AMENDMENT No . 6
TO CITY SECRETARY CONTRACT No. 49555
WHEREAS, the City of Fort Worth (CITY) and HDR Engineering, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 49555, (the
CONTRACT) which was authorized M&C C-28288 on the 20th day of June, 2017 in
the amount of S 400,000.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1
in the amount of $ 843,000.00 which was authorized by M&C # C-28764 on June
26, 2018, Amendment Number 2 in the amount of $ 1,746,516.00 which was
authorized by M&C # 21-0206 on March 23, 2021, Amendment Number 3 in the
amount of $ 61,952.00 which was authorized administratively on August 15,
2023, Amendment Number 4 in the amount of $ 382,936.00 which was authorized
by M&C # 24-0275 on April 9, 2024, Amendment Number 5 in the amount of $
99,944.00 which was administratively authorized on January 31, 2025; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Avondale-Haslet Road, CPN 101014; and
WHEREAS, it has become necessary to execute Amendment No. 6 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $144,250.00. (See Attached Funding Breakdown Sheet,
Page -4-)
2.
Article II of the CONTRACT is amended to provide for an increase in
City of Fort Worth, Texas Avondale-Haslet Road

the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $3,678,598.00.

herein, shall remain in full force and effect.

Scope for Enaineerina Desian Related Services for Arterial Improvements
Amendment No. 6
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be perFormed and address the needs of the Project.
OBJECTIVE
The objective of this amendment is to modify the scope of Design Engineering Services for
Avondale Haslet Road to incorporate additional design changes, utility coordination,
drainage changes, and water and sanitary sewer relocations.
Project limits are: from Charlotte Ann Lane to West of Haslet County Line Road (�5, 280 feet
east of Sendera Ranch Blvd.) project length = 2.4 miles. Work under this agreement
includes, but is not limited to, project management, final design, and water and sanitary
sewer design.

NANCE RANCH PLANS MODIFICATIONS
The ENGINEER shall modify plans to accommodate a new cross street T-intersection with
Avondale Haslet Road near roadway station 87+00 within the Nance Ranch property.
Wagley Robertson Road is the apparent cross street name to the south Avondale Haslet
Road, and the intersection improvements shall include a median opening, an added
eastbound right turn and westbound left turn deceleration lanes along Avondale Haslet
Road, as well as drainage, illumination, signing and striping, and erosion control. The new
intersection shall include a new T-intersection signal design along with sidewalk and curb
ramp adjustments.

• Roadway Modifications
o Intersection improvements shall include median opening at new cross street near sta

Assumptions for Roadway Modifications
o New Wagley Robertson Road cross street design shall not extend more than 200' to
the south of Avondale Haslet Road.
o Right Of Way for the turn lane widenings along Avondale Haslet Road and along
new Wagley Robertson Road shall be sufficient for the roadway modifications and
coordinated between the CITY and the Developer.
o Roadway survey is not included with this contract. If recent construction or new or
recent ground improvements have been made, the CITY shall provide the
ENGINEER with a survey of the affected area.
o Any roadway or other changes beyond the limits of the mentioned modifications
areas shall not be included in this contract.

• Retaining Wall

Compensation
A. The ENGINEER shall be compensated for personnel time, non-labor expenses,
and subcontract expenses in performing services enumerated in Attachment A as
follows:
i. Personnel Time. Personnel time shall be compensated based upon hours
worked directly in performing the PROJECT multiplied by the appropriate Labor

Expenses at invoice or internal office cost.

expenses associated with delivery of the work; plus applicable sales, use, value
added, business transfer, gross receipts, or other similar taxes.

COMPENSATION
iii. Subcontract Expenses. Subcontract expenses and outside services shall be
reimbursed at cost to ENGINEER plus a markup of ten percent (10%).
iv. Budgets. ENGINEER will make reasonable efforts to complete the work within
the budget and will keep the City informed of progress toward that end so that
the budget or work effort can be adjusted if found necessary.
ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be
adjusted, nor is the City obligated to pay ENGINEER beyond these limits.
If ENGINEER projects, in the course of providing the necessary services, that the
PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether
by change in scope of the project, increased costs or other conditions, the
ENGINEER shall immediately report such fact to the City and, if so instructed by the
City, shall suspend all work hereunder.
When any budget has been increased, ENGINEER's excess costs expended prior
to such increase will be allowable to the same extent as if such costs had been
incurred after the approved increase.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
Method of Payment
A. The ENGINEER shall be paid by the City based upon an invoice created on the
basis of statements prepared from the books and records of account of the
ENGINEER, based on the actual hours and costs expended by the ENGINEER in
performing the work.
B. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
C. ENGINEER shall prepare and submit invoices in the format and including content
as presented in Exhibit B-1.
D. Payment of invoices will be subject to certification by the City that such work has
been performed.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department monthly progress reports and
schedules in the format required by the City.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a Developer Funding Agreement in the amount of $1,129,570.00 with Beaten Path Development, LLC for the purpose
of design and construction of intersection improvements at Avondale Haslet Road and Wagley Robertson Road project (City Project No.
101014);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Developer Contribution Fund, in the
amount of $1,129,570.00, from future revenues within Developer Cash Contributions, for the purpose of funding the design and construction
of finro future intersections on Avondale Haslet Road project (City Project No. 101014);
3. Authorize execution of Amendment No. 6 to City Secretary Contract No. 49555, an engineering agreement with HDR Engineering, Inc., in the
amount of $144,250.00 for engineering services for the design of Avondale Haslet Road project, for a revised contract amount of
$3,678,598.00 (City Project Number 101014); and
4. Amend the Fiscal Years 2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor & Council Communication (M&C) is to appropriate eligible Future Improvement Agreement funding from Beaten Path
Development LLC, in the amount of $1,129,570,00 forthe Avondale Haslet Road project. The developer has requested that the City modify its
Avondale Haslet Road design and construct roadway modifications for the future Avondale Haslet Road and Wagley Robertson Road intersection
as part of the City project, to avoid damaging Avondale Haslet Road after construction.
The improvements include the future Wagley Robertson intersection and turn lane improvements at the future Newcomer Way. These
improvements are estimated to cost as follows: Design Cost -$90,000.00; Construction Cost -$797,490.00. The full amount of $887,490.00 is
being collected from the developer via a Developer Funding Agreement. Per the agreement, upon final accounting of actual costs, if any additional
amount is owed for design or construction, the developer shall remit it to the City. If any credit or refund is owed to the developer, the City shall remit
to the developer.
In addition, a traffic signal will be required at the future Wagley Robertson/Newcomer Way intersection. The developer is only responsible for 36%
of the traffic signal's cost in accordance with development proportionality policies. The developer will make a one-time payment of $242,080.00 for
their share of the design and construction of the traffic signal. Funding in the amount of $335,440.00 for the balance of the signal design and
construction cost will be provided by the Avondale Haslet project. If there is a default, there are funds available in the 2018 and 2022 Bond
Program Funds.
This M&C will authorize execution of Amendment No. 6 to the engineering and services agreement with HDR Engineering, Inc., in an amount of
$144,250.00 for the engineering services associated with this Developer Funding Agreement and additional subsurFace utility services to help with
franchise utility relocation.

Funding for these intersection improvements in the project was not included in the FY2026-2030 Capital Improvement Program because the
developer proposed these improvements to the City after the project scope was finalized. The action in this M&C will amend the FY2026-2030
Capital Improvement Program as approved in connection with Ordinance 27979-09-2025.
This project is included in the 2022 Bond Program. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08-2022)
provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until the debt is
issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement
expressing official intent to reimburse, that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022).
The project is located in COUNCIL DISTRICT 10.

The Director of Finance certifies that upon approval of the above recommendations, execution of the contract, and adoption of the attached
appropriation ordinances, funds will be deposited into the Developer Contribution Fund as appropriated. The Transportation and Public Works
Department (and Financial Management Services) is responsible for the collection and deposit of funds due to the City. Prior to any expense
being incurred, the Transportation and Public Works Department also has the responsibility to validate the availability of funds.
