HomeMy WebLinkAbout6230-01-2026 - City Council - ResolutionA RESOLUTION NO. 6230-01-2026 A RESOLUTION AUTHORIZING AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION IN THE AMOUNT OF $1,060,892.00, OF WHICH FEDERAL PARTICIPATION IS $734,897.00, STATE PARTICIPATION IS $201,495.00 AND CITY OF FORT WORTH PARTICIPATION IS $201,495.00 AND CITY OF FORT WORTH PARTICIPATION IS $124,500.00 FOR CONSTRUCTION OF THE INTERSECTION IMPROVEMENTS AT BUSINESS 287 (NORTH MAIN STREET) AND 29TH STREET. WHEREAS, federal law establishes federally funded programs for transportation improvements to implement its public purposes, and WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall design, construct and operate a system of highways in cooperation with local governments, and Section 222.052 authorizes the Texas Transportation Commission to accept contributions from political subdivisions for development and construction of public roads and the state highway system within the political subdivision, and WHEREAS, a Master Agreement between the City of Fort Worth ("Local Government") and the State of Texas acting through the Texas Department of Transportation ("State") has been adopted and states the general terms and conditions for transportation projects developed through this Advance Funding Agreement (AFA); and WHEREAS, federal and state laws require local governments to meet certain contract standards relating to the management and administration of State and federal funds, and WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56 that describe federal, state, and local responsibilities for cost participation in highway improvement and other transportation projects, and WHEREAS, the Texas Transportation Commission passed Minute Order Number 116522 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as traffic signal improvements at the intersection of Business 287 (North Main Street) and 29th Street in Fort Worth, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The City Manager, or their designee, is hereby authorized to execute an Advance Funding Agreement with the Texas Department of Transportation (CSJ4 0014-01-032) in the approximate amount of $1,060,892.00, with federal participation in the amount of $734,897.00, state participation in the amount of $201,495.00, plus any cost overruns for construction, and local participation in the amount of $124,500.00 for construction of the intersection improvements at Business 287 (North Main Street) and 29th Street. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0014-01-032) for the intersection improvements at Business 287 (North Main Street) and 29th Street project (City Project No. 106608) in the amount Up to $1,060,892.00 with Federal participation in the amount Up to $734,897.00, State participation in the amount Up to $201,495.00 and Local participation in the amount of $124,500.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount up to $734,897.00, subject to receipt of the grant, for the purpose of funding the Business 287 (North Main Street) and 29th Street project (City Project No. 106608); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Project State Fund, in the amount up to $151,713.00, subject to receipt of the grant, for the purpose of funding the Business 287 (North Main Street) and 29th Street project (City Project No. 106608); 4. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund, by increasing estimated appropriations in the Business 287 (North Main Street) and 29th Street project (City Project No. 106608) in the amount of $124,500.00, and decreasing appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount; and 5. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $1,060,892.00, with City participation in the amount of $124,500.00 for the intersection improvements at the Business 287 (North Main Street) and 29th Street project (City Project No. 106608). The project intends to create a cost-effective solution to improve the efficiency of traffic flow while increasing the visibility and safety. The scope of work for the project consists of installing traffic and pedestrian signals, providing safety lighting at the intersection, refreshing pavement markings, and installing pedestrian crosswalks to comply with the Americans with Disabilities Act (ADA) regulations. TxDOT will be responsible for the construction of the project. This project is expected to be let by TxDOT in May 2027. TxDOT is responsible for all construction activities within the scope of this project. Further, TxDOT is responsible for securing the Federal and State share of the funding required for the development and construction of the project along with any cost overruns for construction. City funds appropriated for this project include professional services, and local participation. Currently, the City is working on an agreement with the developer, OGC SN Hotel, LP, for the N Stockyards Multifamily development to provide the cost associated with the engineering fees and environmental fees for the traffic signal project design at Business 287 (North Main Street) and 29th Street intersection. The development warranted a traffic signal at the intersection. The developer is designing per the TxDOT standards and will submit the design plans to TxDOT. Design costs and environmental fees are to be bome by the developer. Upon execution of the said agreement with the developer, the funds being appropriated by the City with this M&C for professional services and local participation will be appropriated back to the programmable bucket with a future M&C. No advance payment to TxDOT is required for this project. The final payment to TxDOT for local participation will be based on actual costs. At the end of the project, the asset will remain with the City of Fort Worth. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for the grant portion of the project was not included in the Fiscal Years 2026-2030 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. This project is located in COUNCIL DISTRICT 2. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Texas Department of Transportation FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Traffic Signals project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the Grants Cap Projects Federal Fund, Grants Capital Project State Fund, and 2022 Bond Program Fund for the BUS 287P (N Main St) & 29th project to support the execution of the Advance Funding Agreement. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
