A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS, the Fort Worth City Council on December 9, 2025, in M&C 25-1169, ordered and
decreed that a public necessity existed to acquire 2.174 acres of land in Permanent Sewer Easement and
approximately 2.524 acres for a Temporary Construction Easement from Real Property Owned by the
Lago Cantera LLC., Located at 4905 Corriente Lane, in the T.G. Zachary Survey, ABST. No. 1759 &
F.M. Wales Survey ABST. No. 1637, City of Benbrook, Tarrant County, Texas, as described in the
exhibits attached to the above-referenced M&C; those exhibits are incorporated herein for all purposes
(the “Property”);
WHEREAS, the Fort Worth City Council has determined that:
- the Property is needed for Mary’s Creek Force Main (the “Project”);
- the land rights in the Property are needed to transport wastewater to the future Mary’s Creek
reclamation facility;
- public necessity required the acquisition by condemnation of the Property, located within the
alignment of the Project;
- the use of the Property will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Property needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owners, Lago Cantera
LLC, were unsuccessful due to inability to negotiate agreeable terms for the property interest being
acquired by the City of Fort Worth; and
WHEREAS, on this 9th day of December 2025, at a regular meeting of the Fort Worth City
Council, upon Motion of Councilmember Crain, to wit:
“I move that the Fort Worth City Council adopt the resolution authorizing use of the power of eminent domain to acquire
2.174 acres in Permanent Sewer Easement and approximately 2.524 acres for a Temporary Construction Easement
interest from real property owned by Lago Cantera LLC. The subject property is located at 4905 Corriente Lane,
in the T.G. Zachary Survey, Abstract. No. 1759 & F.M. Wales Survey Abstract. No. 1637, City of Benbrook,
Tarrant County, Texas. The land rights in the subject property are needed for the Mary's Creek Force Main, a
public use that provides for transporting wastewater to the future Mary's Creek Water Reclamation Facility
in order to treat wastewater produced in the rapidly developing western part of the City.
The property interest to be acquired is described by metes and bounds and depicted by survey exhibits
attached to this Mayor and Council Communication.
Seconded by Councilmember Hill, duly put and carried: RESOLUTION.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Property for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed, to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interest listed above and attached to the M&C.

conveyed to Lago Cantera, LLC, as recorded in Instrument No. D222004798 of said Official Public
Records of Tarrant County, Texas, said 20-Foot Wide Permanent Access Easement being more
particularly described by metes and bounds as follows:
COMMENCING at a 1/2 inch iron rod with cap stamped “LANDCON INC” found for the southeast
corner of a called 79.854 acre tract of land conveyed to W. Michael Greene, Trustee, as recorded
in Instrument No. D224102894 of said Official Public Records, the most northerly northeast corner
of Block 4 of Reata Place at Team Ranch, an addition to the City of Fort Worth as recorded in
Cabinet A, Slide 5342 of the Plat Records of Tarrant County, Texas, said 1/2 inch iron rod with
cap stamped “LANDCON INC” being in the west line of said Lot A, from which a 5/8 inch iron rod
found for the southwest corner of said called 79.854 acre tract of land, the northwest corner of
Block One of Team Ranch Addition, an addition to the City of Fort Worth as recorded in Volume
388-209, Page 48 of said Plat Records of Tarrant County, Texas, bears North 89 degrees 51
minutes 05 seconds West, a distance of 1,376.99 feet, said 5/8 inch iron rod found being in the
northeast line of Loop 820 (variable width right-of-way); THENCE North 00 degrees 22 minutes
32 seconds West, with the east line of said called 79.854 acre tract of land and the west line of
said Lot A, a distance of 525.91 feet to a calculated point for the POINT OF BEGINNING, said
calculated point having a grid coordinate of N=6,941,655.715 and E=2,285,683.584;
THENCE North 00 degrees 22 minutes 31 seconds West, a distance of 23.30 feet to a calculated
point for corner for the beginning of a curve to the right having a radius of 121.23 feet, a delta of
38 degrees 48 minutes 29 seconds, and whose chord bears North 81 degrees 07 minutes 53
seconds East, a chord distance of 80.55 feet;
THENCE Northeasterly, with said curve to the right, an arc distance of 82.11 feet to a calculated

Benbrook, Tarrant County, Texas, for the Mary's Creek Force Main Project
RECOMMENDATION:
It is recommended that the City Council:
1. Declare that negotiations between the City and the property owner to acquire 2.174 acres permanent easement and approximately
2.524 acres for a temporary construction easement interest from real property owned by Lago Cantera LLC., Located at 4905 Corriente
Lane, Benbrook, Tarrant County, Texas in the T.G. Zachary Survey, Abstract. No. 1759 & F.M. Wales Survey ABST. No. 1637, City of
Benbrook, Tarrant County, Texas, were unsuccessful due to the inability to negotiate agreeable terms for the property interest being acquired
by the City;
2. Declare the necessity to acquire the described property interest for the Mary's Creek Force Main project (City Project No. 103648);
3. Adopt the attached resolution authorizing the City to use its power of eminent domain to acquire the property for public use;
4. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interest from the
property owner;
5. Authorize a payment pursuant to an award of commissioners or a negotiated settlement; and
6. Authorize the City Manager or his designee to accept and record the appropriate instruments.
DISCUSSION:
The purpose of this Mayor and City Council Communication (M&C) is to recommend that the City Council authorize the condemnation of land for
the Mary's Creek Force Main project, (City Project No. 103648).
The project will transport wastewater to the future Mary's Creek Water Reclamation Facility in order to treat wastewater produced in the rapidly
developing western part for the City and source high -quality reclaimed water for future businesses and industries in the area.
An independent appraisal established the property's fair market value of the Permanent Sewer easement and Temporary Construction Easement
Acquisition in the total amount of $213,200.00. Negotiations were unsuccessful due to the inability to negotiate agreeable terms for the property
interest being acquired by the City.
Upon approval, a condemnation action will be brought and a Special Commissioner's hearing held to acquire the Permanent Sewer Easement
and Temporary Construction Easement Interest on the property.

To approve this M&C, the Council Member making a motion to authorize condemnation by eminent domain should say:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of eminent domain to acquire 2.174 acres of land in
Permanent Easement and approximately 2.524 acres for a Temporary Easement Acquisition from real property owned by Lago Cantera LLC. The
subject property is located at 4905 Corriente Lane, in the T.G. Zachary Survey, Abstract. No. 1759 & F.M. Wales Survey Abstract. No. 1637, City of
Benbrook, Tarrant County, Texas. The land rights in the subject property are needed for the Mary's Creek Force Main, a public use that provides for
transporting wastewater to the future Mary's Creek Water Reclamation Facility in order to treat wastewater produced in the rapidly developing
western part of the City. The property interest to be acquired is described by metes and bounds and depicted by survey exhibits attached to this
Mayor and Council Communication."
Funding is budgeted in the Water & Sewer Bond 2017A Fund for the Water Department for the purpose of funding the MC LS Site & FM Align
project, as appropriated.
This property is located in Benbrook near COUNCIL DISTRICT 3.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Water & Sewer Bond
2017A Fund for the MC LS Site & FM Align project to support approval of the above recommendations and acquisition of easements. Prior to any
expenditure being incurred, the Property Management and Transportation and Public Works Departments have the responsibility to validate the
availability of funds.
