJECTIVE
The objective for this Amendment is to prepare landscape and irrigation construction plans for
the updated median areas along Long Avenue per the landscape exhibit submitted to the
CITY on June 2025. The Long Avenue conceptual landscape exhibit from this report is
attached for reference.
• Install landscape per plans along the medians from Azle Avenue to 35t" Street.
• Install Irrigation per plans along the medians from Azle Avenue to 35th Street.

TASK 12. LANDSCAPE AND IRRIGATION CONSTRUCTION DUMNETS.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.
12.1 Design Management:
• Lead, manage and direct design team activities.
• Ensure Quality Control / Quality Assurance (QC/QA) is practiced in performance
of the work. Refer to Tasks 12.4 and 12.5 for further details.
• Communicate internally among team members.
• Task and allocate team resources.
12.2 Landscape and Irrigation Design (90%)
ENGINEER will develop the preliminary design of the infrastructure as follows.
12.2.1 Landscape Plans and Details
Develop Landscape Plans and Details for the medians showings new plant
material locations as they relate to the medians.
• Develop planting schedule specifying recommended plant species and details
illustrating recommended installation methods and requirements.
12.2.2 Irrigation Plans and Details
• Develop Irrigation Plans and Details forthe proposed landscape improvements
showing head layout, pipe sizing and controller/valve locations and standard
details.
• Plans will show sufficient detail for construction and will be prepared to conform
to published City requirements.
12.2.3 Standards
• Compile applicable City standard details necessary for design; City standard
details may be modified as needed.
12.2.4 OPCC
• Develop opinion of probable construction costs (OPCC). This estimate shall be
standard CITY of TxDOT bid items, as applicable.
• The ENGINEER has no control over the cost of labor, materials, equipment, or
over the Contractor's methods of determining prices or over competitive
bidding or market conditions.

Opinions of probable construction costs provided herein are based on the
information known to ENGINEER at this time and represent only the
ENGINEER's judgment as a design professional familiar with the construction
industry.
• The ENGINEER cannot and does not guarantee that proposals, bids, or actual
construction costs will not vary from its opinions of probable costs.
12.3 Final Design (100%)
ENGINEER will develop final design of infrastructure as follows:
• Following 90% comment review meeting with CITY, the ENGINEER shall submit
Final Design Plans (100%) to the CITY. Each plan sheet shall be stamped, dated,
and signed by the ENGINEER registered in State of Texas.
• The ENGINEER shall submit an opinion of probable construction cost with both
the 90°/o and 100% design packages.
12.4 QA/QC and Review (90%)
• ENGINEER shall perform Quality Assurance / Quality Control (QA/QC) review of all
documents being submitted for review for the 90% design review submittal. QA should
be performed by an individual within the firm who is not on the design team.
12.5 QA/QC and Review (100%)
• ENGINEER shall perform Quality Assurance / Quality Control (QA/QC) review of all
documents being submitted for review for the 100% Final Document design review
submittal. QA should be performed by an individual within the firm who is not on the
design team.
12.6 CCA Support for Landscape and Irrigation
ENGINEER will support the construction phase of the project as follows:
• The ENGINEER shall attend two additional construction progress meetings during
the duration of construction. The ENGINEER will prepare of collaborate with the
CITY PM on a Construction Progress Report using the CITY's standard format and
upload to eBuilder.
The ENGINEER shall review two additional shop drawings, samples and other
submittals submitted by the contractor for general conformance with the design
concepts and general compliance requirements of the contract for construction.
Such review shall not relieve the Contractor from its responsibility for performance in
accordance with the contract for construction, nor is such review a guarantee that
the work covered by the shop drawings, samples and submittals is free of errors,
inconsistencies, or omissions. The ENGINEER shall log and track all shop drawings,
samples, and other submittals to eBuilder.
ASSUMPTIONS
• One (1) digital 11" x 17" PDF to be submitted to the CITY for comment review.
• Address one (1) round of 90% CITY comments.

• Three (3) plan review meetings.

ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES
Additional Services not included in the existinq Scope of Services — CITY and
ENGINEER agree that the following services are beyond the Scope of Services described in
the tasks above. However, ENGINEER can provide these services, if needed, upon the
CITY's written request. Any additional amounts paid to the ENGINEER as a result of any
material change to the Scope of the Project shall be agreed upon in writing by both parties
before the services are performed. These additional services include the following:
• Additional bid phases and bid packages.
• Negotiation of easements or property acquisition.
• Services related to development of the CITY's project financing and/or budget.
• Services related to disputes over pre-qualification, bid protests, bid rejection and re-
bidding of the contract for construction.
• Construction management services.
• Services necessary due to the default of the Contractor.
• Services related to damages caused by fire, flood, earthquake, or other acts of God.
• Services related to warranty claims, enforcement, and inspection after final completion.
• Services to support, prepare, document, bring, defend, or assist in litigation undertaken
or defended by the CITY.
• PerFormance of miscellaneous and supplemental services related to the project as
requested by the CITY.

Lump Sum Project
Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $49,955.00 as
summarized in Exhibit B-1 — Engineer Invoice and Section IV — Summary of Total
Project Fees. The total lump sum fee shall be considered full compensation for
the services described in Attachment A, including all labor materials, supplies, and
equipment necessary to deliver the services.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
II. Method of Payment
A. Partial payment shall be made to the ENGINEER monthly upon City's approval of
an invoice prepared and submitted by the ENGINEER in the format and including
content as presented in Exhibit B-1, Progress Reports as required in item III. of
this Attachment B, and Schedule as required in Attachment D to this Agreement.
B. The estimated current physical percent complete as required on the invoice shall
be calculated from the progress schedule as required in Attachment D to this
Standard Agreement and according to the current version of the City of Fort
Worth's Schedule Guidance Document.
C. The cumulative sum of such monthly partial fee payments shall not exceed the
total current project budget including all approved Amendments.
D. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department monthly progress reports and
schedules in the format required by the City.

Amendment Purpose Statement:
The purpose of this engineering amendment is to provide additional design services to
account for landscape and irrigation plan development which has been incorporated into
the project at the request of the City after the final plans are approved. This effort includes
designing the tree planting plan for the medians along Long Ave within the project limits.
The amendment also includes designing irrigation systems for these medians.
The effort also includes resources to provide additional coordination with City departments
and construction phase services to coordinate with the City and contractor for this
landscape and irrigation component of this project.
The detailed scope and level of effort is attached with this amendment. The scope and
level of effort have been reviewed and agreed upon by the City staff prior to submittal of
this amendment.
